AN ORDINANCE relating to building regulations; adopting by reference
the Uniform Mechanical Code, 1979 Edition, by the Inter-
national Conference of Building Officials together
with "Appendix A", Uniform Mechanical Code Standards,
and "Appendix B", Steam and Hot Water Boilers, Steam
and Hot Water Piping (Hydronics), "Appendix C", Sizing
of Ventilating Systems serving appliances equipped
with draft hoods and appliances listed for use with
Type B vents; repealing apprentice licensing; providing
amendments thereto; and amending Sections 11.32.010,
11.32.015, 11.32.040, 11.32.050, 11.32.060, 11.32.070,
11.32.080, 11.32.100, 11.32.120, 11.32.130 and 11.32.150;
adding new Section 11.32.075, and repealing Section
11.32.030, all of the City of Yakima Municipal Code.
WHEREAS, R.C.W. 35.21.180 authorizes cities and towns within
the State of Washington to pass ordinances adopting by reference com-
pilations and codes relating to the construction of buildings, and
110 WHEREAS, the City Council of the City of Yakima has heretofore
examined and understands the scope and purpose of the regulations of
the "Uniform Mechanical Code", 1979 Edition, of the International Con-
ference of Building Officials and deems it in the best interests of
the City that such Uniform Mechanical Code be adopted as the law of
the City of Yakima, and
WHEREAS, three copies of such Uniform Mechanical Code have hereto-
fore been filed in the office of the City Clerk of the City of Yakima
for use and examination by the public, as required by law, now, therefore
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. Section 11.32.010 of the City of Yakima Municipal
Code is hereby amended to read as follows:
"11.32.010. Adoption of Uniform Mechanical Code. The 'Uniform
Mechanical Code', 1979 Edition, of the International Conference
of Building Officials, together with 'Appendix A', Uniform Code
Standards, and 'Appendix B', Steam and. Hot Water Boilders, Steam
and Hot Water Piping and Fuel Gas Piping, 'Appendix C', Sizing of
Venting Systems Serving Appliances equipped with draft hoods and
appliances listed for use with Type B Vents, of which not less than
three copies each have been and are now on file in the office of
the City Clerk of the City of Yakima, is hereby adopted and incor-
porated as fully as if set out in full herein, as the Mechanical
Code of the City of Yakima, except as hereinafter amended, and the
provisions and regulations of the City of Yakima; and the several
sections or numbers therein shall constitute, and be referred
to as, the numbers of this chapter."
Section 2. Section 11.32.015 of the City of Yakima Municipal Code
is hereby amended to read as follows:
"11.32.015 Amendment to Subsection 201 (a). Subsection 201
410 (a) of the Uniform Mechanical Code adopted by this chapter is
hereby amended to read as follows:
'Sec. 201 Powers and Duties of Building Officials.
(a) General. The Chief of Code Administration and his
designees are hereby authorized and directed to enforce all the
provisions of this Code. For such purpose, the Chief of Code
Administration and his authorized representatives shall have the
powers of police officers. Whenever the term Building Official
is used in this Code it shall be construed to mean the Chief of
Code Administration or his designees.'"
Section 3. Section 11.32.040 of the City of Yakima Municipal
Code is hereby amended to read as follows:
"11.32.040 Amendment to Subsection 913 (b) 1. Subsec-
tion 913 (b) 1 of the Uniform Mechanical Code adopted by
this chapter is hereby amended to read as follows:
'Sec. 913. Masonry Chiuneys.
(b) Gas Venting into Existing Masonry Chimneys. Exist-
ing lined masonry chimneys and unlined masonry chimneys with
not more than one side exposed to the outside may be used
to vent gas appliances provided:
1. An approved metal liner shall be installed in
existing unlined masonry chimney when deemed necessary by
the Building Official. Such approved liner shall be con-
structed of not less than 24 gauge USG galvanized sheet
steel.'"
Section 4. Section 11.32.050 of the City of Yakima Municipal Aft

