AN ORDINANCE relating to fire codes; adopting by reference the Uniform Fire Code, 1979 Edition, copyright 1979 by the Inter- national Conference of Building Officials and the Wtstern Fire Chiefs Association, and making deletions therefrom and amendments thereto; and amending Sections 10.05.010, • 10.05.020, and 10.05.025, all of the City of Yakima Municipal Code. WHEREAS, R.C.W. 35.21.180 authorizes cities and towns within the State of Washington to enact ordinances which adopt by reference cm- pilations and codes, including fire codes, and Ill WHEREAS, R.C.W. 19.27.030 mandates that on and after January 1, - 1975, there shall be in effect in all cities of the state a state build- ing code which shall include the Uniform Fire Code with appendices thereto, 1973 Edition, and WHEREAS, R.C.W. 19.27.040 authorizes cities within the state to amend the state building code and to adopt subsequent revisions thereof, and WHEREAS, the City Council of the City of Yakima has heretofore examined and understands the scope and purpose of the regulations of the Uniform Fire Code, and appendices thereto, 1979 Edition, copyright 1979 . by the Western Fire Chiefs Association and the International Conference 1111 of Building Officials and deems it in the best interests of the City of Yakima that such code, as amended by this ordinance, be adopted as the fire code of the City of Yakima, and WHEREAS, three copies of such Uniform Fire Code have heretofore been filed and are now on file in the office of the City Clerk of the City of Yakima for use and examination by the pUblic, as required by 'law, now, therefore, BE IT ORDAINED BY THE CITY CF YAKIMA: Section 1. Section 10.05.010 of the City of YakimallUnicipal Code is hereby amended to read a“ollows: 411 "10.05.010 Adoption of codes. The Uniform Fire Code with appendices thereto, 1979 Edition, published by the International Conference of Building Officials and the Western Fire Chiefs Assoc- iation consisting of Uniform Fire Code and a separate supplement volume thereto entitled 'Uniform Fire Code Standards', of iich not less than three copies each are filed in the office of the City 0 Clerk cf the City of Yakima, and are hereby adopted and incotpor ated as fully as if set out in full herein, as the fire prevention code of the City, except as hereinafter amended, and the provisions and regulations thereof are hereby adopted as the provisions and regulations of the City, and the several sections or numbers there- in shall constitute, and may be referred to as, the numbers cf this III Chapter." Section 2. Section 10.05.020 of the City of Yakima Municipal Code is hereby amended to read as follows: "10.05.020 Deletion from the Uniform Fire Code. Sections 2.103 and 2.104 and Article 78, 'Fireworks', are hereby deleted in their entirety from the Uniform Fire Code, 1979 edition." Section 3. Section 10.05.025 of the City of Yakima Municipal Code is hereby amended to read as follows: "10.05.025 Amendments to the Uniform Fire code. A. Section 2.101, 'Responsibility For Enforcement', of the Uniform .Fire Code, 1979 Edition, is amended to read as follows: 'Sec. 2.101 Responsibility for Enforcement. (a) The Director of COmmUnity Development shall be responsible for the administra tion and enforcement of this code. Under his/her direction the Divisioncf Code Administration shall enforce all ordinances of the jurisdiction pertaining to: 1. The prevention of fires. 2. The storage, use and handling of explosive, flammable, toxic, corrosive and other hazardous gaseous, solid and liquid materials. 3. The installation and maintenance of automatic, manual, and other private fire alarm systems and fire-extinguish ing eguiPaent • • 4. Yrhe maintenance and regulation of fire escapes. 5. The elimination of fire hazards on land and in buildinge, structures, and other property including those under construction. • 6. The means and adequacy of each exit in the event of f ire, from factories, schools, hotels, lodging houses, asylums, hospitals, churdhes, halls, theatres, amphitheatres, and all other places in Which people wotk, live or congregate from time to time for any purpose. 7. Adoption and enforcement of this code shall not be con- strued for the particular .benefit of any individual person or group of persons, other than the general pub. lic. In the event of a conflict between the intent of this section and any other sec herein, this section shall govern insofar as applicable. (b) The Chief cf the Fire Department shall be responsible for the administration and enforcememt of all ordinances Of the admin- istration and enforcement of all ordinances of the jurisdiction' pertaining to: ORDRES/L • 2 1. The suppression or extinguishing of dangerous or hazard- ous fires. • 2. The investigation of the cause, origin and circanstances of fires. B. Section ■2.102, 'Rules and Regulations', of .the Uniform Fire Code, 1979 Edition, is amended to read