HomeMy WebLinkAbout1981-2570 ORDINANCE NO. t67 AN ORDINANCE relating to City government administration; specifying administrative departments and divisions and the fun - ctions thereof; designating duties of the City Manager, Assistant City Manager and department and division man- agers; and amending Sections 1.18.010, 1.18.015, 1.18.017, 1.18.030, 1.18.040, 1.18.050, 1.18.060, 1.18.070, 1.18.080, 1.18.081, and 1.18.200; adding new • Sections 1.18.005 and 1.18.065; and repealing 1.18.020 and 1.18.062, all of the City of Yakima Municipal Code. BE IT ORDAINED BY THE CITY OF AMA Section 1. Section 1.18.005 is hereby enacted as a new Section of the City of Yakima Municipal Code to read as follows: "1.18.005 Administrative Organization -- General Provisions. A. The City government administrative functions shall be performed by departments administered by department heads who shall be responsible to the City Manager for the direction and control of their respective departments. The City Manager, Assistant City Manager, Administrative Secretary, heads of departments, divisions and offices identified by this Chapter, lieutenants in the Police Department, City Prosecutor and Assistant City Attorneys, camprise the management group of the City government. B. The administration of the City government shall be divid- ed into departments as follows and with the following described general functions: 1. City Manager. Provides executive policy guidance and administrative oversight in the effective discharge of City Council policy and Charter and ordinance provisions. 2. Assistant City Manager. Assists the City Manager in performing those management functions; serves as thief labor negotiator for the City; and directs officers and divisions according to the provisions of this Chapter or as instructed by the City Manager. 3. Legal. Provides legal services including the de- fense and prosecution of civil lawsuits, drafting of legal documents and providing legal advice to the City management and City Council; prosecutes traffic offenses and other crim- inal violations. 4. Police. Provides protection of persons and property fran criminal acts. 5. Fire. Provides protection of persons and property fran loss caused by fires. 6. Public Works. Reponsible for street maintenance and refuse collection, for equipment maintenance and garage opera- tion and the City bus transit system, and performs sudz other functions as may be instructed by the City Manager. 7. Community and Economic Development. Responsible for • a housing rehabilitation program, enforcement and admins tration of building, fire and construction codes and for comprehensive physical and environmental planning and to direct proper urban and economic growth and development; overspps Cable TV operations and acts as liaison with the Convention Center and Capitol Theatre; and performs such other functions as may be directed by the City Manager. 8. Engineering and Water /Sewer Utilities. Responsible for all City traffic, civil and sanitary engineering services; responsible for operation of the Water Treatment Plant and Wastewater Treatment plant, along with water and sewer main- tenance operations; and for such other work as may be directed by the City Manager. 9. Parks and Recreation. Responsible for the construct- ion, maintenance and operation of park and recreation facil- ities for the use and enjoyment of the pUblic, operation of the municipal cemetery, senior citizens center, and for such other functions as may be directed by the City Manager. 10. Finance and Budget. Responsible for providing financial planning, budgeting, investments fiscal management, and customer services and for sudh other fUnctions as may be • directed by the City Manager." Section 2. Section 1.18.010 of the City of Yakima Municipal Code is hereby amended to read as follows: "1.18.010 City Manager -- Powers and Duties. The City Manager shall be the thief executive officer and the head of the admin- istrative brandh of the City government. He shall be responsible to the council for the proper administration of all administrative affairs of the City and to that end he shall have per and shall be required to: 1. Plan, direct and coordinate the administrative • functions of the City and administer and execute the laws and ordinances of the City. 2. Appoint and, when necessary for the good of the service, remove all administrative officers and employees of the City, all in campliance with Civil Service rules, regula- tions and laws; he may authorize the head of the department or office to appoint and remove subordinates in such department • or office; 3. Prepare the budget annually and submit it to the Council and be responsible for its administration after adopt- ion; 4. Prepare and submit to the Council at the end of the fiscal year a complete year-end financial report of the City for the preceding year. 5. Keep the Council advised of the financial condition of future needs of the City and make such recammendations as may seem to him desirable. 