ORDINANCE NO. f
AN ORDINANCE relating to building regulations; adopting by reference
• the Uniform Building Code, 1982 Edition, copyright 1982
by the International Conference of Building Officials,
regulating the erection, construction, enlargement,
alteration, repair, moving, removal, conversion, de-
molition, occupancy, equipment, use, height, area and
maintenance of buildings or structures in the City of
Yakima; and amending Sections 11.04.010, 11.04.015,
111P 11.04.020, 11.04.025, 11.04.027, 11.04.055 and 11.04.070,
all of the City of Yakima Municipal Code.
WHEREAS, R.C.W. 35.21.180 authorizes cities and towns within the
State of Washington to pass ordinances adopting by reference compila-
tions and codes relating to the construction of buildings, and
WHEREAS, the City Council of the City of Yakima has heretofore
examined and understands the scope and purpose of the regulations of the
Uniform Building Code, 1982 Edition, copyright 1982 by the International
Conference of Building Officials, and deems it in the best interests of
the City that such Uniform Building Code and Regulations for Bureau-Free
Facilities be adapted as the law of the City of Yakima, and
WHEREAS, one or more copies of such Uniform Building Code have
heretofore been filed and are now on file in the office of the City
Clerk of the City of Yakima for use and examination by the public, as
required by law, now, therefore,
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. Section 11.04.010 of the City of Yakima Municipal Code
is hereby amended to read as follows:
411 "11.04.010 Adoption of Uniform Building Code. The Uniform
Building Code, 1982 Edition, copyright 1982 by the International
Conference of Building Officials, consisting of the Uniform Build-
ing Code, all appendices thereto except Appendix Chapter One, and a
separate supplement volume thereto entitled Uniform Building Code
Standards, of Which no less than one or more copies each have been
filed and now are on file in the office of the City Clerk of the
City of Yakima, is hereby adopted and incorporated as fully as set
out in full herein, as the building code of the City of Yakima;
except as hereinafter amended, and the provisions and regulations
. of the City of Yakima and the several sections or numbers therein
shall constitute, and may be 'referred to as, the numbers of this
Chapter."
Section 2. Sec. 11.04.015 is hereby amended to rPad as follows:

"11.04.015 Amendment,to Section 102. Section 102 of the
Uniform Building Code, as applied to the City of Yakima, is hereby
amended to read as follows:
'Sec. 102. Purpose. The purpose of this code is to provide
minimum standards to safeguard life or limb, health, property and
public welfare by regulating and controlling the design, con-
struction, quality of materials, use and occupancy, location and

maintenance of all buildings and structures within this juris-
diction and certain equipment specifically regulated herein.
Adoption or enforcement of this code shall not be construed
for the particular benefit of any individual person or group of
persons, other than the general public. In the event of a conflict
between the intent of this section and any other section herein,
this section shall govern insofar as applicable.'"
Section 3. Section 11.04.020 of the City of Yakima Municipal Code
is hereby amended to read as follows:

"11.04.020 Amendment to Section 201. Section 201 of the
Uniform Building Code, as applied to the City of Yakima, is hereby
amended to read as follows:
'SECTION 201. There is hereby established in the City of
Yakima the Division of Code Administration in the Department of
Community and Economic Development With shall be under the jur-
isdiction of the Code Administration Manager designated by the
appointing authority. Wherever the term Building Official is used
in this code it shall be construed to mean the Code Administration
Manager.'"
Section 4. Section 11.04.025 is hereby enacted as a new section of
the City of Yakima Municipal Code to read as follows:
"11.04.025 Amendment to Section 420. Section 420 of the
Uniform Building Code, as applied to the City of Yakima is hereby
amended to read as follows:
'SECTION 420. SHAFT is a vertical opening through a building
for elevators, duMbwaiters, mechanical equipment or similar pur-
poses.
SHALL
(a) With respect to the functions and powers of the Director
of Community and Economic Development, the Code Administration
Manager, any agents and employees of the City of Yakima and any
board authorized hereunder, a direction and authorization to act in
the exercise of sound discretion and in good faith;
(b) With respect to the Obligations upon owners and occupants 111
of premises and their agents, a mandatory requirement to act in
compliance with this code at the risk of civil and criminal lia-
bility upon failure so to act."
SMOKE DETECTOR is an approved detector which senses visible or
invisible particles of coMbustion. The detector shall bear a label
or other identification issued by an approved testing agency having
a service for inspection of materials and workmanship at the fac-
tory during fabrication and asseMbly.
STAGE is a partially enclosed portion of an assembly building
which is designed or used for the presentation of plays, demon-
Strations or other entertainment Wherein scenery, drops or other
effects may be installed or used, and where the distance between
the top of the proscenium opening and the ceiling above the stage
is more than 5 feet.
STORY is that portion of a building included between the upper
surface of any floor and the upper surface of the floor next above,
except that the topmost story shall be that portion of a building
included between the upper surface of the topmost floor and the
ceiling or roof above. If the finish ed floor level directly above
a basement or unused under-floor space is more than 6 feet above
grade as defined herein for more than 50 percent of the total
perimeter or is more than 12 feet above grade as defined herein at

any point, such basement or unused under-floor space shall be
considered as a story.
STORY, FIRST, is the lowest story in a building which qual-
ifies as a story, as defined herein, except that a floor level in a
building having only one floor level shall be classified as a first
story, provided such floor level is not more than 4 feet below
grade, as defined herein, for more than 50 percent of the total
perimeter, or more than 8 feet below grade, as defined herein, at
any point.

