AN ORDINANCE accepting the recommendation of the Planning Com-
mission and rezoning property at the southeast
corner of the intersection of South 17th Avenue
and Bonnie Doone in the City of Yakima, Washing-
* ton, from Planned Development Zone to R-2, Two-
Family Zone.
WHEREAS, pursuant to due and legal notice, the City Coun-
cil of the City of Yakima held a hearing on the 2nd day of
September, 1980, upon the recommendation of the Planning Com-
mission that real property situate at the southeast corner of
the intersection of South 17th Avenue and Bonnie Doone, in the
City of Yakima, Washington, the legal description of which is
411 set out hereinbelow, be rezoned from Planned Development Zone
to R-2, Two-Family Zone, and
WHEREAS, as a result of its hearing, the. City Council
hereby makes its following findings and conclusions:
FINDINGS:
1. The one lot constituting the subject property consists
of a portion of a larger site, constituting a total of
four lots, all as depicted on the map attached hereto and
made a part hereof. The entire larger site is presently
zoned as Planned Development Zone. Improvements on the
entire larger site consist of one single-family dwelling
situate on the subject property. The subject property
is now owned by a separate owner from the balance of'the
property within the Planned Development Zone, who desires
to improve the subject property for R-2, Two-Family Zone
use, rather than as a part of the larger Planned Develop-
ment Zone.
2. Of the remaining three lots to the south in the larger
411 site constituting the total Planned Development Zone, the
easterly two have no street or utility access and are
therefore best suited to a combined development of all
three southerly lots. These three lots can be developed
in accordance with the existing Planned Development
independently of the subject property. R-2 zoning of
these lots, however, would not permit a single cohesive
development.
3. The General Plan as amended by the Land Use Plan for
Nob Hill Boulevard indicates the site as best suited for
medium density residential (12-24 DU/NRA). All other
properties in the vicinity are zoned R-2 and occupied
by single family dwellings.
4. On August. 5, 1980, the Planning Commission held its
public hearing on this rezone and recommended that the
northerly lot, legally described below, be rezoned from
Planned Development Zone to R-2, Two-Family Zone.
CONCLUSIONS: •
1. The Planning Commission initiated a rezone of the
property to a specific zone (R-2) rather than initiating
a consideration of whether the continued existence of
the Planned Development is in the public interest under
the authority of Section 12.50.140 of the City Zoning
ordinance. For this reason, these conclusions are based
upon public benefits of the proposed R-2 zone.
2. The proposed R-2 zone is in accordance with the General
Plan and is compatible with adjacent land uses and zoning.
3. The recommendation of the Planning Commission should
be affirmed and the rezone should be granted .
now, therefore,
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. The recommendation of the Planning Commission
of the City of Yakima that the following described real property
situate at the southeast corner of the intersection of South 17th
Avenue and Bonnie Doone in the City of Yakima, Washington, and
more particularly described as follows, to wit: 11"
The north half of the east half of Lot 7, Allan's Acre
Tracts, according to the official plat thereof recorded
in Volume "B" of Plats, page 103, records of Yakima County,
Washington,
be rezoned from Planned Development Zone to R-2, Two-Family
Zone, be, and the same is hereby, approved and said real property
is hereby rezoned to Two-Family Zone.
Section 2. The above change in zoning shall be included and

III depicted on the next regularly amended Use District Map pre-
pared by and for the City.
Section 3. The City Clerk is hereby authorized and

lir directed to file with the Yakima County Auditor a certified
copy of this ordinance.
Section 4. This ordinance shall be in full force
and effect thirty days after its passage, approval and publi-
cation as provided by law and by the City Charter.