as follows: III 'Sec. 2.102 Rules and Regulations. The Director of Community Development or person designated by the Director, is authorized to make and enforce such rules and regulations for the prevention and control of fires and fire hazards as may be necessary from time to time to carry out the intent of this code. Three certified copies of such rules and regulations shall be filed with the Clerk of the jurisdiction, and shall be in effect immediately thereafter and additional copies shall be kept in the Office of Code Administra- tion for distribution to the pUblic.' C. Section 2.105, 'Authority of Fire Personnel to Exercise Powers of Police Officers', of the Uniform Fire °Ode, 1979 Edition, is hereby amended to read as follows: • 'Sec. 2.105. Authority of Chief of Fire Department and Director of Community Development to Exercise Powers of Police Officers. The Chief of the Fire Department and Director of CbM- munity Development, together with their respective authorized . representatives, shall have the powers of a police officer in performing their respective duties under this code.' D. Section 2.106 'Authority and Duty of Police Personnel to Assist in Enforcing this Code of the Uniform Fire Code, 1979 Edition, is hereby amended to read as follows: Sec. 2.106. Authority and Duty of Police Personnel to Assist in Enforcing this Code. Whenever requested to do so by the Chief of the Fire Department or the Director of Community Development or one of their authorized representatives, the chief of Police shall assign such available police officers as in his discretion may be necessary to assist the Fire Department or Office of Code AdminiS tration in enforcing the provisions of this Code.' E. Section 2.201, 'Inspections and Unsafe Buildings', of the Uniform Fire Code, 1979 Edition, is hereby amended to read as 410 follows:. 'Sec. 2.201. Inspections and Unsafe Buildings. (a) The Chief of Code Administration or his authorized representatives shall inspect, as often as may be necessary, all buildings and premises, including such other hazards or appliances, as the Chief of Code Administration or his authorized representatives may de4 signate for the purpose of ascertaining and causing to be corrected any conditions which would reasonably tend to cause fire or con. tribute to its spread, or any violation of the purpose or pro- visions of this Code and of any other law or standard affecting fire safety. • (b) All buildings or structures which are structurally unsafe or not provided with adequate egress, or which constitute a fire hazard, or are otherwise dangerous to human life, or which in • relation to existing use constitute a hazard to safety or health, or public welfare, by reason of inadequate maintenance, dilap idation, obsolescence, fire hazard, disaster damage, or Abondon7 ment, as specified in this Code or any other effective ordinance; are, for the purpose of this Section, unsafe buildings. All such unsafe buildings are hereby declared to be public nuisances and Shall be Abated by repair, rehabilitation, demolition, or removal in accordance with the procedure specified in Chapters 4 through 9 of the Uniform Code for the Abatement of Dangerous Buildings or by any other procedures provided by law.' F. Section 2.202 'Investigations', of the Uniform Fire Code, 1979 Edition, is hereby amended to read as follows: ORDRES/I, 3 1.4 'Sec. 2.202. Investigations. (a) The Fire Department shall' investigate promptly the cause, origin and circumstances of each and every fire occurring in the municipality involving loss of life. or injury to person or destruction or damage to property, and if it 110' appears to the Chief of the Fire Department or his authorized representatives making the investigation that such fire is of suspicious origin, he shall then take immediate charge of all physical evidence relating to the cause of the fire and shall pursue the investigation to its conclusion. The Chief of the Fire Department or his authorized representatives shall make a report in 0 writing of all facts and findings relative to each investigation. (b) The Police Department shall assist the Fire Department in its investigations whenever requested to do so, unless otherwise directed by the Chief of Police.' • G. Section 2.107, 'Right of Entry', of the Uniform Fire Code, 1979 Edition, is hereby amended to read as follows: 'Sec. 2.107. Right of Entry. Whenever necessary to make an inspection to enforce any of the provisions of this code, or any rules and regulations adopted hereunder, or Whenever the Chief of Code Administration or any of his authorized representatives has 'reasonable cause to believe that there exists in any building or upon any premises any condition in violation of this code which makes suds building or premises unsafe, the Chief of Code Admin- istration or any of his authorized representatives may enter such building or premises at all