6. Administer all finance and fisical matters of the City and countersign warrants and approve claim voudhers and authorize travel for administrative personnel. 7. Perform such other duties as may be prescribed by this Chapter or required of him by the Council, not incon- sistent with the Charter. 8. Prepare and submit to the Council such reports as may be required by that body or he may deem it advisable to submit. 9. Transfer between items within any class in the budget, and notwithstanding the provisions of any statute to the contrary, the budgetary transfers herein authorized may be made as between any offices, departments, divisions, services, 1111 institutions,, etc., or any .combination thereof within the • City's organizational structure, which operate from the appro- priations of the same fund; provided, hagever, that no salary shall be increased above the amount provided therefor in the budget and compensation plan." Section 3. Section 1.18.015 of the City of Yakima Municipal Code is hereby amended to read as follows: RESORD FF2 12/81 "1.18.015 Assistant City Manager -- Powers and Duties. A. The City Manager may appoint an Assistant City Manager, or designate an employee of the City as such officer. Whenever the City Manager is unable to personally perform the duties of his office due to disability or absence fran the City, the Assistant City Manager, at no increase in salary, shall serve as Acting City Manager, and shall supervise and be responsible for the effective management and administration of City affairs and • otherwise shall be empowered with all the powers of the City Man- ager, except the per to appoint and remove heads of City depart- ments and divisions; provided, however, that whenever the. City Manager's absence or disability appears to the City Council to be of continuing duration, the City Council may, in its discretion appoint the Assistant City Manager or some other City employee to perform the duties City Manager. 4 .. B. The. Assistant City Manager shall direct primary divi- sions, supervised by division managers as follows: 1. Office. of Information Systems: Under the super- vision of the Information Systems Manager, this office shall: i. Analyze and make recommendations for automation of information systems within the various offices and . departments. ii. Design, program and maintain information sys- tems for approved applications. iii. Analyze, design and implement record retrieval systems for approved applications. iv. Administer a records management program pro - viding for the inventory, retention, and disposal of City records. v. Administer duplication services, and the Word Processing Center. vi. Perform such other services as may be required by the Assistant City Manager. 2. Office of Personnel: Under the supervision of the Personnel Officer, this office shall: i. Prepare and maintain a classification plan based on the duties and responsibilities of positions in the municipal competitive service. ii. Administer procedures for the appointment, pro- motion, discipline, and separation of employees, includ- ing recruitment, testing, counseling and selection ser- vices for all departments and offices. iii. Establish and maintain a personnel record system. iv. Administer all rules and regulations pertaining to Civil Service, and provide staff assistance to the Civil Service Commissions. v. Administer the City's Affirmative Action Pro- gram. vi. Develop and administer a safety and training program for all employees, except public safety per- sonnel. vii. Participates with the Assistant City Manager in the negotiations of collective bargaining agreements. viii. Perform such other services as may be required by law or by the Assistant City Manager. RESORD FF3 12/3/81 3. Office of City Clerk and Records: Under the super- -- vision of the City Clerk, this office shall: i. Receive, on behalf of the City Council, all petitions, claims, filings for office and similar offic- ial communications. ii. Maintain a journal of Council proceedings, record and index file all ordinances and resolutions and 0 post notices and make publications as required by law. iii® Maintain all Council records, books, papers, contracts, bonds and other valuable documents of the City unless provided for by other applicable laws. iv. Perform such other services as may be required by law or by the Assistant City Manager, v. Provide office support services for animal control and police and . fire pension systems. vi. Administer the telephone and information ser- vices for City. Hall. 4. Office of Purchasing. Under supervision of the Purchasing Agent, this office shall: i Purdzase all supplies, materials and services for the City, except the service of specialists, upon properly executed requisitions. ii. Store all supplies and materials not delivered to the various departments. iii. Supervise the disposal of surplus property. iv. Conduct management, operations and productivity analyses and perform such other services as may be re- quired by the Assistant City Manager. 