HomeMy WebLinkAbout1983-2680 REZONE PROPERTY IN THE 300 BLOCK OF SOUTH 10TH AVENUE ORDINANCE Nd. 2 t 8 0 AN ORDINANCE affirming the recommendation of the Planning Commission and rezoning property in the 300 block of South 10th Avenue from R-3, Multiple-Family Zone to B-1, Modified Business Zone. WHEREAS, pursuant to due and legal notice, the City Council of the City of Yakima held a hearing on the 22nd day of February, 1983, on the recommendation of the Planning Commission that property situate in the 300 block of South 10th Avenue in the City of Yakima, Washington, the legal description of which is set out hereinbelow, be rezoned from R-3, Multiple-Family Zone to B-1, Modified Business Zone, and WHEREAS, as a result of its hearing, the City Council deter- 111 mined that the rezone should be granted, and hereby makes its following findings and conclusions: FINDINGS 1. The property involved in the rezone request consists of eight lots situate on the east side of South 10th Avenue between Spruce Street and Pine Street in the City of Yakima. The property is presently zoned for R-3, Multiple-Family Zone, and the request is those lots to be rezoned to B-1, Modified Business Zone for the purpose of developing the property for professional office use. 411 2. The properties under consideration are occupied by well maintained single-family dwellings, one lot is vacant, and is zoned R-3 (Multiple-Family Res.). Land use and zoning on adjacent properties is as follows: Zoning Land Use South North h Single-family residential and convalescent home • R-3 Single-family residential East Single-family residential West B-1 Professional offices and single- ., family residential 3. The property for which the rezone is sought is adjacent to property presently zoned B-1, Modified Business Zone.and is buffered from adjacent R-3, Multiple-Family Zone properties by 411 and alley and streets. Any potential problems of incompatibility between the use of the rezoned property and adjacent properties are resolved by this buffering effect. 4. There is a demand by physicians and related services for property to be developed for professional offices in this 111 area adjacent to the existing medical center area, but there is 410 a shortage of property with. B-1, Modified Business Zone zoning and available for development as professional offices in the area. 5. The Yakima City Planning Commission, in public hearing on February 1, 1983, recommended approval of the rezone request. CONCLUSIONS 1. There is a very limited supply of properly zoned land to accommodate the demand for growth of the medical center area. Growth to the west and south is generally undesirable except for a few_very restricted circumstances. Growth to the north and east is acceptable provided it occurs in an orderly manner with limited compatibility conflicts with adjacent properties. The growth associated with this rezone is occuring in a proper direction and in an orderly manner. 2. The recommendation of the Planning Commission to grant the rezone should be affirmed, and the rezone should be granted, now, therefore, BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. The recommendation of the Planning Commission of the City of Yakima that the following described real property situate in the 300 block of South. 10th Avenue in the City of Yakima, 111 Washington, and more particularly described as follows, to wit: Both the east half and the west half of Lot 9; Lots 10, 11, 12, 13, 14, 15 and 16, Block 374, Capitol Addition to North Yakima, now Yakima, as recorded in Volume "A" of Plats, Page 29, records of Yakima County, Washington. be rezoned from R-3, Multiple-Family Zone to B-1, Modified Business Zone be, and the same is hereby, approved and said real property is hereby rezoned toB-1, Modified Business Zone. Section 2. The above. change in zoning shall be included and depicted on the next regularly amended Use District Map by and for the city. -2- Section 3. The City Clerk is hereby authorized and directed 410 to file with the Yakima County Auditor a certified copy of this ordinance. Section 4. This ordinance shall be in full force and effect thirty days after its passage, approval and publication as provided by law and by the City Charter.
