HomeMy WebLinkAbout1980-2457 ADOPTING THE UNIFORM BUILDING CODE ORDINANCE NO. • AN ORDINANCE relating to building regulations; adopting by reference the Uniform Building Code, 1979 Edition, copyright 1979 by the International Conference of Building Officials, regulat- ing the erection, construction, enlargement, alteration, repair, moving, removal, conversion, demolition, occupancy, equipment, use, height, area and maintenance of buildings or structures in the City of Yakima; and amending Sections 11.04.010, 11.04.020, 11.04.030, 11.04.040, 11,04.050, 11.04.060, 11.04.070 and 11.04.080, and enacting new Sec- tions 11.04.015, 11.04.025 and 11.04.027, all of the City of Yakima Municipal Code. WHEREAS, R.C.W. 35.21.180 authorizes cities and towns within the State of Washington to pass ordinances adopting by reference compilations and codes relating to the construction of buildings, and WHEREAS, the City Council of the City of Yakima here heretofore . __ Al sh examined and understands the scope and purpose of the regulations of "41111, the Uniform Building Code, 1979 Edition, copyright 1979 by the International Conference of Building Officials, and deems it in the best interests of the City that such Uniform Building Code and Regulations for Barrier-Free Facilities be adopted as the law of the City of Yakima, and WHEREAS, three copies of such Uniform Building Code and those Regula- tions have heretofore been filed and are now on file in the office of the City Clerk of the City of Yakima for use and examination by the pub- lic, as required by law, now, therefore, BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. Section 11.04.010 of the City of Yakima Municipal Code 0 is hereby amended to read as follows: "11.04.010 Ado.tion of Uniform Buildin: Code. The Uniform Building Code, 19 Esition, copyrig t •-• .y t e International Conference of Building Officials, consisting of the Uniform Building Code, all appendices thereto, and a separate supplement volume there- to entitled Uniform Building Code Standards, of which no less than three copies each have been and now are on file in the office of the City Clerk of the City of Yakima, is hereby adopted and incorporated as fully as set out in full herein, as the building code of the City of Yakima; except as hereinafter amended, and the provisions and regulations of the City of Yakima and the several sections or numbers therein shall constitute, and may be referred to as, the numbers of this chapter." Section 2. Section 11.04.015 is hereby enacted as a new section of 11! the City of Yakima Municipal Code to read as follows: "11.04.015 Amendment to Section 102. Section 102 of the Uniform Building Code, as applied to the City of Yakima, is hereby amended 410 to read as follows: 'Sec. 102. Purpose. The purpose of this code is to provide minimum standards to safeguard life or limb, health, property and public welfare by regulating and controlling the design, construc- tion, quality of materials, use and occupancy, location and m4n- tenance'of all buildings and structures within this jurisdiction and certain equipment spe'cificallv regulated herein. Adoption or enforcement of this code shall not be construed for the particular benefit of any individual person or group of persons, other than the general public. In the event of a con- flict between the intent of this section and any other section : herein, this section shall govern insofar as applicable. Section 3. Section 11.04.020 of the City of Yakima Municipal Code is hereby amended to read as follows: "11.04.020 Amendment to Section 201. Section 201 of the Un' form Building Coi, as applied to the City of Yakima, is hereby amended to read as follows: 'SECTION 201. There is hereby established in the City of Yakima the Division of Code Administration in the Department of Community Development which shall be under the jurisdiction of the Chief of Code Administration designated by the appointing authority. Wherever the term Building Official is used in this code it shall be construed to mean the Chief of Code Administration.'" Section 4. Section 11.04.025 is hereby enacted as a new section of the City of Yakima Municipal Code to read as follows: "11.04.025 Amendment to Section 420. Seation420 of the Unlit,' Building Code, as applied to the City of Yakima is hereby amende to read as follows: 'SECTION 420. SHAFT is a vertical opening through a building for elevators, dumbwaiters, mechanical equipment or similar pur- poses. SHALL (a) With respect to the functions and powers of the Director of Community Development, Chief of Code Adtinistration, any agents anc employees of the City of Yakima and any board authorized hereunder, a direction and authorization to act in the exercise of sound dis- cretion