AN ORDINANCE relating to building regulations; adopting by
reference the Washington State Energy Code, effec-
tive June 30, 1980; setting new energy conservation
• standards for commercial and residential structures
within the City of Yakima; repealing existing ther-
mal standards; enacting Chapter 11.05 and the various
• sections thereof as a new chapter and new sections
of the City of Yakima Municipal Code and repealing
Section 11.04.080 of the City of Yakima Municipal
Code.
WHEREAS, R.C.W. 35.21.180 authorizes cities and towns with-
in the Stat e of Washington to pass ordinances adopting by reference
compilations of codes relating to construction of buildings, and
WHEREAS, the City Council of the City of Yakima has examined
and understands the scope and purpose of the Washington State
Energy Code, 1980 Edition, by the State Building Code Advisory
Council and the Washington State Energy Office and deems it in
the best interests of the City of Yakima that the Washington State
Energy Code, as amended herein, be adopted as the law of the City
of Yakima, and
WHEREAS, three copies of the Washington State Energy Code
have been filed with the office of the City Clerk of the City of
Yakima for use and examination by the public as required by law,
now, therefore,
41" BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. Chapter 11.05, "Energy Code", and Sections 11.05.010,
11.05.020, 11.05.030, 11.05.040 and 11.05.050 thereof are hereby
adopted as a new chapter and new sections of the City of Yakima
Municipal Code to read as follows:
"Chapter 11.05
ENERGY CODE
11.05.010 Adoption of the Washington State Energy
110 Code. The Washington State Energy Code developed and
adopted by the State Building Code Advisory Council with
staff support from Planning and Community Affairs Agency
for administrative support and The Washington State Energy
Office for technical support and production, effective
June 30, 1980, of which not less than three copies each
111 have been and now are on file in the office of the City
Clerk of the City of Yakima, is hereby adopted and incor-
porated as fully as if it were set out in full herein
as the energy code of the City of Yakima; except as herein-
after amended, and the provisions and regulations of the
City of Yakima and the several sections or number 6 there-
in shall constitute, and may be referred to, as the numbers
of this chapter.
11.05.020 Amendment to Section 101. Section 101
of the Washington State Energy Code, as adopted by this
chapter, is hereby amended to read as follows:
'Section 101. Intent. The purpose of this
Code is to provide minimum standards for new
• buildings and structures or portions thereof to
achieve efficient use of energy.

It is intended that these provisions provide
flexibility to permit the use of innovative ap-
proaches and techniques to achieve effective uti-
lization of energy. These provisions are struc-
tured to permit compliance with the intent of
this Code by any one of the three paths of design.
Compliance with any one of these paths meets
the intent of this Code. This Code is not
intended to abridge any safety or health require-
ments required under any other applicable codes
•or ordinances.
The provisions of this Code do not consider

the efficiency of various energy forms as they
are delivered to the building envelope. A
determination of delivered energy efficiencies
in conjunction with this Code will provide
the most efficient use of available energy in
new building construction.
Adoption and enforcement of this Code shall
not be construed for the particular benefit of
any individual person or group of persons,
other than the general public. In the event
of a conflict between the intent of this sec-
tion and any other section herein, this section
shall govern insofar as applicable.'"
11.05.030 Amendment to Section 109. Section 109
of the Washington State Energy Code, as applied to the.
City of Yakima, is hereby amended to read as follows:
'Section 109. Violations. It shall be un-
lawful for any person, firm, or corporation to
erect or construct any building, or substantially
remodel or rehabilitate any existing building or
structure in the city, or allow the same to be
done, contrary to or in violation of any of the
provisions of this Code.
It is a public nuisance for any person, firm
or corporation to erect or construct any building
or structure, or substantially remodel or rehabili-
tate any existing building or structure or allow
the same to be done contrary to or in violation
of any of the provisions of this Code. Such pub-
lic nuisance shall be subject to Prevention and
abatement by injunction or other appropriate legal
remedy in the superior court of Washington in
Yakima County.'"
11.05.040 Amendment to Section 202. Section 202
of the Washington State Energy Code, as applied to the
City of Yakima, is hereby amended to read as follows:

'Section 202. B
BOILER CAPACITY. The rate of heat output in
BTU/h measured at the boiler outlet at the design
pressure and/or temperature and rated fuel input.
BUILDING ENVELOPE. The elements of a build-
ing which enclose conditioned spaces through which ,

thermal energy may be transferred to or from the
exterior.
BUILDING OFFICIAL. The Chief of Code Adminis-
tration or his duly authorized representative.'"
11.05.050 Amendment to Section 219. Section 219
of the Washington State Energy Code, as applied to the
City of Yakima, is hereby amended to read as follows:
'Section 219. S.
SEQUENCE. A consecutive series of operations.
SERVICE SYSTEMS. All energy-using systems in
a building that are operated to provide services
for the occupants or processes housed therein,
including YVAC, service water heating, illumination,
transportation, cooking or food preparation, laun-
dering or similar functions.
SERVICE WATER HEATING. Supply of hot water
110 for domestic or commercial purposes other than
comfort heating.
SERVICE WATER HEATING DEMAND. The maximum
design rate of energy withdrawal from a service
water heating system in a designated period of
time (usually an hour or a day).
SHADING COEFFICIENT (SC). The ratio of the
solar heat gain through a glazing system to that
of an unshaded single-pane of 1/8 inch float win-
dow glass under the same set of conditions.

SHALL
(a) With respect to the functions and powers
of the Director of Community Development, Chief
of Code Administration, any agents and employees
111 of the City of Yakima and any board authorized
hereunder, a direction and authorization to act
in the exercise of sound discretion and in good
faith.
(b) With respect to the obligations under
owners and occupants of premises and their agents,
a mandatory requirement to act in compliance with
this Code at the risk of civil and criminal
liability upon failure so to act.
SHOULD. Not mandatory but desirable as good
practice.
SKYLIGHT. A clear or translucent panel or
slope set in the plane of a roof to admit day-
light into the interior of a building.
SLAB ON GRADE (in a heated space). Any por-
tion of a slab poured in contact with the ground
where the top of the finished slab is less than
12 inches below the final elevation of the nearest
exterior grade.
SOLAR ENERGY SOURCE. Source of thermal,
chemical or electrical energy derived directly
from conversion of incident solar radiation.

SPECIAL GLAZING. Glazing which has a maximum
"U" value of 0.65. Insulating glass with at
least 1/4 inch air space or approved storm sash
will be considered to provide the "U" value
required.
SUBSTANTIALLY REMODELED OR REHABILITATED.
Any alteration or restoration of a building or

structure within any 12 month period, the cost
of which exceeds 60 percent of the current
replacement value of the particular building
or structure.
SYSTEM. A combination of equipment and/or
controls, accessories, interconnecting means,
and terminal elements by which energy is trans-
formed so as to perform a specific function,
such as HVAC, service water heating or illumina-
tion.'"
Section 2. Section 11.04.080 of the City of Yakima Municipal
Code is hereby repealed.
Section 3. This ordinance shall be in full force and effect
thirty days after its, passage, approval and publication as pro-
vided by law and by the City Charter.