5. Air Terminal Office: Under the supervision of the Airport. Manager, this office shall: i. Maintain and operate the Yakima Air Terminal buildings, runways and grounds. ii. Negotiates and administers lease agreements with tenants on Airport property. iii. Provide for the protection and security of air passengers. C. The Assistant City Manager further shall assist the City Manager in any other areas as he may designate and perform such other duties for the benefit of the City as City Manager may direct." Section 4. Section 1.18.017 of the City of Yakima Municipal Code is hereby amended to read as follows: "1.18.017 Legal Department. Under the general supervision of the ` City Attorney, the following divisions shall perform the fun- ctions and duties generally described as follows: 1. The Civil Division, under the direction of the City Attorney, shall: i. Advise and assist in the preparation of, and prepare in final form, all ordinances, orders and regu- lations. ii. Prepare and pass on the legality and correct- ness and form of all contracts, bonds and other legal instruments to which the City is a party. RESORD FF4 12/3/91 iii. Advise the Council, the City Manager, all departments heads and other administrative officials and all boards and commissions regarding legal matters. iv. Represent the City as attorney in all legal proceedings in which the City is a party. v. Recommend settlement or compromise of claims or suits at law or equity to which the City may be a party f involving property rights or money claims. vi. Preserve in its office copies of all opinions rendered by the department. vii. Attend all meetings of the City Council and, upon direction of the City Manager, any meeting of any City government committee or advisory board of the Coun- cil. viii. Perform such other legal duties as may be required by the City garter, ordinance, the Council, or the City Manager. 2. The Prosecution Division, under the direction of the City Prosecutor, shall: i. Be responsible for all prosecutions under ordinances of the City. ii. Advise the Police Department, and other law enforcement departments of the City, concerning enforce- ment of City penal codes. iii. Perform such other duties as may be directed by the City Attorney. 3. The City Attorney may hire Assistant City Attorneys or engage special legal counsel, all as authorized from time to time by the City Manager, as deemed appropriate by the volume of legal work assigned to the Legal Department." Section 5. Section 1.18.020 of the City of Yakima Municipal Code is hereby repealed. ( "Administrative Organization - General Provisions.) Section 6. Section 1.18.030 of the City of Yakima Municipal Code is hereby amended to read as follows: "1.18.030 Police Department A. Under the direction of the Chief of Police, this depart- ment shall: 1. Provide for the protection of persons and property and prevent crimes. 2. Detect and apprehend offenders and suspected per - sons. 3. Enforce all ordinances and statutes relating to law enforcement and traffic control. 4. Preserve peace and order in the City. 5. Perform such other duties as may be required B. This department shall consist of three primary divisions, supervised by Police Captains and Lieutenants responsible to the Chief of Police, as follows: RESORD FF5 12/1/81 1. The Patrol Division shall be responsible for uniform . field personnel and operational patrol functions and traffic control. 2. The Detective Division shall be responsible for the investigative functions of the Police Department, Bureau of Records and the Youth Bureau. 3. The Administrative Service Division shall be res- f possible for administrative services, communications and • complaints, and training functions." Section 7. Section 1.18.040 of the City of Yakima Municipal Code is hereby amended to read as follows: "1.18.040 Fire Department. A. Under the direction of the Fire Chief, the Fire Depart - ment shall: 1. Provide for the protection of persons and property and the elimination of fire hazards, except to the extent that the administration and enforcement of the Uniform Fire Code and other fire prevention and safety codes are assigned by this Chapter to the Office of Code Administration. 2. Perform such other duties as may be required by law and by the City Manager. B. The Fire Department shall consist of three divisions, as fol laws : • 1. The Fire Suppression Division, which shall: i. Respond to all alaLms and prevent and extin- guish fires; ii. Protect lives and property against loss from fire; iii. Maintain all property and equipment Charged to the Fire Department; iv. Perform such other duties as may be assigned by the Chief; 2. The Fire Investigation Bureau, which shall be res- ponsible for: i. Investigation of fires; ii. Promotion of fire prevention and life safety practices, except to the extent that all the adminis- tration and enforcement of the Uniform Fire Code anther fire prevention and safety costs are assigned by