and in good faith; (b) With respect to the obligations upon owners and occupants of premises and their agents, a mandatory requirement to act in compliance with this code at the risk of civil and criminal lia- bility upon failure so to act.'" SMOKE DETECTOR is an approved detector which senses visible. invisible particles of combustion. The detector shall bear a labei or other identification issued by an approved testing agency having a service for inspection of materials and workmanship at the factory during fabrication and assembly. STAGE is a partially enclosed portion of an assembly building which is designed or used for the presentation of plays, demonstra- tions or other entertainment wherein scenery, drops or other effects may be installed or used, and where the distance between the top of the proscenium opening and the ceiling above the stage is more than 5 feet. STAIRWAY. Two or more risers shall constitute a stairway. STORY is that portion of a building included between the surface of any floor and the upper surface of the floor next abc 0 except that the topmost story shall be that portion of a buildin'' included between the upper surface of the topmost floor and the ceiling or roof above. If the finished floor level directly above a basement or unused under-floor space is more than 6 feet above grade as defined here m in for more than 50 percent of the total per meter or is more than 12 feet above grade as defined herein at any point, such basement or unused under-floor space shall be considered as a story. -2- STORY, FIRST, is the lowest story in a building which quali- fies as a story, as defined herein, except that a floor level in a building having only one floor level shall be classified as a first story, provided such floor level is not more than 4 feet 411 below grade, as defined herein, for more than 50 percent of the total perimeter, or more than 8 feet below grade, as defined herein, at any point. STREET is any thoroughfare or public space not less than 16 feet in width which has been dedicated or deeded to the public 411 for public use. STRUCTURE is that which is built or constructed, an edifice or building of any kind, or any piece of work artificially built up or composed of parts joined together in some definite manner:" Section 5. Section 11.04.030 of the City of Yakima Municipal Code is hereby amended to read as follows: "11.04.030 Amendment to Subsection 2305 (d). Subsection 2305 (d) of the Uniform Building Code, as applied to the City of Yakima is hereby amended to read as follows: 'SECTION 2305 (d) SNOW LOADS. Snow load, full or unbalanced shall be considered in place of loads as set forth in Table No. 23-C where such loading will result in larger members or connec- tions. When valleys are formed by a multiple series of roofs, special provisions shall be made for the increased load at the intersections. The snow load for the City of Yakima is thirty pounds per square foot." Section 6. Section 11.04.040 of the City of Yakima Municipal Code is hereby amended to read as follows: "11.04.040 Amendment to Subsection 2305 (e). Subsection 2305 (e) of the Uniform Building Code, as applied to the City of Yakima is hereby amended to read as follows: 'SECTION 2305 (e) SPECIAL PURPOSE ROOFS. Roofs to be used for special purposes shall be designed for appropriate loads as approved by the building official. Greenhouse roof bars, pur- lins and rafters shall be designed to carry a 100-pound-minimum concentrated load in addition to the live load. Residential green- . houses, lath houses, residential patio structures and agricultural buildings shall be designed for a verticle live load of not less than fifteen pounds per square foot.'" Section 7. Section 11.04.050 of the City of Yakima Municipal Code is hereby amended to read as follows: "11.04.050 Amendment to Subsection 2907 (a) Subsection 2907 (a) of the Uniform Building Code, as applied to the City of Yakima is hereby amended to read as follows: 'SECTION 2907 (a) GENERAL. Footings and foundations, unless otherwise specifically provided, shall be constructed of masonry, concrete or treated wood in conformance with U.B..0 Standard No. 29-3 and in all cases shall extend below the frost line. Footings of concrete and masonry shall be of solid material. Foundations supporting wood shall extend at least 6 inches above the adjacent finish grade. Footings shall have a minimum depth below finished grade of twenty four inches.'" Section 8. Section 11.04.060 of the City of Yakima Municipal Code is hereby amended to read as follows: "11.04.060 Amendment to Section 4501.Section 4501 of the Uni- form Building Code, as applied to the City of Yakima, is hereby amended to read as follows: -3- 'Sec. 4501. No part of any structure or any appendage thereto, except signs, shall project beyond the property 411 line of the building site, except as .specified in this chap- ter, provided that in the remodeling of existing commercial buildings a maximum of four inches projection beyond the property line, or the existing projection line, shall be allowed for the installation of new or different facing materials. 