!The City Council met in session on this date at 6:30 P.M. at Station
(KYVE-TV. Councilmen present at the meeting were Mayor Bert Broad,
!Wray Brown, Betty L. Edmondson, Dick Jarms, W. K. "Pete" Moore,
1Don Schussler and Dr. Bill Simmons.
!Council was given the final recap of Budget adjustments made for
1976, which indicate that the combination of factors in increasing
and decreasing the Budget left a make-up balance of $7,400 to be
made up from Capitol Outlay in City Hall remodeling, office
itraining equipment, and replacement of Mag Card II equipment for
the Word Processing Center.
;Director of Management and Budget Charles Rains indicated that the
!other Budget adjustments in Parks and Recreation would be made
'up from Contingency reserves. Other expenditures from FRS funds
(include Health District, Voice Privacy System and Fire Escape.
The Council next listened to Sue McCallister and Celeste Sunderland
!re proposed funding for the VAC for 1976. They indicated good
;support has been received from public agencies in the past year
and were looking forward to continued support in the coming year
;for their efforts. Their annual budget is in the amount of $35,000
and they request $6,000 from the City of Yakima.
1 Mayor Broad reviewed the letter of resignation received from Human
!Relations Commission member Ann Miller.
iGeneral discussion followed on the Visitor and Convention Bureau
for Bicentennial Pavilion operations. City Manager McMicken
!indicated that a Council Committee be formed to meet with the
1 Visitors and Convention Bureau committee to review the operational
irequirements of the Bicentennial Pavilion. Councilman Edmondson
i suggested that the City Manager and City Attorney draw up a
;;contract with the Visitor and Convention Bureau for this purpose;
;however, it was determined by the Council that this action should
; a meeting between the Council and Sam Burns, the Consultant
iistudying operational requirements of the Bicentennial Pavilion.

At 8:00 P.M., the Council members moved into the television
;studio of KYVE-TV for the balance of the meeting, Mayor
!Broad presiding, Councilmen Brown, Edmondson, Jarms,
'Moore, Schussler and Simmons, City Manager McMicken and
City Attorney Andrews present on roll call.
The Invocation was given by Councilman Brown.
The minutes of the previous meeting of December 8, 1975
'having been duly certified accurate by two Councilmen
and no one present wishing to have said minutes read publicly,
:Mayor Broad declared said minutes approved as recorded.
IMrs. Judy Matson, Yakima City/County Bicentennial Chairman
!presented the Washington State Bicentennial Essay Contest Award
Ito Cindy Warren for her essay submitted in the adult category.
The award included a Certificate of Recognition, $25.00 and a
!bronze medal.
!Mr. Frank Bradley, Chairman of the Capitol Theatre Committee,
, summarized a written report to the City Council from the
'Capitol Theatre Committee giving their recommendations re future
!restoration of the Capitol Theatre. He reviewed the findings
of the Committee obtained after contacts with several civic
organizations and community meetings in which alternatives
for the future of the Theatre were presented. He reported
that considerable community interest is maintained in the
'restoration of the Theatre and it is believed to be superior
in its present location and capacity as a performing arts
itheatre. Mr. Bradley emphasized the feelings of the Committee
that the restored theatre is necessary to the Yakima community
and recommended that in reference to its future, the City
,Council adopt a policy statement in reference to the restoration
of the Theatre and begin restoration by August of 1976.
He indicated the statement should contain a declaration
that property taxes will not be used to continue the Capitol
,Theatre as a performing arts center. He further recommended
that the restoration take place in two phases, to include
;elementary restoration of the theatre building necessary
for the scheduling performing arts and secondly, :total
!historical restoration of the Theatre and outfitting with
!necessary equipment. He recommended immediate action by
the Council to formalize authorization for work on the walls
now standing. He estimated that Phase I will take approximately
!four months at $40,000. Upon completion of Phase I, a comprehen-
sive funding program will be submitted. He requested that
the Council take action on the recommendations for a Statement
lof Policy, Phase Construction, work on the supporting walls
and authorization for architectural services. Councilman
Jarms indicated he wished time to study the written report
, and decide on these matters within another week. Mr. Lewis
'spoke in favor of the Theatre restoration indicating that
!without it, Yakima will not have an adequate performing
arts theatre. Mr. H.G. Wells, Chamber of Commerce, also
.endorsed the proposed project. Councilman Schussler explained
that the Council extended funding for the Capitol Theatre
Corporation after the Theatre fire this past year and asked
them to report before the end of the year concerning the Theatre's
future. He expressed appreciation for their efforts and
!emphasized that there appears to be much support in the
=community for a good performing arts facility and urged
the Council to act quickly on the recommendations.
Judge George Mullins, being present, spoke to the Council
,regarding probation services for the Yakima District Court.
He explained that the Court is having a problem and that an
.adequate probation staff for the District Court is needed.
In monetary terms, he reviewed the cost for services over
the past four years. The City is charged $4 per case indicating
the cost has been $40,000 over the past four years. Costs
are collected in approximately 75 percent of the cases.