reasonable times to inspect; provided, that if such building or premises be occupied he shall first pre- sent proper credentials and demand entry; and if such building or premises be unoccupied, he shall first make a reasonable effort to locate the owner or other persons having charge or control of the building or premises and demand entry. If sudh entry is refused, the Chief of Code Administration or any of his authorized repres- entatives shall have recourse to every remedy provided by law to secure entry,' H. Section 2.204, 'Orders, Notices and Tags', of the Uniform Fire Code, 1979 Edition, is hereby amended to read as follows: 'Sec. 2.204. Orders, tices and-Tags. (a) Whenever the Chief of Code Administration shall find in any building or on any premises coMbustible, hazardous or explosive materials, or danger,- ous accumulations of rubbish, or unnecessary accumulations of waste paper, boxes, shavings, or any highly flammable property, or shall find Obstructions to or on fire escapes, stairs, passageways, doors or windows that reasonably tend to interfere with the operations of the Fire Department, or the egress of the occupants of such build ing or premises, or shall find that the effectiveness of any exit door, attic separation, or any fire separation wall is reduced, or shall find that this Code is being violated, he shall issue such orders as may be necessary for the enforcement of the fire preven- tion laws and ordinances governing the same and for the safeguard- ing of life and property from fire. (b) Whenever the Chief of Code .Administration deems any chimney, smokestack, stove, oven, incinerator, furnace or other heating device, electric fixture or any appurtenance thereto, or . anything regulated under a nationally approved standard in or upon • any building, structure or premises not specifically mentioned in the Code, to be defective or unsafe so as to create an immediate of hazard, he shall serve upon the owner or the person having control of the property a written notice to repair or alter as necessary and Shall notify any other authority enforcing codes regulating such equipment. He may affix a condemnation tag prohibiting the use thereof until such repairs or alterations are made. When affixed, such tag may be removed only by the order of the Chief of 0 Code Administration or his duly authorized representative and may be removed only when the hazard to which the order pertains has been eliminated in an approved manner. Until removed, that item or device which has caused the hazard shall not be used or be per - mitt to be used. ORDRES/L 4 (c) Every order or notice Shall set forth a time limit. The ' length of such time limit shall be dependent upon the hazard and danger created by the violation.' 411 I. Section 3.102 'Unlawful Continuance of Fire Hazard', of the Uniform Fire Code, 1979 Edition, is hereby amended to read as follows: Sec. 3.102. Unlawful Continuance of Fire Hazard. Any person 411 operating or maintaining any occupancy, premises or vehicle subject to this Cod e who shall permit any fire hazard to exist on premises under his control or Who shall fail to take immediate action to Abate a fire hazard When ordered or notified to do so by the Chief of Code Administration or his duly authorized representative shall be guilty of a misdemeanor.'. J. Section 2.203. 'Records and Reports', of the Uniform Fire Code, 1979 Edition, is hereby amended to read as follows: 'Sec. 2.203. Records and Reports. (a) The Fire Department shall keep a record of all fires occurring within its jurisdiction and of all facts concerning the same, including statistics as to • the extent of such fires and the damage caused thereby, together • III . . with such other information as may be required by the Chief. (b) The Chief of the Fire Department shall retain for not less than three years a record of each investigation made showing the cause. the findings and disposition of each such investigation. The Chief of Code Administration shall retain for not less than three years a record of each inspection made showing the findings and disposition of each such inspection.' K. Section 2.301. 'Alternative Materials and Methods', of the Uniform Fire Code, 1979 Edition, is hereby amended to read as follows: . 