AN ORDINANCE authorizing and directing the City Attorney of
the City of Yakima to institute and prosecute
legal proceedings for the condemnation and
acquisition of real property for the widening
111 and improving of the intersection of 16th Avenue
and Lincoln Avenue and for the installation of
curbs, gutters, sidewalks, drainage facilities
• and public utility facilities related thereto;
providing for the condemnation and taking of
such real property and declaring the condemnation
and taking thereof to be necessary for a public
use required by the public interests; directing
• that compensation for such taking be paid from
fund number 142 - Arterial Street Fund of the
• City of Yakima; and declaring an emergency.
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. The City Attorney of the City of Yakima is
411 • hereby authorized and directed to institute and prosecute an
action in the Superior Court of the State of Washington, in
and for Yakima County, for the condemnation and acquisition of
the hereinafter described real property for the widening and
improving of the intersection of 16th Avenue and Lincoln Avenue
in the City of Yakima, Washington, and for the installation of
curbs, gutters, sidewalks, drainage facilities and public utility
facilities related thereto, all in acicordance with plans for
such improvement project as depicted n a drawing prepared by

the Yakima City Engineer, a copy of lejich drawing is attached
to this ordinance and by reference mese a part hereof, said real
property being legally described on hibit A To Condemnation
Ordinance" attached to this ordinance .nd by reference made a
part hereof.
Section 2. The acquisition of aid real property for the
purposes herein mentioned is requires:for the interests of the
public and of the City of Yakima, ar4the uses and purposes
herein mentioned do constitute a pubAc use of said property,
410 and said real property is necessary for the use and purposes
mentioned herein.
� Section 3. The compensation for said real property to
be taken shall be payable from fund number 142 - Arterial Street
Fund of the City of Yakima.
Section 4. In conducting said condemnation proceedings,

the City Attorney is hereby authorized to stipulate to any
matters for the purpose of minimizing damages.
Section 5. Funding for the acquisition of property and 411
for the project contemplated by this ordinance is available from
the State of Washington, Urban Arterial Board, provided that
this ordinance is immediately enacted and progress on the pro-
ject satisfactory to that Board has been made by October 15, 1981,
at which time the Board will determine whether to continue to
authorize the funding for this project or whether to cancel that
funding. Therefore, the City Council deems an emergency to exist Aft
and hereby declares that this ordinance is one to provide for the I P
immediate preservation of the public peace, property, health,
safety and welfare of the people of the City of Yakima and an
emergency is hereby declared to exist and this ordinance shall
be in full force and effect kffimediately upon its passage, approval
and publication as provided by law and by the City Charter.

EXHIBIT A TO CONDEMNATION ORDINANCE
• Each of the following parcels is situated in the City of

Yakima, Yakima County, Washington:
Parcel 104: Beginning at a point 59.88 feet north and
30 feet east of the southwest corner of
the northwest quarter of the northwest
quarter, of Section 24, Township 13 North,
Range 18 East, W.M.; thence southeasterly
along the arc of a 24 foot radius curve a
distance of 37.58 feet to a point 36 feet
north and 53.88 feet east of said south-
west corner; thence S 89 43' 00" E,
parallel with the south line of the north-
west quarter of the northwest quarter,
Section 24, a distance of 66.12 feet; thence
south parallel with the west line of said
northwest quarter a distance of 6 feet;
thence west parallel with said south line,
a distance of 90 feet; thence north 29.88
feet to the point of beginning.
Parcel 105: The north 6 feet of the south 36 feet of the
east 50 feet of the west 170 feet of the

Parcel 106: The north 6 feet of the south 36 feet of the

Parcel 107: Beginning at a point 220 feet east and 30
feet north of the southwest corner of the
northwest quarter, northwest quarter,
Section 24, Township 13 North, Range 18
East, W.M.; thence 'north 6 feet; thence
east, parallel with the south line of the
® northwest quarter, northwest quarter, a
distance of 30 feet; thence southeasterly
20.04 feet to a point which is 270 feet
east and 34.75 feet north of the southwest
