HomeMy WebLinkAbout1982-2643 INDUSTRIAL WASTE SEWER USE, DISPOSAL & TREATMENT OF SEPTAGE WASTE MATERIAL AT WASTEWATER TREATMENT PLANT. ORDINANCE NO'.. 6 4 3 AN ORDINANCE relating to public services and utilities; regulating industrial waste sewer use; providing for disposal and treatment of septage waste material at the Wastewater Treatment Plant; repealing Chapter 7.16,. "Industrial Waste Sewer Use ", and Sections 7.16.010, 7.16.020, 411 7.16.030, 7.16.040, 7.16.050 and 7.16.060 thereof; re- pealing Subsection 7.60.020D; amending Subsection 7.62.050H, and enacting Chapter 7.63, " Septage Waste Disposal ", and Sections 7.63.010, 7.63.020, 7.63.030, 7.63.040 and 7.63.050 as a new chapter and new sections, all of the City of Yakima Municipal Code. BE IT ORDAINED BY THE CITY OF YA IMA: Section 1. Chapter 7.16, "Industrial Waste Sewer Use ", and Sec- tions 7.16.010, 7.16.020, 7.16.030, 7.16.040, 7.16.050 and 7.16.060 thereof, and Subsection 7.60.020D, all of the City of Yakima Municipal Code, are hereby repealed. Section 2. Subsection 7.62.05011 of the City of Yakima Municipal ID Code is hereby amended to read as follows: "7.62.050 Use of Public Sewers. H. (1) When required by the Director of Engineering & Utilities, the owner of any property serviced by a building sewer carrying industrial: wastes shall install a suitable structure together with such necessary meters and other appurtenances in the building sewer to facilitate observation, sampling, and measurement of the wastes. Such structure, when required, shall be accessibly and safely located and shall be constructed in accordance with plans approved by the Director of Engineering & Utilities. The structure shall be installed by the owner at his expense and shall be maintained by him so as to be safe and accessible at all times. (2) All wastes discharged into the industrial wastes sewer shall be adequately screened by a twenty mesh or finer screen before discharge. An additional screen, with openings not to exceed III one - fourth : inch square, shall be instal led in a fixed position so that all material must pass through said screen immediately before entrance into sewer." Section 3. Chapter 7.63, "Septage Waste Disposal ", and Sections 7.63.010, 7.63.020, 7.63.030, 7.63.040 and 7.63.050 are hereby enacted as a new chapter and new sections of the City of Yakima Municipal Code to read as follows: "Chapter 7.63 SEPTAGE WASTE DISPOSAL 7.63.010 Septage Waste Defined. As used in this chapter, the phrase "septage waste" mans a semiliquid substance consisting of set - tled sewage solids combined with varying mounts of water and dissolved III materials generated from a private or public septic tank or other pri- vate or public wastewater treatment system. RESORD J1 10/5/82 7.63.020 Septage Waste Disposal - Condition. A. Septage waste will be accepted for disposal at the Wastewater Treatment Plant subject to the provisions, terms and conditions spec- - ified in this Chapter, and subject to all applicable rules and regu- • lations of Chapter 7.62 of the City of Yakima Municipal Code, subject to . all applicable rules and regulations of the Yakima County Health Dis- trict related to septage waste disposal, and subject to rules and regu- - lations adopted by the City Director of Engineering & Utilities as authorized by this chapter. W. No septage waste shall be accepted for disposal at the Wastewater Treatment Plant unless the hauler holds a valid and applicable Yakima County Health District registration certificate and unless the vehicle Which hauls the septic waste to the Wastewater Treatment Plant for disposal has been approved by the Yakima County Health District in connection with the issuance of the registration certificate. C. Septage waste will not be accepted for disposal at the Wastewater Treatment Plant if any of the following conditions exist: 1. The septage waste is of a quality or contains any substance, the discharge of Which into the city public sewer system is prohibited or limited by Section 7.62.050 of the City of Yakima Municipal Code, 2. The hauler of. the septagOeste does not hold a valid appli- cable Yakima County Health District registration certificate, or other- wise fails to satisfy or comply with the requirements of any applicable provision of this Chapter, any applicable rule or regulation of the Yakima County Health District, or rule or regulation adopted by the City Director of Engineering & Utilities pertaining to septage disposal; 3. Payment for the hauler of a billing by the city to that hauler for septage disposal fees is unpaid and more than thirty (30) days have elapsed from the date of the billing. 7.63.030 Disposal -Fee - Payment • A. A fee at the rate of $.019 per gallon shall be paid to the city by the septage hauler for septage waste disposed of at the Wastewater Treatment Plant. B. The amount of the disposal fee, at the rate specified in Subsection A of this section, shall be based on the capacity of the hauling tank as certified by the Yakima County Health District in connection with the issuance of the applicable Yakima county Health District regiStration permit. C. The disposal fee shall be payable monthly. A billing shall be rendered monthly by the city for all disposal fees due from septage waste haulers for the precArling month and shall be payable thirty (30) days from the date it is issued by the city. 7.63.040 Liability Insurance Required. No septage waste shall be accepted for disposal at the Wastewater Treatment Plant unless the hauler has filed with the office of the Wastewater Treatment Plant Superintendent a certificate or other proof of the existence of lia- bility insurance with coverage of not less than $250,000 for property damage to city-owned property resulting from operations of the septage waste hauler. 7.63.050 Rules and Regulations. The Director of Engineering & Util- ities is hereby authorized to adopt such rules and regulations as the Director deems necessary carry out the provisions of this Chapter and to regulate the disposal of septage waste at the Wastewater Treatment Plant, Which rules and regulations shall not conflict with the pro- visions Of this Chapter.!' • Section 4. This ordinance shall be in full force and effect thirty days after its passage, approval and publication as provided by law and by the City : Charter.