'Sec. 2.301. Alternative Materials and Methods. (a) The Chief of Code Administration may modify any of the provisions of this code upon application in writing by the owner or lessee, or his duly authorized representative, Where there are practical difficulties in the way of carrying out the strict letter of the Code provided that the spirit of the Code shall be complied with, public safety secured and substantial justice dOne. The partic- ulars , of such modification shall be granted or allowed and the • decision of the Chief of Code Administration shall be entered upon the records of the department and a signed copy shall be furnished the applicant. (b) The Chief of Code Administration may approve any alter- nate material or method, provided he finds that the proposed de-7 sign, use or operation satisfactorily complies with the intent of this Code and that the material, method of work performed or pper ation is, for the purpose intended, at least the equivalent of that prescribed in this Code in quality, strength, effectiveness, fire resistance, durability and safety. (c) The Chief of Code Administration may require tests . as. proof of compliance with the intent Of this Code, such tests to be made by an approved agency at the expense of the person requesting approval of the alternate material or method of oOnstruction. (d) If technical expertise is unavailable within the depart ment because of new technology, process, products, facilities, materials, and uses attending the design, operation, or use of a building or premises subject to the inspection of the department', Ak■ the Chief of Code Administration may require the owner or the IIP person in possession or control of the building or premises to provide, without charge to the Office of Code Administration, a technical opinion and report. The opinion and report shall be prepared by a qualified engineer, specialist, laboratory or fire safety speciality organization acceptable to the Chief of Code Administration and the owner and shall analyze the fire safety properties of the design, operation or use of the building or premises and the facilities and appurtenances situated thereon, and . prescribe the necessary recommended dianges.' ORDREM 5 L. Section 2.302, 'Board of Appeals', of the Uniform Fire Code, 1979 Edition, is hereby amended to read as follows: 'Sec. 2.302. Board of Appeals. In order to determine the suitability of alternate materials and type of construction and to 411 provide for reasonable interpretations of the provisions of this Code, there shall be and hereby is created a Board of Appeals, con- sisting of five members Who are qualified by experience and train- ing to pass upon pertinent matters. The Chief of Code Adminis- tration shall be an ex officio member and shall act as Secretary of the Board. The Board of Appeals shall be appointed by the execu- tive 111 body and shall hold office at their pleasure. The Board shall • adopt reasonable rules and regulations for conducting its investi- gations and shall render all decisions and fi dings in writing to the Chief of Code Administration with a duplicate copy to the • appellant and may recommend to the executive body such new legis- lation as is consistent therewith.' M. Section 4.103 'Application for Permit', of the Uniform Fire Cbde, 1979 Edition, is hereby amended to read as follows: 'Sec. 4.103. Application for Permit. All applications for a permit required by this Code shall be made to the Office of Code Administration in such form and detail as prescribed by the Chief of Code Administration. Applications for permits shall be accom- panied by such plans as required by the Chief of Code Administr- ation.' 0. Section 4.104, 'Inspection Required', of the Uniform Fire Code, 1979 Edition, is hereby amended to read as follows: 'Sec. 4.104. Inspection Required. Before a permit may be issued, the Chief of Cbde Administration or his authorized repre- sentative shall inspect and approve the receptacles, vehicles, buildings, devices, premises, storage spaces or areas to be used._ P. Section 4.105 'Retention of Permits', of the Uniform Fire • • Code, 1979 Edition, is hereby amended to read as follows: 'Sec. 4.105. Retention of Permits. Permits shall at all times be kept on the premises designated therein and shall at all times be subject to inspection by an officer of the Police De- partnent or the Chief of Code Administration or his authorized representative.' Q. Section 4.107 'Revocation of Permits', of the Uniform Fire Code, 1979 Edition, is hereby amended to read as follows: 'Sec. 4.107. Revocation of Permits. Any permit or certi- ficate issued under this Code may be suspended or revoked when it is determined after a hearing by the Chief of Code Administration that: (a) It is used by a person other than the person to than the permit or certificate was issued. (b) It is used for a location other than that for which it was issued. (c) Any of the conditions or limitations set forth in the permit or certificate have been violated. (d) The permittee fails, refuses or neglects to comply with any order or notice duly served upon him under the provisions of this Code within the time provided therein. (e) There has been any false statement or misrepresentation as to a material fact in the application or plans on which the 111 permit or application was based.