4111 Structures or appendages regulated by this Code shall be constructed of materials as specified in Section 1710. The projection of any structure or appendage shall be the distance measured horizontally from the property line to the outermost point of the projection. Nothing in this code shall prohibit the construction and use of a structure between buildings and over or under a public way, provided the structure complies with all requirements of this code. No provision of this chapter shall be construed to permit the violation of other laws or ordinances regulating the use and occupancy of public property.'" Section 9. Section 11.04.070 of the City of Yakima Municipal Code is hereby amended to read as follows: "11.04.070 Adoption of Regulations for Barrier-Free Facilities. The Regulations for Barrier-Free Facilities, dated October 1, 1976, as promulgated by the Washington State Building Code Advisory Council, of which regulations not less than three copies of each have been and now are on file in the office of the Yakima City Clerk, are adopted and incorporated as fully as if set out in full herein, as supplements and amendments to the Uniform Building Code adopted by this chapter." Section 10. Section 11.04.080 of the City of Yakima Municipal Code is hereby amended to read as follows: "11.04.080 Thermal performance and design standards. 110 Sections 2 through 10 of Laws of the State of Washington,: 1st Extraordinary Session, 1977, Chapter 14, of which standards not less than three copies of each have been and now are on file in the office of the Yakima City Clerk, are adopted and incorporated as fully as if set out in full herein as supplements and amendments to the Uniform Building Code adopted by this chapter." Section 11. Section 11.04.027 is hereby enacted as a new sec- tion of the City of Yakima Municipal to read as follows: "11.04.027 Amendment to Section 307. Section 307 of the Uniform Building Code, as applied to the City of 'Yakima, is hereby amended to read as follows: 'Sec. 307. Certificate of Occupancy. (a) Use or Occupancy. No building or structure of Group A, E, I, H, B or R, Division 1 Occupancy, shall be Am. used or occupied, and no change in the existing occupancy 111 classification of a building or structure or portion thereof shall be made until the building official has issued a Certificate of Occupancy therefor as provided herein. -4- (b) Change in Use. Changes in the character or use 411 of a building shall not be made except as specified in Section 502 of this code. (c) Certificate Issued. After final inspection when it is found that the building or structure complies with the provisions of this code and other laws which are enforced by the code enforcement agency, the building official shall issue a Certificate of Occupancy which shall contain the following: 1. The building permit number. 2. The address of the building. 3. The name and address of the owner. 4. A description of that portion of the building for which the certificate is issued. 5. A statement that the described portion of the 1111, building complies with the requirements of this code for the group and division of occupancy and the use for which the proposed occupancy is classified. 6. The name of the building official. (d) Temporary Certificate. If the building official finds that no substantial hazard will result from occupancy of any building or portion thereof before the same is com- pleted, he may issue a temporaryCertificate of Occupancy for the use of a portion or portions of a building or structure prior to the completion of the entire building • or structure. (e) Posting. The Certificate of Occupancy shall be posted in a conspicuous place on the premises and shall not be removed except by the building official. (f) Public Nuisance. It is a public nuisance to use or occupy a building or structure, or any part thereof, 410 of the group enumerated in subsection (a) herein without there having been issued a valid Certificate of Occupancy for such building, structure or part thereof. Such public nuisance shall be subject to prevention or abatement by injunction or other appropriate legal remedy in the superior court of Washington in Yakima County.'" Section 12. This ordinance shall be in full force and effect thirty days after its passage, approval and publication as provided by law and by the City Charter.