STREET is any thoroughfare or public space not less than 16
feet in width which has been dedicated or deeded to the public for
public use.
STRUCTURE is that which is built or constructed, an edifice or
building of any kind, or any piece of work artifically built up or
composed of parts ,joined together in some definite manner.'"
Section 5. Section 11.04.027 is hereby enacted as a new section of
the City of Yakima Municipal Code to read as follows:
"11.04.027 Amendment to Section 307. Section 307 of the
Uniform Building Code, as applied to the City of Yakima, is hereby
amended to read as follows:
'Sec. 307. Certificate of Occupancy
(a) Use or Occupancy. No building or structure of Group
E, I, H, B, or R, Division 1 Occupancy, shall be used or occupied,
and no change in the existing occupancy classification of a build-
ing or structure or portion thereof shall be made until the build-
ing official has issued a Certificate of Occupancy therefor as
provided herein.
(b) Change in Use. Changes in the Character or use of a
building shall not be made except as specified in Section 502 of
• this code.
(c) Certificate Issued. After final inspection when it is
found that the building or structure complies with the provisions
of this code and other laws which are enforced by the code enforce-
ment agency, the building official shall issue a Certificate of
Occupany which shall contain the following:
411 1. The building permit number.
2. The address of the building.
3. The name and address of the owner.
4. A description of that portion of the building for Which
the certificate is issued.
5. A statement that the described portion of the building
complies with the requirements of this code for the group
and division of occupancy and the use for which the
proposed occupancy is classified.
)11 6. The name of the building official.
(d) Temporary Certificate. If the building official finds
that no substantial hazard will result from occupancy of any build-
. ing or portion thereof before the same is completed, he may issue a
temporary Certificate of Occupancy for the use of a portion or
portions of a building or structure prior to the completion of the
entire building or structure.
(e) Posting. The Certificate of Occupancy shall be posted in
a conspicuous place on the premises and shall not be removed except
by the building official.

(f) Revocation. The building official may, in writing,
suspend or revoke a certificate of occupancy issued under the
provisions of this code, Whenever the certificate is issued in
error, or on the basis of incorrect information supplied, or When
it is determined that the building or structure or portion thereof
is in violation of any ordinance or regulation or any of the pro-
visions of this code.
(g) Public Nuisance. It is a public nuisance to use or
occupy a building or structure, or any part thereof, of the groups
enumerated in subsection (a) herein without there having been
issued a valid Certificate of Occupancy for such building, struc-
ture or part thereof. Such public nuisance shall be subject to
prevention or Abatement by injunction or other appropriate legal
remedy in the superior court of Washington in Yakima County.'"
Section 6. Section 11.04.055 of the City of Yakima Municipal Code
is hereby amended to read as follows:
"11.04.055 Amendment to Subsection 3802(a). Subsection
3802(a) of the Uniform Building Code, as applied to the City of
Yakima is amended to read as follows:
'Sec. 3802 (a) Where Required. An automatic fire-extin-
guishing system shall be installed in the occupancies and locations
as set forth in this section.
For special provisions and hazardous dhemicals and magnesium,
and calcium carbide, see the Fire Code.
EXCEPTION: Automatic sprinkler systems shall not be required
for controlled atmosphere storage rooms in Which refrigeration
apparatus is installed to control the temperature in the storage
rooms and gas-tight seals are incorporated in the construction of
the roams so as to facilitate the maintenance of an atmosphere
within the storage rooms that is lower in oxygen content and higher
in nitrogen and carbon dioxide content than normal atmosphere."
Section 7, Section 11.04.070 of the City of Yakima Municipal Code
is hereby amended to read as follows:
"11.04.070 Adoption of Regulations for Barrier-Free Facil-
ities. The Regulations for Barrier-Free Facilities, dated October
1, 1976, and amended September 5, 1977, as promulgated by the Wash-
ington State Building Code Advisory Cbuncil, of Which regulations
not less than three copies of eadi have been and now are on file in
the office of the Yakima City Clerk, are adopted and incorporated
as fully as if set out in full herein, as supplements and anend-
ments to the Uniform Building Code adopted by this dapter."
Section 8. This ordinance shall be in full force and effect thirty
days after its passage, approval and publication as provided by law and
by the City Charter. •