° • R. Section 9.104 of the Uniform Fire Code, 1979 Edition, is • hereby amended to read as follows: ORDRES/L • 6 • 'Sec. 9.104 BALCONY, EXTERIOR EXIT, is a landing or porch projecting fran the wall of a building and Which serves as a required,means of . egress., The long side shall be at least 50 percent open, and the open area above the guardrail shall be so distributed as to prevent the accumulation of smoke or toxic gases. BARREL Shall mean a volume of 42 U.S. gallons. BELOW' GROUND CONTAINER shall mean a storage installation in which the maximum liquid level in the container is below the surrounding grade or below a badkfill berm, which is at least 10 feet wide at the top, and then slopes away from the con- tainer at a natural angle of repose or is retained 10 feet fran the container by a retaining wall, and constructed of earth, concrete, solid masonry, or suitable material designed to prevent the escape of liquid. BLASTING AGENT shall mean any material or mixture consisting of a fuel and oxidizer, intended for blasting, not otherwise classified as an explosive, in which none of the ingredients are classified as explosives, provided that the finished product, as mixed and packaged for use or shipment, cannot be • • detonated by means of a No. 8 test blasting cap when uncon- fined. Materials or mixtures classified as nitrocarbonitrates by the Department of Transportation regulations shall be included in this definition. BLASTING CAP is a shell closed at one end and containing a charge of detonating compound Which is ignited by a safety fuse. It is used for detonating explosives. BLEACHERS are seating facilities without backrests in which an • area of 3 square feet or less is assigned per person for computing the occupant load. BOILOVER shall mean the expulsion of crude oil (or certain other liquids) from a burning tank in which the light frad tions of the crude oil burn off producing a heat wave in the • residue, which on reaching a water strata may result in the expulsion of a portion of the contents of the tank in the forM of a froth. BOILING POINT shall mean the boiling point of a liquid at a 410 pressure of 14.7 psia (760mm). Where an accurate boiling point is unavailable for the material in question, or for mixtures which do not have a constant boiling point, for purposes of this classification, the 10 percent point of : a distillation, performed in accordance with the Standard Method of Test for Distillation of Petroleum Products ASTM may be used as the boiling point of the liquid Btu shall mean British Thermal Unit--the heat necessary to raise the temperature of one pound of water one degree Fahren- heit. BUILDING is any structure used or intended for supporting or sheltering any use of occupancy. BUILDING CODE. See Uniform Building Code. BUILDING OFFICIAL shall mean the official of the jurisdiction charged with the administration of the Building Code. BULK OXYGEN SYSTEM shall mean an assanbly of equipment, such 411 as oxygen storage containers, pressure regulators, safety devices, vaporizers, manifolds, and interconnection piping, which has a storage capacity at normal temperature and pres- sure of: 1. More than 12,000 cubic feet of oxygen connected in ser- vice or ready for service, or ORDRES/L 7 2. More than 25,000 cubic feet of oxygen, including un- connected reserve on hand at the site. The bulk oxygen system terminates at the point Where oxygen at 410 service pressure first enters the supply line. The oxygen may be stored as a liquid or gas in either stationary or portable containers. BULK PLANT shall mean that portion of a property Where refined 4116 flammable or combustible liquids are received by tank vessel, pipeline, tank car or tank vehicle, and are stored or blended in bulk for the purpose of distributing such liquids in tank vessel, pipeline, tank car, tank vehicle, or container. BULLET RESISTANT shall mean materials and construction methods capable of preventing penetration of a 180 grain, 30 caliber, soft nose, hunting type bullet, when propelled at a maximum velocity of 2700 feet per second. BUREAU OF FIRE PREVENTION shall mean the Chief of Code Admin- istration of the City of Yakima or his authorized representa- tive when the term herein defined is used in a context which relates to duties assigned to the Chief of Code Administration by Section 2.101 . (a) of this Code. Otherwise, Bureau of Fire 411 ,Prevention shall mean the chief officer of the Fire Department of the City of Yakima or his authorized representative when • the term herein defined is used in a context which relates to duties assigned to the Chief of the Fire Department by Section 2.101 (b) of this Code.' S. Section 1.405 of the Uniform Fire Code, 1979 Edition, is hereby amended to read as follows: 'Sec. 1.405. CGA shall mean Compressed Gas Association. CARGO TANK shall mean any container having a liquid capacity in excess of 120 gallons used for the carrying of flammable or combustible liquids, LP Gas, or hazardous Chemicals, and mounted permanently or otherwise upon a tank vehicle. The term "cargo tank" does not apply to any container used solely for the purpose of supplying fuel or propulsion of the vehicle upon which it is mounted. 