AN ORDINANCE accepting the recommendation of the Planning Commission and rezoning property at 217 - 219 South 30th Avenue in the City of Yakima, Wash- ington, from R-1, One-Family Zone to Planned Development Zone. 411 WHEREAS, pursuant to due and legal notice, the City Council of the City of Yakima held a hearing on the 28th day of April, 1981, upon the recemmendation of the Planning Commission that real property situate at 217 - 219 South 30th Avenue in the City of Yakima, Washington, the legal description of which is set out hereinbelow, be rezoned from R-1, One-Family Zone, to Planned Development Zone, and WHEREAS, as a result of its hearing, on June 2, 1981, the City Council determined that the rezone should be granted, and hereby makes its following findings and conclusions: FINDINGS: 1. The property for which the rezone is sought consists of two parcels of residencial property at 217 - 219 South 30th Avenue which are presently zoned R-1, One-Family Zone. The purpose of the request for the rezone is to convert the existing dwelling at 219 South 30th Avenue to a child care facility for the children of hospital employees, the rear yard area of 219 South 30th Avenue and a portion of the rear yard of 217 South 30th Avenue would be utilized as an exterior play area and would be completely fenced with a six (6) foot high site screening cedar fence. 2. The child care facility is proposed to serve a maxi- mum of thirty-eight (38) children during the hours of 6:30 a.m. and 8:00 p.m. and a maximum of five (5) children aged one month to nine years between the hours of 8:00 p.m. to 6:30 a.m. Off-street parking for the hospital employees using the child care center is provided immediately across Walnut Street from the site. 3. Land use and zoning for properties located adjacent to the site is as follows: Zoning Land Use • NORTH SOUTH R-1 R-3 Single Family Residential Yakima Valley Memorial Hospital EAST R-3 & R-1 Tri-plex and Single Family Res. WEST R-1 Single Family Residential 4. The Optimal Land Use Element of the proposed Yakima Urban Area Plan provides that the proposed child care facility falls within the "Professional Service" intensity range and the surrounding residential neighborhood within the "Moderate Density Residential" intensity range. The Optimal Land Use Element provides that "Professional Ser- vice" intensity development may be located adjacent to "Moderate Density Residential" only if it can demonstrate compatibility and only where compatibility conflicts with citizens of the area can be resolved. 5. The proposed rezone is in accordance with the current General Plan of the City of Yakima. 6. The proposed nursery school would be an extension of the existing hospital facility and would be for the sole use of the hospital employees rather than a facility ser- vicing a larger market with only an indirect association with the hospital. Memorial Hospital, as a public insti- tution employing a significant number of women of child bearing and raising age, needs a nursery school/daycare center in close proximity to meet the needs of its employees. As noted in the applicant's written program, the nursery school would facilitate nurses' employability during a time when there is a shortage of working nurses. 7. Since the proposed nursery school will be for hospital employees, it will not generate any additional traffic or parking problems in the area of the hospital. -2- 8. The proposal would result in increased noise levels on adjacent properties during the hours children are using the outside play area. Also, the appearance of the site • will change somewhat due to the fencing. 9. The Planning Commission recommended to the City Council that the request be granted for a Planned Development Zone. CONCLUSIONS: 1. The recommendation of the Planning Commission to grant the rezone should be affirmed, and the rezone should be granted. now, therefore, BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. The recommendation of the Planning Commission of the City of Yakima that the following described real property situate at 217 - 219 South 30th Avenue in the City of Yakima, Washington, and more particularly described as follows, to wit: The West half of Lots 11 and 12 of Nob Hill Orchard Heights as recorded in Volume "E", Page 25, records of Yakima County, Washington. be rezoned from R-1, One-Family Zone,to Planned Development Zone be, and the same is hereby, approved and said real property is hereby rezoned to a Planned Development Zone, all in accordance with, and to conform to, the final development plan and program therefor approved by the Yakima Planning Commission, a copy of which is attached hereto and by reference made a part hereof. Section 2. The above change in zoning shall be included and depicted on the next regularly amended Use District Map prepared by and for the City. Section 3. The City Clerk is hereby authorized and directed to file with the Yakima County Auditor a certified copy of this 411 ordinance. Section 4. This ordinance shall be in full force and effect thirty days after its passage, approval and publication as provided -3- by law and by the City Charter.
