AN ORDINANCE accepting the recommendation of the Planning Com-
mission and rezoning property located at 1705.
South 24th Avenue in the City of Yakima from
R-3, Multiple-Family Zone, to M-4, Planned Indus-
' 41111 trial Zone.
WHEREAS, pursuant to due and legal notice, the City Council
of the City of Yakima held a hearing on the 23rd day of December,
1980, upon the recommendation of the Planning Commission that
real property situate at 1705 South 24th Avenue in the City of
Yakima, Washington, the legal description of which is set out
hereinbelow, be rezoned from R-3, Multiple-Family Zone, to M-4,
Planned Industrial Zone, and •
WHEREAS, as a result of its hearing the City Council hereby
makes it following findings and conclusions:
FINDINGS:
1. The subject property is currently zoned R-3, Multiple-
Family Zone, and is occupied by a single-family residence.
2. The land use and zoning of property surrounding the,
subject property is as follows:

South R-3 Single-family residential
East M-4 Vacant
West M-1 Professional Offices and Light
Industrial
3. The rezone request does not conform to the General Plan
designation, however, it was determined by the Planning
Commission and the City Council in early 1980 that the area
between 24th Avenue and the Tahoma Cemetery is not suited
for cemetery expansion. This determination was
basis for rezoning to M-4 the property immediately adlicent
411 to the cemetery and the present rezone site.
4. The proposed zoning and use of the site iS'comptibie
with adjacent land uses. The only inconsistency is the
remaining small R-3 zoned property south of the rezone site.
Since this R-3 property is presently occupied by a single-
family residence, the staff recommends that it remain R-3
until such time as the residential use is abandoned.
5. The rezone request, if approved, will provide
the applicant with a business office site fronting on 24th
Avenue while still retaining reasonable access to their M-4
property to the north and east.
6. The Planning Commission has recommended to the City
Council that the subject area be rezoned to M-4, Planned
410 Industrial Zone.
CONCLUSIONS:
1. Although the proposal does not conform to the General
Plan, it is compatible with other land use in the vicinity.
2. The recommendation of the Planning Commission to grant
the rezone should be affirmed and the rezone should be
granted.
Now, therefore,
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. The recommendation of the Planning Commission 410
of the City of Yakima that the following described real property
situate at 1705 South 24th Avenue in the City of Yakima, Washing-
ton, and more particularly described as follows, to wit:
The south 65 feet of the north 146 feet of the west one-
third of the north 6 acres of the west 16 acres of the sou"
west quarter of the northeast quarter of Section 35, Town-
ship 13 North, Range 18, E.W.M., EXCEPT right-of-way for road
on the west,
be rezoned from R-3, Multiple-Family Zone, to M-4, Planned Indus-
trial Zone, be, and the same is hereby, approved and said real
property is hereby rezoned to Planned Industrial Zone.
Section 2. The above change in zoning shall be included and
depicted on the next regularly amended Use District Map prepared
by and for the City.
Section 3. The City Clerk is hereby authorized and directed 411
to file with the Yakima County Auditor a certified copy of this
ordinance.
Section 4. This ordinance shall be in full force and effect
thirty days after its passage, approval and publication as provided
by law and by the City Charter.
PASSED BY THE CITY COUNCIL, signed and approved this