He requested funding from the City in the amount of $30,000
to continue funding probation costs and asked that the Council
reconsider this matter. Mayor Broad indicated that this matter
was considered carefully in reference to budget discussions by
the Council and reiterated the fact that the Council did not
Ifeel it was their responsibility and therefore, should not
be funded.
1 City Manager McMicken requested approval of a Change Order
to the contract with Hill Construction Company for "winterizing"
the Capitol Theatre. He explained that this will involve protection
of existing walls and covering the stage and other adjoining
:parts which have been left standing. This work is requested,
since it is believed the winter weather might cause deterioration
of the partial structure. He indicated Paddock and Hollingberry,
lArchitects, support the Change Order in the amount of $6,646.50.
The protective covering will involve the stage floor and the
!partial walls,supporting beams, and balcony. A ten day extension
on the present contract is requested. After discussion, it
was MOVED by Moore, seconded by Schussler that the Council
;approve the Change Order, as presented: carried, Broad, Brown,
i Edmondson, Jarms, Moore, Schussler and Simmons voting aye by
;voice vote.
'City Manager McMicken reviewed the Collective Bargaining Agreement
;to be executed with the American Federation of State, County
and Municipal Employees, Local 112. He indicated that the
!agreement includes provisions for pregnancy disability, and employee
;salary increases of 10% for the coming year. It was MOVED
by Brown, seconded by Simmons that Resolution No. D-3428, authoriz-
ing the execution of said agreement with AFSCME, be passed:
icarried, Broad, Brown, Edmondson, Jarms, Moore, Schussler and
(Simmons voting aye on roll call.
RESOLUTION NO. D-3428, A RESOLUTION authorizing and directing
the City Manager and City Clerk of the City of Yakima to execute
the Collective Bargaining Agreement with the Washington State
Council of County, and City Employees, Local 1122 of the American
!Federation of State, County and Municipal Employees, AFL-CIO.
!City Manager McMicken explained that the two-year agreement with the
Yakima Police Patrolmen's Association contains no essential
changes and therefore, _legislation is not required;for Ocliitlnuation.!
The 1976 provisions includes a 10.9% increase in salaries and
Hfringe costs, health insurance payments for families increased
!Ifrom $8 to $17 per month and an increase in dental coverage.
City Manager McMicken next reviewed the Collective Bargaining
HAgreement with the Yakima Firefighter's Association, Local
H469. He indicated that the Agreement includes increases in medical
'insurance for dependents, dental insurance to dependents extended
at full premium and increase in life insurance. Duty hours will
!
be reduced to 55 hours per week. He further reviewed the provisions,
for non-LEFF employees,to include an increase in benefits for
families in medical and dental coverage. It was MOVED by Schussler,
! 'seconded by Jarms that Resolution No. D-3429, authorizing the
!execution of said agreement with IAFF, Local 469, be passed:
hcarried, Broad, Brown, Edmondson, Jarms, Moore, Schussler and
Simmons voting aye on roll call.

'City Manager McMicken requested authorization to execute contracts
with the Yakima County Division of Manpower Development for
CETA positions, explaining that this involves 50 to 80 positions
'throughout the year. The City receives funds to disperse
!salaries similar to regular employees. He explained that
; the contract involves two agreements to include police and
fire personnel under Title II (32) in the amount of $344,000 for
the period July, 1975 through July, 1976. Under Title VI,
$140,000 is allocated and includes personnel in Traffic Engineer
!Department, Airport Personnel, and Parks and Recreation personnel,
to be funded through next June. Funding for Community Development
,workers is extended through March of 1976. It was MOVED by
Brown, seconded by Simmons that Resolution No. D-3430, authorizing
the execution of said agreements,be passed: carried, Broad,
IBrown, Edmondon, Jarms, Moore, Schussler and Simmons voting
,aye on roll call.
RESOLUTION NO, D-3430, A RESOLUTION authorizing the City Manager
and City Clerk of the City of Yakima to execute contracts
with the Yakima County Federal Programs Authority to fund
!positions under the Comprehensive Employment and Training
.Act of 1973.
;City Manager McMicken explained the proposed Joint Computer
Center Lease Agreement with Yakima County, indicating that
this Agreement is renewed each year covering space utilized
'in the County Courthouse. The rental rate is the same as
'last year, but the room size has been changed since the Computer
; Center has been expanded. It was MOVED by Schussler, seconded
by Edmondson that Resolution No. D-3431, authorizing the execution
of said Agreement, be passed: carried, Broad, Brown, Edmondson,
'Jarms, Moore, Schussler and Simmons voting aye on roll call.
!RESOLUTION NO. D-3431, A RESOLUTION authorizing and directing
the City Manager and City Clerk of the City of Yakima to execute