Code is hereby amended to read as follows:
"11.32.050 Amendment to Section 302. Section 302
of the Uniform Mechanical Code adopted by this chapter
is hereby mended by adding thereto a new subsection num-
bered 302 (d), which new subsection shall read as follows:
'Sec. 302. Application for Permit.
(d) To Whom Permits May Be Issued.
1. A permit may be issued to a properly licensed
person, firm or corporation not acting in violation of
any current contractors law.
2. Any permit required by this code may be issued
to any person to do any work regulated by this code in a
single family dwelling used exclusively for living pur-
poses, including the usual accessory buildings and quar-
ters in connection with such buildings, in event that such
person is the bona fide owner of any such dwelling and
an accessory building and quarters, and that the same are
occupied by said owner, provided, that owner shall personally
purchase all materials and shall personally perform all
labor in connection therewith.
3. No permit shall be issued to any person to do
or cause to be done any work regulated by this code ex-
cept to a person holding a valid unexpired and unrevoked
heating and/or comfort cooling contractor license as re-
quired by Section 11.32.090 of this chapter.'"
Section 5. Section 11.32.060 of the City of Yakima Municipal
Code is hereby amended to read as follows:
"11.32.060 Amendment to Section 305. Section 305 of 411
the Uniform Mechaiiica1 Code adopted by,ihis chapter is here-
by amended to read as follows:
'Sec. 305. Inspection. All equipment for which a
permit is obtained under this code shall be inspected by
the Building Official. That portion of any equipment intended
to be concealed by any permanent portion of the building
shall not be concealed until inspected and approved.

When the installation of any equipment is complete,
a second or final inspection shall be made. Certification
of inspection and approval of gas installations shall be
by attaching a metal 'City of 'Yakima' seal to the gas
piping and by telephone verification to the gas utility
• company.
Equipment regulated by this Code shall not be con-
nected to the fuel or power supply until authorized by
the Building Official.
Exception: The requirements of this section shall
not be considered to prohibit the operation of any heating
equipment installed to replace existing heating equipment
serving an occupied portion of a building, in the event
a request for inspection of such heating equipment has
been filed with the Office of Code Enforcement not more
than 48 hours after such replacement work is completed,
and before any portion of such equipment is concealed by
any permanent portion of the building.
A final inspection approval may, upon notice, be re-
voked by the Building Official if he finds that the heat-
ing, ventilating, cooling, or refrigeration equipment fails
in any respect to comply with the requirements of this
Code, or that the installation is unsafe, dangerous or
a hazard to life or property.'"
Section 6. Section 11.32.070 of the City of Yakima Municipal
Code is hereby amended to read as follows:
"11.32.070 Amendment to Section 2203 of 'Appendix
B' by Addition of Subsection 2203 (g). Section 2203 of
'Appendix B' of the Uniform Mechanical Code adopted by
this chapter is hereby amended by adding thereto a new
subsection (g) to read as follows:
'Sec. 2203. Gas Meter Locations.
(g) All gas meters shall be located outside of build-
• ings, and those meters now installed inside or under build-
ings shall be moved outside when additional equipment is
added, or if existing equipment is replaced.'"
Section 7.. Section 11.32.080 of the City of Yakima Municipal
Code is hereby amended to read as follows:
"11.32.080 Definitions. As used in this chapter
the following terms shall have the following meanings:
1. 'Heating and/or comfort cooling contractor' means
any person, firm or corporation who installs, con-
tracts to install or services, repairs, alters or
cleans any or all types of heating and cooling

2. 'Journeyman' means any person engaged in the actual
work of installing or servicing any heating or comfort
cooling appliance, and who is the authorized holder
of a valid and subsisting 'journeyman's license'.
3. 'Heating and/or comfort cooling appliance' means
an appliance which utilizes gas, liquid, solid fuel
or electricity for the purpose of heat and/or cool-
ing, and shall include all necessary piping and duct

