ORDINANCE NO. ..,71X AN ORDINANCE accepting the recommendation of the Planning Commission and rezoning property at the southwest corner of the intersection of North 4th Avenue and D Street in the City of Yakima, Washington, from R-3, Multiple-Family Zone, to Planned Development Zone. WHEREAS, pursuant to due and legal notice, the City Council of . the City of Yakima held a hearing on the 23rd day of September, 1980, upon the recommendation of the Planning Commission that real property situate at the southwest corner of the intersection of North 4th Avenue and D Street in the City of Yakima, Washington, the legal description of which is set out hereinbelow, be rezoned from R-3, Multiplle-Family Zone, to Planned Development Zone, and WHEREAS, as a result of its hearing, the City Council hereby makes its following findings and conclusion s: FINDINGS: - 1. The subject property is currently zoned R-3, Multiple- Family Zone. The request for the Planned Development Zone is to construct a parking lot for the Washington State Depart- ment of Social and Health Services, Office of Public Assis- tance. 2. The site consists of two (2) lots. The west half of the north lot is unpaved and is currently being used for parking for the aforementioned use. The east half of the north lot is a single-family residence. The southern lot is also being used as a single-family residence. Land use and zoning of the surrounding properties are as follows: Zoning Land Use NORTH R-3 Single-Family. SOUTH. R-3 Single-Family EAST R-3 Single-Family WEST B-3 Professional 3. The General Plan designates this area to be best suited for medium density (6-12 DU/NR A) residential development. 4. This proposal meets city codes and standards for parking lots. 5. On September 2, 1980, the Planning Commission recommended approval of the proposed subject to the following conditions: A. Spaces 12 and 31 be deleted for adequate vehicular AI/ circulation. B. A Drainage Plan, designed by a licensed engineer, be approved by the City Office of Engineering. CONCLUSIONS: 1. Although this proposal is not consistent with the General Plan, it provides a necessary function for an existing profes- sional use. 2. The recommendation of the Planning Commission to grant the rezone subject to the conditions contained hereinbelow should be affirmed and the rezone should be granted. Now, therefore, BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. The recommendation of the Planning Commission of the City of Yakima that the following described real property situate. at the southwest corner of the intersection of North 4th Avenue and D Street in the City of Yakima, Washington, and more particularly described as follows, to wit: Lots 7 and 8 of The Syndicate Subdivision according to the official plat thereof recorded in Volume "A" of Plats, page 25, records of Yakima County, Washington, be rezoned from R-3, Multiple-Family Zone, to Planned Development Zone be, and the same is hereby, approved and said real property is hereby rezoned to a Planned Development Zone, all in accordance with, and to conform to, the final development plan and program therefor approved by the Yakima Planning Commission, a copy of which is attached hereto and by reference made a part hereof; provided, this rezone is granted with the following conditions: 1. Spaces 12 and 31 be deleted for adequate vehicular circulation. 2. A Drainage Plan, designed by a licensed engineer, be approved by the City Office of Engineering. Section 2. The above change in zoning shall be included and depicted on the next regularly amended Use District Map prepared by and for the City. Section 3. The City Clerk is hereby authorized and directed to file with the Yakima County Auditor a certified copy of this ordinance. Section 4. This ordinance shall be in full force and effect thirty days after its passage, approval and publication as provided by law and by the City Charter.