this Chapter to the Office of Code Administration; iii. Public eduction concerning fire safety; 3. The Administrative Services Division which shall be i p responsible for: i. Training, education and safety of deprtmental personnel; ii. Repair and maintenance of city communications, fire alarm and related systems; iii. The operation of the fire alarm headquarters." RFSORD FF`8 12/3/81 Section 8. Section 1.18.050 of the City of Yakima Municipal Code is hereby amended to read as follows: "1.18.050 Department of Public Works. Under the general direction of the Director of Public Works, the following offices and divisions shall perform the responsibilities and duties gen- erally described as follows: III 1. Street and Refuse Division. Under, the supervision of the Street and Refuse Superintendent, this division shall: i. Maintain, repair, and clean City streets, alleys, bridges and catch basins, and remove snow from the City streets; ii. Maintain and repair sidewalks; iii. Maintain street rights-of-way such as removing weeds, pruning or removal of unwanted trees; iv. Collect and dispose of refuse for residential sections of the City; v. Perform such other services as may be required , by law or by the Director of Public Works. 2. Garage and Equipment Maintenance Division. Under the supervision of the Fleet Manager, the Garage shall: „ i. Service, maintain and repair City vehicles and equipment; ii. Maintain vehicle maintenance and operation cost records, adffinister the equipment replacement fund and recommend rental rates; iii. Prepare specifications for new and replacement vehicles and equipment; iv . Perform such other services as may be required by law or by the Director of Public Wbrks. 3. Transit Division. Under the supervision of the Transit Manager, this division shall: i. Operate and maintain a public bus transpor- tation system; ii. Perform such other duties as may be required by law or by the Director of Public Wbrks.. Section 9. Section 1.18.060 of the City of Yakima Municipal Code is hereby amended to read as follows: "1.18.060 Community and Economic Development. Under the direction of the Director of Community and Economic Development, the following offices and divisions shall perform the responsi- bilities and duties generally described as follows: IN& Imp 1. Office of Environmental Planning. Under the super- vision of the Planning Manager, this office shall: i. Conduct studies and research relative to the development and redevelopment of the City of Yakima and its environs; ii. Conduct studies and research relative to the • amendment of and additions to the general plan of the. City, and relative to zoning, rezoning and subdivision of property; RESORD FF7 12/1/81 iii. Administer policies and procedures relative to annexations to the City, growth management, and the extension of City utilities to serve property outside the City; iv. Provide all staff assistance and counsel, secretarial and clerical services required by the City Planning Commission; v. Perform such other duties as may be directed by 410 the Director of Community and Economic Development. 2. Office of Housing and Neighborhood Conservation. Under the supervision of the Community Development Block Grant Manager, this office shall: i. Conduct studies and research and administer programs relative to housing, neighborhood rehabilitation and environment, and community development and redevelop- ment; ii. Provide staff assistance and counsel required by various housing and neighborhood conservation-related committees and groups; iii. Administer community development block grants; iv. Perform such other duties as may be directed by the Director of Cdmmunity and Economic Development. 3. Code Administration and Facility Maintenance Divi- sion. Under the supervision of the Code Administration Mana- ger, this office shall: Enforce all laws, rules and regulations rela- tive to zoning, housing, building, fire prevention, life safety, construction codes and litter control; ii. Provide staff assistance and counsel to the Board of Adjustment, building code Board of Appeals, Board of Plumbing Examiners, Medhanical Code Examining Board and the Housing Advisory and Appeals Board; iii. Be responsible for the maintenance of the City Hall building; iv. Perform such other duties as may be directed by law or by the Director of Community and Economic Develop- ment. 4. Cable TV Programming -- Convention Center and Cap- itol Theatre Liaison. Under the supervision of the department director, this function shall; i. Be responsible for City staff support and advice to the Convention Center Board and the Capitol Theatre Board, and act as liaison between those boards and the City government. ii. Cable TV franchise operations, coordinates and administers public cable TV programming, and serves as staff support to the Cable Television Advisory Committee, develops and administers cable television training pro- grams, and develops and administers a cable television budget." Section 10. Section 