work, and shall also include piping for all gas

appliances including such appliances as gas
refrigerators.'"
Section 8. Section 11.32.100 of the City of Yakima Municipal
Code is hereby amended to read as follows:
"11.32.100 Amendment to Section 421. Section 421 of
the Uniform Mechanical Code adopted by this chapter as applied
to the City of Yakima is hereby amended to read as follows:
"Sec. 421.
SELF CONTAINED means having all essential working
parts except energy and control connections so contained
in a case or framework that they do not depend on appliances
or fastenings outside of the machine.
SHALL
(a) With respect to the functions and powers of the
Director of Community Development, Chief of Code Adminis-
tration, any agents and employees of the City of Yakima and
any board authorized hereunder, a direction and authoriza-
tion to act in the exercise of sound discretion and in
good faith.
(b) With respect to the obligations upon owners and
occupants of premises and their agents, a mandatory require-
ment to act in compliance with this Code at the risk of
civil and criminal liability upon failure to act.
SOLDERED JOINT is a joint obtained by the joining
of metal parts with metallic mixtures or alloys which melt
at a temperature below 800° F. and above 400° F.
STOP VALVE is a device to shut off the flow of
refrigerant.'"
Section 9. 11.32.120 of the City of Yakima Municipal
Code is hereby amended to read as follows:
"11.32.120 Journeyman's License Required. It is
unlawful for any person to install or service any heating
or comfort cooling appliance without first having obtained
and being the authorized holder of a valid and subsisting
journeyman's license as authorized by this chapter."
Section 10. Section 11.32.130 of the City of Yakima Municipal
Code is hereby amended to read as follows:
"11.32.130 Journeyman's License Fee. The fee for
such journeyman's license shall be eleven dollars and eleven
dollars for renewal, per year for each person payable to
the City of Yakima City Clerk."
Section 11. Section 11.32.150 of the City of Yakima Municipal.
Code is hereby amended to read as follows:
"11.32.150 Amendment to Section 102. Section 102 of
the Uniform Mechanical Code adopted by this chapter as
applied to the City of Yakima is hereby amended to read
as follows:
'Sec. 102. Purpose. The purpose of this code is to
provide minimum standards to safeguard life or limb, health,
property and public welfare by regulating and controlling

the design, construction, installation, quality of materials,
location, operation and maintenance or use of heating,
ventilating, cooling, refrigeration systems, incinerators
and other miscellaneous heat producing appliances within
this jurisdiction.
411 Adoption and enforcement of this code shall not be
construed for the particular benefit of any individual
person or group of persons, other than the general public.
In the event of conflict between the intent of this sec-
tion and any other section herein, this section shall
govern insofar as applicable."
Section 12. Section 11.32.075 is hereby enacted as a new
section of the City of Yakima Municipal Code to read as follows:
"11.32.075 Amendment to Section 404. Section 404 of
the Uniform Mechanical Code adopted by this chapter is here-
by amended to read as follows:
'Sec. 404.
BOILER, HIGH PRESSURE, is a boiler furnishing steam
at pressures in excess of 15 pounds per square inch or
hot water at temperatures in excess of 250° F. or at pressures
in excess of 160 pounds per square inch.
BOILER, LOW PRESSURE HOT WATER and LOW PRESSURE STEAM,
is a boiler furnishing hot water at pressures not exceed-
ing 160 pounds per square inch and at temperatures not more
than 250° F., or steam at pressures not more than 15 pounds
per square inch.
BOILER ROOM is any room containing a steam or hot
water boiler.
BLAZED JOINT is any joint obtained by joining of
metal parts with alloys which melt at temperatures higher
than 800° F. but lower than the melting temperature of
the parts to be joined.
411 BREECHING is a metal connector for medium and high-
heat appliances.
BRINE is any liquid used for the transmission of heat
without a change in its state, having no flash point or
a flash point above 150° F., as determined by the require-
ments of U.M.C. Standard No. 4-1.
BTU/H is the listed maximum capacity of any appliance,
absorption unit or burner expressed in British thermal
units input per hour unless otherwise noted.
BUILDING CODE is the 1979 edition of the Uniform Build-
ing Code as adopted by Chapter 11.04 of the City of Yakima
Municipal Code.
111 BUILDING OFFICIAL is the Chief of Code Administration
or the Director of the Department of Community Development
or their respective designees.'"

Section 13. Section 11.32.030 of the City of Yakima Muni- 0
Code is hereby repealed.
Section 14. This ordinance shall be in full force and effect
thirty days after its passage, approval and publication as provid411
by law and by the City Charter.
