HomeMy WebLinkAbout1982-2649 REZONE PROPERTY IN 600 BLOCK OF SOUTH 3RD STREET 410 ORDINANCE NO. 2 4 9 AN ORDINANCE rezoning property in the 600 block of South 3rd Street in the City of Yakima, Washington, from R-3, Multiple-Family Zone to B-3, General Business Zone. WHEREAS, pursuant to due and legal notice, the Yakima City Council held hearings on October 26, 1982 and November 2, 1982 on the application of Gerald Gipson and others for the rezone of property in the 600 block of South 3rd Street in the City of Yakima, Washington, from R-3, Multiple-Family Zone to B-3, General Business Zone, applicable to the real property described hereinbelow, and 411 WHEREAS, as a result of its hearings, the City Council determined that the rezone request should be granted, and hereby makes its following findings and conclusions: FINDINGS: 1. The property for which the rezone is sought consists of eight lots on the west side of South 3rd Street, in the 600 block, in the City of Yakima, Washington. The purpose of the request is to accommodate an addition to an existing commercial structure at 616 South 3rd Street and the establishment of an automobile sales lot on 610-614 South 3rd Street. The Aft application does not indicate any proposed new uses of the other four lots which are presently occupied by single-family residences. 2. Land Use and Zoning Zoning Land Use North B-3 Commercial (Oscar Daniels House Moving, Lay & Nord) South B-3 City Park & Commercial (Minda Lanes, Bowling, Nu-Way Cleaners, gill Gordie's Garage) East R-3 Single & Multiple-Family Residential, Mount Hope Baptist Church West B-3 Single-Family Residential 3. Comprehensive Plan The request would permit CBD support intensity development 10 ' which would be compatible with established zoning to the north, south, and west and "compatible with site considerations" with residential zoning and uses to the east. 4. Future R-3 Multiple-Family development of the site is 111 unlikely due to its location adjacent to commercial zoned properties and along an arterial street. / 5. Expansion of the present non-conforming commercial use at 616 South 3rd Street would require the structure and off-street parking to be brought up to code resulting in a general improvement of the site. The proposed auto sale lot would require paving and provisions for drainage. 6. The Yakima City Planning Commission, on October 6, 1982, recommended approval of the request. CONCLUSIONS: 1. The request generally conforms to the Urban Area Compre- hensive Plan. 2. The development of the property for B-3 uses would generally improve the appearance of the site. 3. The Planning Commission recommendation that the rezone be granted should be affirmed, and the rezone should be granted. now, therefore, BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. The following described real property situate in the 600 block of South 3rd Street in the City of Yakima, Washington, and more particularly described as follows, to-wit: 411 Lots 1-8, Block 57, Town of North Yakima (now Yakima) as recorded in Volume "A" of Plats, Page 10, rerecorded in Volume "E" of Plats, Page 1, records of Yakima County, Washington. is hereby rezoned from R-3, Multiple-Family Zone to B-3, General Business Zone. Section 2. The above change in zoning shall be included and depicted on the next regularly amended use district map prepared by and for the City. Section 3. The City Clerk is hereby authorized and directed to file with the Yakima County Auditor a certified copy of this ordinance. -2- Section 4.