1.18.062 of the City of Yakima Municipal Code is hereby repealed. (Airport Security Guards - Powers and Duties.) RESORD FF8 12/1/81 , Section 11. Section 1.18.065 is hereby enacted as a new Section of the City of Yakima Municipal Code to read as follows: i s "1.18.065 Department of Engineering and Water /Sewer Utilities. Under the Director of Engineering and Utilities, the following offices and divisions shall perform the responsibilities and duties generally described as follows: • 1. Office of Engineering. Under the supervision of the '.. Director of Engineering and Utilities, this office shall perform the sanitary, civil and traffic engineering for the City, including the following specific functions: i. Provide for the preparation of all estimates, plans and specifications for all types of public con- struction projects. ii. Provide surveying and inspection services and maintain suitable files and records of all official maps, plats, surveys and construction projects. iii. Prepare legal descriptions and arrange for the acquisition of all street rights- of-way by dedication, purchase or condemnation. iv. Negotiate with property owners and prepare cost estimates and assessment rolls for all local improvement district projects. v. Administer construction contracts and authorize progress payments on public improvement projects, vi. Coordinate with other departments and provide survey and cost data needed in planning projects and applying for federal grants. vii. Make traffic studies and recommendations; prepare and review geometric designs of City streets and intersections. viii. Investigate complaints and prepare reports on requests for parking, speed control, signing, striping, signal and lighting installations. ix. Supervise installation of parking meters, signing and striping of City streets, installation and regulation of traffic signals, and the installation of street lights. x. Supervise abatement of vision hazards, place- ment of trees, utility poles, and landscaping in the public right -of -way. 2. Water -- Irrigation Division,; Under the supervision of the Water and Irrigation Superintendent, this division shall: i. Maintain and operate all domestic water lines, pumps, distribution systems, water meters, service lines and appurtenances, and water treatment plant. ii. Review plans of all now water lines and exten- sions of lines which are to be connected to the City water system. iii. Install and maintain fire hydrants. iv. Maintain maps and records of water system. v. Operate, maintain and improve the irrigation water system, including all lines, pumps, reservoirs, canals and ditches. RESORD FF9 12/1/81 . „ vi. Perform such other services as may be required by law or by the Director of Engineering and Utilities. 3. Wastewater Treatment Division. Under the super- , vision of the Wastewater Treatment Superintendent, this div- . ision shall: i. Maintain and operate all sewer lines, pumps, collection systems and appurtenances of the domestic sewer system. 411 ii. Maintain storm drains. iii. Maintain and operate the Wastewater Treatment Plant and industrial waste treatment system. iv. Perform suds other services as may be required by law or by the Director of Engineering and Utilities." Section 12. Section 1.18.070 of the City of Yakima Municipal code is hereby amended to read as follows: "1.18.070 Department of Parks and Recreation. Under the direction of the Director of Parks and Recreation, this department shall construct, maintain and operate public facilities for use and enjoyment by the Public administered by the following offices and divisions: 1. Parks Division. Under the supervision of the Dir- ector of Parks and Recreation, shall maintain the City parks and other public places as directed by law. 2. Recreation Division. Under the supervision of the Recreation Superintendent, Shall plan and implement recreation programs for the general welfare of the people of the City and perform such other duties as may be required by law or by the Director of Parks and Recreation. 3. Cemetery. Under the supervision of the Director of Parks and Recreation, this office Shall: i. Maintain and operate Tahana Cemetery. ii. Keep a correct record of all internments, showing the name, age, nativity, residence, whether married or single, and time of internment, of all persons buried in the cemetery, and of the lot, block and section in which each person is interred. iii. Collect and pay to the City Finance Director all money due the City from the sale of blocks or parts thereof or labor performed for lot owners in or about the cemetery. iv. Perform such other services as may be required by law or by the City Manager." Section 13. Section 1.18.080 of the City of Yakima Municipal Code is hereby amended to read as follows: "1.18.080 Department of Finance and Budget. Under the general direction of the Director of Finance and Budget, the following offices shall perform the responsibilities and duties generally described as follows: 1. Office of General Acccunts. Under the supervision of the Accounting Manager, this office shall: i. Compile estimates for the annual budget. ii. Maintain a general accounting system for the City government and exercise budgetary control over all expenditures by offices and departments. RESORD FF10 12/3/81 iii. Perform internal audits of all City financial affairs. • iv. Prepare a monthly report of the fiscal activ- ities of all funds for the preceding month and such other reports as may be required by the City Manager. . v. Determine the structure and operational .char- acteristics of all accounting systems used in the City I government. vi. Maintain control and a running inventory of all fixed assets of the City. vii. 