ORDINANCE NO 96-55
AN ORDINANCE relating to subdivisions, defining terms and establishing
procedures for subdividing land, amending Sections and
Sub Sections 14 10 240, 14 10 270, and 14 20 020, all of
the City of Yakima's Municipal Code
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF YAKIMA
Section 1. Section 14 10 240 of the City of Yakima Municipal Code is
hereby amended to read as follows
"14 10 240 Short Subdivision 'Short subdivision' means the
division or redivision of land into nine or less lots for the purpose of
sale, lease, or transfer of ownership in the present or future except
as provided in Section 14 05 100 (G) of this title "
Section 2. Section 14 10 270 of the City of Yakima Municipal Code is
hereby amended to read as follows

"14 10 270 Subdivision 'Subdivision' means the division or
redivision of land into ten or more lots for the purpose of sale, lease,
or transfer of ownership in the present or future except as provided
in Section 14 05 100 (G) of this title "
Section 3. Section 14 20 020 of the City of Yakima Municipal Code is
hereby amended to read as follows
"14 20 020 Improvement Requirements
A , All short subdivisions shall comply with the design
and improvement requirements for subdivisions contained in
Chapters 14 30 and 14 35 of this title with the following
exceptions
1 Street, utility, lighting, and sidewalk
improvements for two lot short plats shall at least be
consistent with the size, nature, and availability of
existing improvements which serve adjacent lots and lots
in the immediate vicinity of the proposed short
subdivision
2 Improvement requirements and timelines for
• each two lot short plat shall be established by the
Administrator in conformance with subsection (1) of this
section If requested by the subdivider, the
Administrator shall provide a written determination of
improvements which will be required pursuant to the
provisions of this chapter. Appeal of the Administrator's
determination of required improvements may be had in
the same manner as provided for by Section 14.15 120
(B) of this title
3 In the event the required improvements for a
two lot short subdivision are of a lesser size, quality, or
availability than those improvements which would be
required of a three lot short subdivision or full
subdivision pursuant to Chapters 14 30 and 14 35 of this
title, then each lot in the two lot short subdivision shall
be committed on the face of the short subdivisions, as an
obligation or covenant running with the land, to
participate in future local 'improvements, in compliance
with Chapters 14 30 and 14 35 as it exists at the time the
local improvement district is formed "
Section 4. This ordinance shall be in full force and effect thirty days
after its passage, approval, and publication as provided by law and by the
City Charter

SUMMARY EXPLANATION.
Attached is a proposed subdivision ordinance amendment which would
(A) Permit 9 lot short subdivisions (Short plats are now limited
to 4 lots)
(B) Permit short subdivisions of 2 lots to provide street, utility,
lighting, and sidewalk improvements consistent with
improvements which serve adjacent Tots (Currently, 4
lot short subdivisions may provide improvements consistent with
adjacent lots )
The proposed ordinance amendment was developed in response to a proposed
affordable housing demonstration project by the City of Yakima Office Of
Neighborhood Development Services and United Builders The project would
construct six (6) single family dwellings each located on an individual lot Permitting
nine (9) lot short subdivisions will save this proposal the review and processing time of
the long subdivision process
Staff met with the Community and Economic Development Review Committee July 31,
1996 and with Phil Hoge Betty Gaudette and Terry Chacon August 1, 1996 Both
groups concurred with proposed legislation
