AN ORDINANCE accepting the recommendation of the Planning Commission
and granting a major modification of a planned develop-
ment affecting property at 105 West Washington Avenue
in the City of Yakima, Washington.
WHEREAS, pursuant to due and legal notice, the City Council
of the City of Yakima held a hearing on the 26th day of October,
1982, upon the recommendation of the Planning Commission to grant
an application of Scott Burd and others for a major modification
of a planned development zone applicable to property at 105 West
Washington Avenue, Yakima, Washington, the legal description of
which is set out hereinbelow, and

111 WHEREAS, as a result of its hearing, the City Council deter-
mined that the major modification should be granted, and makes its
following findings and conclusions:
FINDINGS:
1. The application is to modify an existing planned develop-
ment zone from commercial/multi-family to single family
residential by establishing a 66 unit mobile home park for adults
only. The on-site improvements, water, sewer, streets and side-
walks are to be privately owned and maintained with all the
utilities to be placed underground. A site screening wall is
to be extended the width of the frontage along West Washington
Avenue. A $12,500 square foot storage area for park residents
is being provided at the northwest corner of the site. The time-
table for construction indicates the park will be ready for
occupancy in mid April of 1983.
2. The surrounding zoning and land use of the unimproved
commercial/multi-family planned development is as follows:
North R-2 Two Family-Church Complex

South County R-2 Two Family-Single Family Residence/
Light Industrial
East Planned Mobile Home Park
Development
West Planned Post Office
Development
3. The site, in conjunction with an existing mobile home
park and post office site, were zoned for planned development in
1971. The original proposal was to develop 46 acres along the
north side of West Washington Avenue in four phases, with the
first • and fourth phases to consist of the existing mobile home
4116 park complex. The second phase was to construct a mini-mall/
commercial -.center, and the third phase was to be multi-family
residential development.. A major portion of the commercial
site was taken by the federal government for a new post office
facility during the mid 1970's.
4, The Planning Commission recommended to the City Council
that the request for the major modification of the planned
development zone be granted subject to the condition that
provision be made for a clearview on the applicants' property

for safety purposes related to the use of the post office service
entrance.
CONCLUSIONS:
1. The recommendation of the Planning Commission should
be affirmed, and the major modification should be granted subject
to the condition stated above, now, therefore,
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. The recommendation of the Planning Commission of
the City of Yakima that a major modification be granted to the
planned development zone applicable to property at 105 West

Washington Avenue in the City of Yakima, Washington, more partic-
ularly described as follows, to wit:
All that part of Lots 10, 11, 12 and 13 of PHOEBE D.
ADAMS SUBDIVISION the northwest quarter of Section 31,
Township 13 North, Range 19 East, W.M., according to
the plat thereof recorded in Volume "A" of Plats, page
68, records of Yakima County, Washington, lying west
of the following described line:
Commencing at the northwest corner of Lot 11 of said
plat; thence north 89°54'30" east 931.00 feet to the
point of beginning of said described line; thence
south 1°01'10" east parallel with the west line of
said plat to. the south line of Lot 13 of said plat
and the terminus of said described line,
• EXCEPTING THEREFROM THE FOLLOWING:
1. The north 500.00 feet, as measured along the west 111
line of Lot 11 and parallel with the north line, of
Lots 11 and 10 of said plat.

411 2. Beginning at the Southwest corner of Lot 12 of
said plat; thence east along the south line of Lot 12
of said plat 440.00 feet; thence north 1°01'10" west
parallel with the west line of said plat 655.00 feet;
thence west parallel with the south line of Lot 12
41 of said _plat 100.00 feet; thence north 1°01'10" west
parallel with the west line of said plat to a point
which is 500.00 feet south 1 east of the north
line of Lot 11 of said plat; thence south 89°54'30"
west parallel with the north line of Lot 11 of said
plat to the west line of Lot 11 of said plat; thence
south 1°01'10" east to the point of beginning.
3. The south 10.00 feet of Lots 12 and 13 of said
plat for road.
is hereby approved, and the major modification to the planned
development zone applicable to the aforesaid property is hereby
granted, all in accordance with, and to conform to, the amended
final development plan and program therefore approved by the
Yakima Planning Commission, a copy of which is attached hereto
and by reference made a part hereof; provided, that provision
be made for a clearview across a portion of the property described
above as necessary for safe use of the adjacent post office
service entrance.
Section 2. The above change in zoning shall be included
and depicted on the next regularly amended use district map
prepared by and for the city.
Section 3. The City Clerk is hereby authorized and directed
to file with the Yakima County Auditor a certified copy of this
ordinance.
Section 4. This ordinance shall be in full force and effect
thirty days after its passage, approval and publication as
provided for by law and by the City Charter.
