ORDINANCE NO. pla73 410 AN ORDINANCE accepting the recommendation of the Planning Commis- sion and rezoning certain property situated at 182 and 1806 South 24th Avenue in the City of Yakima f:rom R-4, Suburban Residential Zone, to M-4, Planned Indus- 410 trial Zone. • WHEREAS, pursuant to due and legal notice, the City Council of the City of Yakima held a hearing on the 5th day of March, 1979, upon the recommendation of the Planning Commission that real property situated at 1802 and 1806 South 24th Avenue in the City of Yakima, Washington, the legal description of which is set out hereinbelow, be rezoned from R-4, Suburban Residential Zone, to M-4, Planned Industrial Zone, and WHEREAS, the City Council finds that such recommendation of • the Planning Commission for such rezoning should be approved for the reasons that such rezoning is in accord with good planning and with the General Plan of the City of Yakima; that the majority of property owners in the vicinity do not oppose the change in classification; that the needs of the City and community do require such change and that the highest and best use of said property is for Planned Industrial Zone, now, therefore, BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. The recommendation of the Planning Commission of the City of Yakima that the following described real property situated at 1802 and 1806 South 24th Avenue in the City of Yakima, Washington, and more particularly described as follows, to wit: That part of the northeast quarter of the southeast quarter of the northwest quarter lying south of Wide Hollow Creek and the part of the north 63 feet of the southeast quarter of the southeast quarter of the northwest quarter; EXCEPT the east 30 feet for street and EXCEPT right-of-way of Washington Avenue as recorded in records of Yakima County, Washington, and The north 62.5 feet of the south 596 feet of the southeast quarter of the southeast quarter of the northwest quarter of Section 35, Town- ship 13 North, Range 18, E.W.M., EXCEPT the east 30 feet for street and EXCEPT right-of-way for Washington Avenue, as recorded in records of Yakima County, Washington, be rezoned from R-4, Suburban Residential Zone, to M-4, Planned Industrial Zone, be, and the same is hereby, approved and said real property is hereby rezoned to a Planned Industrial Zone. Section 2. The above change in zoning shall be included and 110 depicted on the next regularly amended Use District Map prepared by and for the City. Section 3. The City Clerk is hereby authorized and directed to file with the Yakima County Auditor a certified copy of this ordinance. Section 4. This ordinance shall be in full force and effect thirty days after its passage, approval and publication as provided by law and by the City Charter.
