AN ORDINANCE accepting the recommendation of the Planning Commis- sion and rezoning property at 310 and 312 North 5th Avenue in the City of Yakima, Washington, from R-3, Multiple-Family Zone, to B-2, Local Business ' WHER 111 purs uant to due and legal notice, the City Council of the City of Yakima held a hearing on the 24th day of March, 1981, upon the recommendation of the Planning Commission that real property situate at 310 and 312 North 5th Avenue in the City of Yakima, Washington, the legal description of which is set out hereinbelow, be rezoned from R-3, Multiple-Family Zone, to B-2, Local Business Zone, and WHEREAS, as a result of its hearing the City Council hereby ' makes its following findings and conclusions: FINDINGS: 1. The subject property consists of two abutting lots, currently zoned R-3, Multiple-Family Zone, with a house existing on each lot. 2. The owner indicates that the purpose for the rezone request is to convert an existing dwelling at 310 North 5th Avenue to an art supply store. 3. Land use and zoning on adjacent properties are as follows: Zoning Land Use NORTH R-3 Single Family Residential SOUTH B-3 Commercial (Service Station) EAST B-3 Professional - Dept. of Social & 41O Health Services WEST R-3 Single Family Residential 4. The General Plan for the City of Yakima indicates that the site is best suited for low-medium density resi- dential (6-12 DU/NRA). 5. North 5th Avenue, the street on which the property fronts, is designated as a major arterial on, the City Arterial Street Plan. 6. Offstreet parking for motor vehicles will be provided on the subject property, and onstreet parking is available on 5th Avenue. 7. The Yakima City Planning Commission, in public'ffie insg and after a public hearing on March 3, 1981, - recommended approval of the rezone request:, - CONCLUSIONS: 1. Although the request does not conform to the General Plan, the southerly one-third of the block is presently zoned B-3 and occupied by commercial uses. Given the presence of B-3 zoning northerly to West "D" Street on adjacent blocks to the east and west, it appears that West "D" Street is a logical and reasonable northerly boundary for commercial uses in this area. 2. The recommendation of the Planning Commission to -- grant the rezone should be affirmed and the rezone should be granted. Vow, therefore, BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. The recommendation of the Planning Commission 111 of the City of Yakima that the following described real property situate at 310 and 312 North 5th Avenue in the City of Yakima, Washington, and more particularly described as follows, to wit: Lots 5 and 6, Block 287, of the Syndicate Subdivision to North Yakima (now Yakima), according to the official plat thereof recorded in Volume "A" of Plats, page 25, records of Yakima County, Washington, be rezoned from R-3, Multiple-Family Zone, to B-2, Local Business Zone, be, and the same is hereby, approved and said real property III is hereby rezoned to Local Business Zone. Section 2. The above change in zoning shall be included and depicted on the next regularly amended Use District Map prepared by and for the City. Section 3. The City Clerk is hereby authorized and directed to file with the Yakima County Auditor a certified copy of this ordinance. Section 4.
