EXECUTIVE SESSION
1. Executive Session regarding prospective and pending litigation
Council: Mayor Kathy Coffey, presiding,Assistant Mayor Dulce Gutierrez, Councilmembers
Holly Cousens (arrived 5:22 p.m.), Kay Funk, Brad Hill and Jason White
Absent and excused: Councilmember Carmen Mendez
MOTION: Gutierrez moved and Funk seconded to adjourn to Executive Session for up
to 30 minutes to discuss prospective and pending litigation. The motion carried by
unanimous vote.
Executive Session was held and adjourned at 5:28 p.m.

Mayor Coffey led the Pledge of Allegiance.
3, Interpreter Services
Mayor Coffey introduced Jorge Villasenor who announced interpreter services are available.4. Open Discussion for the Good of the Order
A. Employee Recognition for Community Relations Specialist Sean Davido
Communications and Public Affairs Manager Randy Beehler introduced and
recognized Community Relations Specialist Sean Davido for his exemplary work. Mayor
Coffey presented Mr. Davido with a City Apple Award.
B. Appointments to Boards, Commissions and Council Committees

i. Appointment to the Lodging Tax Advisory Committee
Mayor Coffey reported the Council Partnership Committee recommends appointment of Anne
Moneymaker, Sales & Marketing Manager of the State Fair Park, to the Lodging Tax Advisory
Committee to replace Greg Lybeck, who resigned his position with the State Fair Park.
MOTION: Cousens moved and Gutierrez seconded to approve the recommendation.
The motion carried by unanimous vote, Mendez absent.
5. Council Reports
A. Lodging Tax Advisory Committee Report
Mayor Coffey reported on the Lodging Tax Advisory Committee meeting of August 15, 2019.
Assistant Mayor Gutierrez requested staff to encourage SOZO to be an applicant for lodging
tax funds in the future.
B. Council Economic Development Committee report
Councilmember White reported on the recent Council Economic Development Committee
meeting.
MOTION: White moved and Gutierrez seconded to add the vacant building ordinance
to the next meeting. The motion carried by unanimous vote, Mendez absent.
6. Consent Agenda
Mayor Coffey referred to the items placed on the Consent Agenda, questioning whether there
were any additions or deletions from Council members present. There were no changes. The
City Clerk read the Consent Agenda items, including resolutions and ordinances, by title.
(Items on the Consent Agenda are handled under one motion without further discussion—see
motion directly below.)
MOTION: Gutierrez moved and Cousens seconded to approve the consent agenda.
The motion carried by unanimous vote, Mendez absent.
A. Approval of the minutes from the August 20, 2019 City Council regular meeting and
August 27, 2019 City Council special meeting
B. Resolution authorizing a contract with Selland Construction, Inc. for Alley Paving
Project
RESOLUTION NO. R-2019-084, A RESOLUTION authorizing a contract with Selland
Construction, Inc. for alley reconstruction
C. Resolution authorizing the Chief of Police to execute recurring annual agreements
with the United States Department of Justice, Drug Enforcement Administration

school resource officer program during the 2019-2020 school year
7. Public Comment
Luz Gutierrez, City resident, spoke about another city in the valley that utilizes lodging tax
•
funds for its annual Cinco de Mayo event and encouraged Yakima to do the same.
Matt Lunstrum, City resident, shared his concerns about the Yakima School District Board.
PUBLIC HEARINGS
8. Open record public hearing to consider the Yakima Planning Commission's recommendation
on a Comprehensive Plan Amendment (CPA#001-19) and Rezone (RZ#002-19) request
submitted by UPI Property II LLC
Planning Manager Joseph Calhoun briefed Council on the request, noting the Comprehensive
Plan Amendment process submittal period ended on April 30, 2019. He stated the Planning
Commission held a study session and a public hearing on the requests and forwarded its
recommendation for approval to the Council.
Mayor Coffey opened the public hearing and, with no one coming forward to speak, closed the
hearing.
MOTION: Gutierrez moved and Cousens seconded to direct staff to prepare
legislation to approve the request and bring this back to Council. The motion carried by
unanimous vote, Mendez absent.
9. Open record public hearing to consider the Yakima Planning Commission's recommendation
on a Comprehensive Plan Amendment(CPA#002-19)and Rezone (RZ#003-19) request
submitted by John I Haas Inc
Planning Manager Joseph Calhoun briefed Council on the request.
Mayor Coffey opened the public hearing and Mark Fickes, representing John I Haas, spoke in
support of this request.
MOTION: Gutierrez moved and Cousens seconded to direct staff to prepare
legislation to approve the request and bring this back to Council. The motion carried by
unanimous vote, Mendez absent.
10. Open record public hearing to consider the Yakima Planning Commission's recommendation
on a Comprehensive Plan Amendment (CPA#004-19) and Rezone (RZ#004-19) request
submitted by the City of Yakima Planning Division
Planning Manager Joseph Calhoun briefed Council on the request.
Mayor Coffey opened the public hearing and, with no one coming forward to speak, closed the
hearing.

