HomeMy WebLinkAbout1982-2659 TAX ON CITY & PRIVATE REFUSE HAULING OPERATIONS & THE RATE THEREOF. 41, ORDINANCE NO. AN ORDINANCE relating to refuse collection; imposing a tax on, City and private refuse hauling operations and specifying the rate thereof; amending Subsection 4.16.180 C and Section 7.64.020 of the City of Yakima Municipal Code; and declaring an emergency. WHEREAS, City of Yakima Ordinance No. 2637 enacted September 21, 1982, provided, among other things for the amendment of Subsection 4.16.180 C of the City of Yakima Municipal Code, and WHEREAS, Ordinance No. 2637 is suspended from taking effect by a referendum petition filed with the Yakima City Clerk, with the result that the effectiveness of Ordinance No. ii, 2637 is currently suspended so that Subsection 4.16.180 C of the City of Yakima Municipal Code currently remains in effect without amendment pending the disposition of those referendum proceedings, and WHEREAS, the amendment of Subsection 4.16.180 C of the City of Yakima Municipal Code as provided herein in not intended by the Yakima City Council as a repeal or amendment of Ordinance No. 2637, nor it is intended that Ordinance No. 2637 and the pending referendum proceedings be superseded or in any manner affected by the amendment of Subsection 4.16.180 C as provided 11, herein; rather, this amendatory ordinance is enacted solely for the purpose of increasing the rate of existing taxes on both the City and private refuse hauling operations, and WHEREAS, the City Council finds and declares an emergency to exist so as to authorize the immediate effectiveness of this ordinance in order to increase revenue to balance the City budget for 1983, which budget has been considered and will be adopted 111 within the time schedule provided by state law, but which takes it necessary that ordinances implementing that budget be enacted with an emergency clause, now, therefore, 1110 BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. Subsection 4.16.180 C of the City of Yakima 111 Municipal Code is hereby amended to read as follows: "4.16.180 Collection of Garbage in Business Class -- License and Tax Regulations. C. License Tax Imposed -- Amount. Commencing January 1, 1983, there is levied upon every person, association or corporation holding a license for the collection and hauling of garbage, refuse or debris within the city or in gathering the same within the city for disposal at some point or area outside of the city, a tax for the privilege of doing so, such tax to be equal to eight percent of the cash receipts from all customers within the city served by the license holder. Such tax shall be due and payable in quarterly installments, for quarters ending with the last days of March, June, September and December of each year; and remittance therefor shall be made on or before thirty days after the end of the quarterly period for which it is due." Section 2. Section 7.64.020 of the City of Yakima Municipal Code is hereby amended to read as follows: "7.64.020 Refuse Tax. Commencing January 1, 1983, there is levied against the street and refuse division of the department of public works of the City of Yakima a tax at the rate of eight percent of the total gross revenue of the municipal refuse fund derived from receipts for refuse collection service charges." Section 3. This ordinance is one to provide for the immediate preservation of the public peace, property, health, safety and welfare of the people of the City of Yakima and an emergency is hereby declared to exist and this ordinance shall be in full force and effect immediately upon its passage, approval and • publication as provided by law and by the City Charter.