!Yakima.
It was MOVED by Moore, seconded by Simmons that Resolution
No. D-3432, authorizing the repair of a Boom Truck for the
!Public Works Department, be passed: carried, Broad, Brown,

on roll call.
,RESOLUTION NO. D-3432, A RESOLUTION authorizing the repair
of a City Boom Truck without calling for bids.
City Manager McMicken requested the approval of professional
'engineering services for analysis and testimony in condemnation
!cases for the Downtown Improvement Project. He explained
!that Counsel from the firm of Stevens, Thompson and Runyan in
, Seattle will provide services of Ken Cottingham, Traffic Engineer,
for the necessary professional engineering services. He explained
that the City will make an appearance in court the 19th of
;December regarding certain properties to be acquired. Since
IMr. Cottingham worked on the earlier Environmental Impact State-
,
ment, it is felt that his expertise in this area will be beneficial.
In response to a question from Councilman Edmondson, City
,Manager McMicken reviewed the breakdown of costs involved
as per letter dated December 10, 1975 to include the Traffic
;Engineer at $40.00 per hour, support personnel at $12.00 per
'hour and travel expense at $.18 per mile. It was MOVED by
!Schussler, seconded by Brown that Ken Cottingham of Stevens,
!Thompson and Runyan, Inc., be engaged for the professional
; engineering services, as requested: carried, Broad, Brown,
;Edmondson, Jarms, Moore, Schussler and Simmons voting aye
by voice vote.
DECEMBER 15, 1975
City Manager McMicken reviewed the report of Sidewalk Repair
Protests dated December 9, 1975 received from the Director of
Public Works. The Public Works Department has analyzed protests
received and report 36 percent valid protests, which is not
enough to stop the repair program. He indicated that the Council
would review parts of the program in January and call for another
public hearing. He indicated that the Street Department has
done some repair work already and repairs are being done in
random areas. After discussion, it was MOVED by Edmondson,
seconded by Moore that February 16, 1976 be the date set for
hearing on this matter: carried, Broad, Brown, Edmondson, Jarms,
Moore, Schussler and Simmons voting aye by voice vote.
In accordance with a report received last week regarding outdated ,
regulatory license fees and regulations for skating rinks, it
was MOVED by Moore, seconded by Brown that Ordinance No. 1866
repealing said fees and regulations, be passed: carried, Broad,
Brown, Edmondson, Jarms, Moore, Schussler and Simmons voting
aye on roll call.
ORDINANCE NO. 1866, AN ORDINANCE relating to licenses and business
regulations; repealing Section 5.02.030 and Chapter 5.68, consist-
ing of Section 5.68.010 and 5.68.020, all of the City of Yakima
Municipal Code.
An Ordinance transferring and appropriating $700 in the Central
Business District Fund, being read by title only at this meeting,
was laid on the table for one week or until December 22, 1975.
City Manager McMicken explained that this involves parking meter
proceeds appropriated for the additional 1975 bills incurred
in the Central Business District project.
An Ordinance appropriating the amount of $8,000 to the Transit
Fund, having been read by title only at this meeting was laid
on the table for one week or until December 22, 1975. City
Manager McMicken explained that this will pay Data Processing
service charges incurred in 1975.
An Ordinance appropriating $36,000 in the General Fund, having
been read by title only at this meeting, was laid on the table
for one week or until December 22, 1975. City Manager McMicken
explained that this involves arterial street improvement projects
which were begun in advance of State and Federal approval.
Approval has now been received on these projects.
Petition No. 872, having been filed with the City Clerk on December:
8, 1975 by Ray Lucus and Others, requesting the improvement
of property by construction of a sewer in the Prospect Park
Addition, it was MOVED by Schussler, seconded by Brown that
Petition No. 872, for the creation of a Local Improvement District,1
be referred to the City Manager and staff for study and recommenda-
tion: carried, Broad, Brown, Edmondson, Jarms, Moore, Schussler
and Simmons voting aye by voice vote.
A Damage Claim having been filed with the City Clerk on December
' 11, 1975 by A.D. Schiffner, 1008 Tieton Drive, in the amount
of $695.20 for overpayment on a water billing, it was MOVED
by Schussler, seconded by Edmondson that said Damage Claim be
referred to the City Manager and Staff for study and recommendation:
carried, Broad, Brown, Edmondson, Jarms, Moore, Schussler and
Simmons voting aye by voice vote.