'Maintain a uniform utility accounting system for the water and sewer utilities as required by state law. viii. Perform such other services as may be required by law or by the Director of Finance and Budget. 2. Office of Treasury. Under the supervision of the Director of Finance and Budget, this office shall: i. Be responsible for the receipt, custody and disbursement of all City funds, all local improvement district funds, and other trust funds, keeping accurate accounts of all collections and disbursements for each fund. ii. Be the custodian of all City investments and bank collateral, investing idle funds as may be prudent and lawful. iii. Prepare and submit all financial statements and reports required by law. iv. Presr:ribe the times at and manner in which monies received by the several offices and departments of the City shall be paid into the Treasury or deposited in a bank. v. Make deposits. of City funds in banks in the manner prescribed by law. vi. Purchase and sell bonds for the benefit of local improvement district funds and the Local Improve- ment District Guaranty Fund. vii. Maintain and supervise a risk management pro- gran covering City buildings, equipment and personnel. viii. Perform such other services as may be required by law or by the Director of Finance and Budget. 3. Office of Customer Services. Under the supervision of the Customer Services Manager, this office shall: i. Receive all customer applications for utility services. ii. Collect and maintain data for billing and collection of all customer utility accounts. iii. Turn on and off services and investigate ser- vice problems. iv. Maintain an office'for the purpose of receiving all money paid as bail for non-moving traffic violation citations. RESORD FF11 - 12/3/81 v. Enforce the provisions of the City's traffic ordinances pertaining to non - moving traffic violations, concurrently with the Police Department. Parking dieck- ers employed in this office are hereby vested with auth- ority to enforce such ordinances by placing notices on illegally parked vehicles, as prescribed by applicable ordinances, and by signing formal complaints for the issuance of warrants by the Court for violations of such ordinances. vi. Service, maintain and repair parking meters. vii. Supervise Animal Control Officers in the en- forcement of laws and ordinances relating to dogs and other animals. viii. Perform such other services as may be required red by law or the Director of Finance and Budget." Section 14. Section 1.18.081 of the City of Yakima Municipal Code is hereby amended to read as follows: "1.18.081 Animal Control Officer -- Duties and Authority. A. In order to enforce laws and ordinances relating to dogs and other animals, the position of animal control officer is creat- ed. The animal control officer shall be under the direction of the customer services manager and shall receive technical supervision from the Chief of Police. B. The animal control officer shall enforce all ordinances • pertaining to the regulation, control and licensing of dogs and other animals in the City, concurrently with the Police Department. For that purpose, the animal control officer and assistants are vested with authority to impound animals when required or author- ized to do so by applicable City ordinances, to issue notices to persons who they have reason to believe have violated suds ordin- ances, to sign formal complaints for the issuance of warrants by the court for violations of such ordinances, to cooperate with the health officer exercising jurisdiction in the City regarding the investigation of dog bites and the quarantine of dogs for rabies examinations, and with authority to otherwise perform duties im- posed by this section and other ordinances of the City." Section 15. Section 1.18.200 of the City of Yakima Municipal Code is hereby amended to read as follows: "1.18.0200 Creation of Other Departments. With the approval of the City Council, other departments, divisions or offices may be created by the City Manager, and existing departments, divisions or offices may be reorganized or dissolved, as the needs of the City require." Section 16. This ordinance shall be in full force and effect thirty days after its passage, approval and publication as provided by law and by the City Charter.