411 cFn NITRATE PLASTICS (PYRONYLIN) shall mean any plastic substance, material or compound, other than cellulose nitrate film covered by Article 5 or guncotton or other explosive covered by Article 11, having cellulose nitrate as a base, or Whatever name known, when in the form of blocks, slabs, Sheets, tubes or fabricated shapes. CENTRAL SHAPES shall mean the portion of the system Which normally supplies the piping systems. CHEMICAL PLANT shall mean a plant or that portion of a plant other than a refinery or distillery Where flammable or com;- bustible liquids are produced by Chemical reactions or used in Chemical reactions. Agit CHIEF OF CODE ADMINISTRATION shall mean the Chief of Cbde Administration of the City of Yakima or his authorized repre- sentative. CHIEF or CHIEF OF THE FIRE DEPARTMENT shall mean the Chief of Code Administration of the City of Yakima or his authorized representative When either term herein defined is used in a 111 context which relates, to duties assigned to the Chief of Code Administration by Section 2.101 (a) of this Code. Otherwise', Chief or Chief of the Fire Department of the City of Yakima or his authorized representative when either term herein defined is used in a context which relates to duties assigned to the Chief of the Fire Department by Section 2.101 (b) of this Code. ORDRES/L 8 CHIEF OF THE BUREAU OF FIRE PREVENTION shall mean the Chief of Code Administration of the City of Yakima or his authorized representative when the term herein defined is used in a 410 context which relates to duties assigned to the Chief of Code Administration by Section 2.101 (a) of this Code. Otherwise, Chief of the Bureau of Fire Prevention shall mean the chief officer of the Fire Department of the City of Yakima or his authorized representative When the term herein. defined is used in a context Mich relates to duties assigned to the Chief of • the Fire Department by Section 2.101 (b) of this Code. CHIEF ENGINEER shall mean the Chief of Code Administration of the City of Yakima or his authorized representative when the term herein defined is used in a context which relates to duties assigned to the Chief of Code Administration by Section 2.101, (a) of this Code. Otherwise, Chief Engineer shall mean , the chief officer of the Fire Department of the City of Yakima or his authorized representative when the term herein defined is used in a context which relates to duties assigned to the Chief of the Fire Department by Section 2.101 (b) of this Code. CHIEF OF POLICE or POLICE DEPARTMENT shall mean the chief law enforcement officer of the jurisdiction or his authOrized representative. CLOSED CONTAINER shall mean a container so seAled•byMeans,of a lid or other device that neither liquid nor vapor will escape from it at ordinary temperatures. COMBINATION STANDPIPE is a fire line system with a constant water supply and installed for the use of the Fire Department and the occupants of the building. COMBUSTIBLE FIBER STORAGE BINS shall mean metal, or metal liquid, containers with a capacity not exceeding 1000 cubic feet, and equipped with a self-closing cover. CCMBUSTIME FIBERS STORAGE ROOMS shall mean roams with a cap-..: acity not exceeding 500 cubic feet separated from the remain-, der of the building , by a one-hour occupancy separation con- structed as specified in the Building Code. COMBUSTTALE FIBERS shall mean and include readily ignitable • and free burning fibers, such as cotton, sisal, henequen ixtle, jute, hemp, tow, cocoa fiber, oakum, baled waste, baled. wastepaper, kapok, hay, • straw, excelsior, Spanish moss, and other like materials. COMBUSTIBLE LIQUID is a liquid having a flash point at or Above 100°F., and below 200 °F. •CCMEUSTIBLE WATER MATTER shall mean magazines, boOks, trim- mings from lawns, trees, flower gardens,- pasteboard boxes, rags, paper, straw, sawdust, packing material, shavings, boxes and all rubbish and refuse that will ignite through contact with flames of ordinary temperatures. COMMODITY is the canbination of product, packing material and container. 411 COMPRESSED GAS is any mixture or material having in the con- tainer either an absolute pressure exceeding 40 pounds per square inch at 70°F., or an absolute pressure exceeding 104 pounds per square inch at 130°F., or both; or any liquid, flammable material having a vapor pressure as defined in. III Section 1.424 exceeding 40 pounds per square inch at 100 °F. CONDENSATE TANK is a tank which is installed in the vapor- . return piping of a vapor recovery system to collected con- densed gasoline. All such tanks shall be capable of being drained without opening. ORDRES/L 9 CONTAINER is any vessel of 60 U.S. gallons or less capacity used for transporting or storing flammable or combustible liquids. CONVERSION OIL BURNER is a burner for field installations in 111 heating appliances such