legislation to approve the request and bring this back to Council. The motion carried by

on a Comprehensive Plan Amendment (CPA#006-19) and Rezone (RZ#006-19) request
submitted by River 16 LLC
Planning Manager Joseph Calhoun briefed Council on the request.

DEPARTMENT ITEMS
13. Resolution authorizing a Lease Agreement with Food Facility Engineering, Inc. for property
located at 2300 West Washington Ave, Suite 11, Yakima Air Terminal-McAllister Field
Mayor Coffey reported this item is postponed to a future meeting.
14. Ordinance repealing City of Yakima Municipal Code Chapter 9.25 Cruising Control
Community Development Specialist Colleda Monick and Councilmember White briefed
Council on a recent meeting with car club enthusiasts.
Art Reis, City resident, spoke favorably on the suggested amendments to the cruising
ordinance and shared how pleased he was with the recent meeting.
MOTION: White moved and Cousens seconded to have staff modify the
cruise ordinance that would allow cruising downtown Yakima on the second and third
Saturdays in June, July,August and September from 6-10 p.m. The motion carried by
unanimous vote, Mendez absent.
15. Ordinance imposing a local sales and use tax, as provided for in Substitute House Bill 1406, to
be used for the provision of affordable housing opportunities within the City; adding new
Sections 3.78.065 and 3.78.067 to the Yakima Municipal Code; and amending Section
3.78.080 of the Yakima Municipal Code
Assistant City Attorney Bleek briefed Council on the ordinance. The City Clerk read the
ordinance by title only.
MOTION: Gutierrez moved and Cousens seconded to pass the ordinance. The motion

carried by unanimous vote, Mendez absent.
ORDINANCE NO. 2019-020,AN ORDINANCE imposing the maximum capacity available
from the City's annual taxable retail sales and use tax, as provided for in Substitute House Bill
1406 effective July 28, 2019, to be used for the provision of affordable housing opportunities
within the City.
16. Ordinance granting PacifiCorp a non-exclusive franchise to locate, construct, maintain and
operate electric transmission and distribution lines within the City of Yakima and prescribing the
terms of such grant
City Attorney Cutter briefed Council on the ordinance. The City Clerk read the ordinance by
title only.
MOTION: Hill moved and Gutierrez seconded to pass the ordinance. The motion carried
by unanimous vote, Mendez absent.
ORDINANCE NO. 2019-021,AN ORDINANCE granting to PacifiCorp, an Oregon
Corporation, doing business as Pacific Power, a non-exclusive franchise to locate, construct,
maintain and operate electric transmission and distribution lines within the City of Yakima,
Washington, and prescribing the terms of such grant.
17. Other Business
Councilmember Funk requested staff provide materials for Executive Session ahead of time.
MOTION: Gutierrez moved and Cousens seconded to add the safe routes to
elementary schools issue to the next agenda. The motion carried by unanimous vote,
Mendez absent.
A. Discussion about, and possible modifications, of the current committee structure
utilized by the City Council
Councilmember Hills stated he would like to research this issue a little more. MOTION: Hill
moved and Cousens seconded to move this item to the October 1 meeting. The
motion carried by unanimous vote, Mendez absent.
18. Adjournment
MOTION: Gutierrez moved and Cousens seconded to adjourn to the next Council
regular meeting on September 17, 2019, at 4:30 p.m. in the Council Chambers at City
Hall. The motion carried by unanimous vote, Mendez absent. The meeting adjourned at 6:19
p.m.