as boilers and furnaces. It may be furnished with or without a primary safety control. Under special circumstances it may be installed for firing ovens, water heaters, ranges, special furnances and the like. A burner of this type may be pressure atomizing gun type, a horizontal or vertical rotary type or a mechanical or natural 410 draft vaporizing type. • CONVERSION RANGE OIL BURNER is an oil burner designed to burn kerosene, range oil or similar fuel. This burner is intended primarily for installation only in a stove or range, a portion or all of which originally was designed for the utilization of • solid fuel and which is flue-connected. CORROSIVE LIQUIDS shall mean and include those acids, alkaline caustic liquids, and other corrosive liquids Which, when in contact with living tissue, will cause severe damage of such tissue by chemical action; or are liable to cause fire When in contact with organic matter or with certain Chemicals. CRUDE PETROLEUM shall mean hydrocarbon mixtures that have a flash point below 150°F. and which have not been processed in a refinery. CRYOGENIC FLUIDS shall be defined as those fluids that have a normal boiling point below 200°F. (See Table No. 36.102). CRYOGENIC INGROUND CONTAINER shall mean a container in which the maximum liquid level is below the normal surrounding grade and is constructed essentially of natural materials, such as earth and rock and dependent upon the freezing of water- saturated earth materials for its tightness or impervious nature. • CRYOGENIC VESSEL shall mean any pressure vessel, low-pressure tank, or atmospheric tank on which venting, insulation, refri- geration, or a caMbination of these, are used in order to maintain the operating pressure within the design pressure, and the contents in a liquid phase.' T. Section 9.108, of the Uniform Fire Code, 1979 Edition, is hereby amended to read as follows: 'Sec. 9.108. FIRE APPARATUS shall mean a vehicle such as a fire puMper, aerial ladder truck, elevated platform, rescue squad or sim- ilar fire fighting or rescue equipment. FIRE APPLIANCE shall mean apparatus or equipment provided or installed for use in the event of an emergency. FIRE ASSEMBLY is the assembly of a fire door, fire window, or fire damper, including all required hardware, andhorage, frames, and sills. FIRE BARRIER shall mean a line or barricade designed to keep unauthorized persons out of the area of a fire. FIRE CHItao shall mean the Chief of Code Administration of the City of Yakima or his authorized representative when the term, herein defined is used in a context which relates to duties assigned to the Chief of Code Administration by Section 2.101 11, (a) of this Code. Otherwise, Fire Chief shall mean the chief officer of the Fire Department of the City of Yakima or his authorized representative When the term herein defined is used in a context Which relates to duties assigned to the Chief of the Fire Department by Section 2.101 (b) of this Code. FIRE SEPARATION shall mean construction of rated fire res- istance or the maintenance of clear area to resist the spread, of fire. FLAMMABLE CRYOGENIC FLUIDS shall mean those cryogenic fluids. which are flammable in their vapor state. FLAMMABLE LIQUID is any liquid having a flash point below 100°F. and having a vapor pressure not exceeding 40 pounds per square inch (absolute) at 100°F. Class I liquids shall in- clude those having. flash points below 100°F. and may be sub divided as follows: ORDRES/L 11 Class I-A shall include those having flash points below 73°F. and having a boiling point below 100°F. Class I-B shall include those having flash points below 73°F. and having a boiling point at or above 100°F. Class I-C shall include those having flash points at or above 73°F. The _flash point of liquids having a flash point at or below 175°F., except for fuel oils and certain viscous materials, 411 shall be determined in accordance with the Standard Method of Test for Flash Point by the Tag Closed Tester, ASTM D-56-70. The flash point of liquids having a flash point Above 175°F., except for fuel oils, shall be determined in accordance with the Standard Method of Test for Flash Point by the Cleveland Open Cup Tester, ASTM D92-72. The flash point of fuel oil and certain viscous materials, having a flash point at or below 175° F. shall be determined in accordance with the Standard Method of Test for Flash Point by the Pensky-Martens Closed Tester, ASTM D93-73. FLAMMABLE MATERIAL shall mean (1) any material that will readily ignite fran common sources of heat; (2) any material that will ignite at a temperature of 600 degrees Fahrenheit or less. FLAMMABLE SOLID shall mean and include a solid substance, other than one classified as an explosive, which is liable to cause fires through friction, through absorption of moisture, through spontaneous Chemical changes, or as a result of re- tained heat from the manufacturing or processing.
