ORDINANCE NO. ‘2.25 4111 AN ORDINANCE accepting the recommendation of the Planning Commis- sion and rezoning property situated at 1701, 1705 and 1707 South 24th Avenue in the City of Yakima, Wash- , ington, from R-2, Two-Family Zone, to R-3, Multiple- , Family Zone. 110 WHEREAS, pursuant to due and legal notice, the City Council of the City of Yakima held a hearing on the 29th day of January, 1979, and held a rehearing on April 9, 1979, upon the recommendation of the Planning Commission, as reaffirmed at its meeting of March 3, 1979, that real property situated at 1701, 1705 and 1707 South 24th Avenue in the City of Yakima, Washington, the legal description of which is set out hreinbelow, be rezoned from R-2, Two-Family 411 Zone, to R-3, Multiple-Family Zone, and WHEREAS, the City Council finds that such recommendation of the Planning Commission for such rezoning should be approved for the reasons that such rezoning is in accord with good planning and with the General Plan of the City of Yakima; that the majority of property owners in the vicinity do not oppose the change in classi- fication; that the needs of the City and community do require such change and that the highest and best use of said property is for Multiple-Family Zone, now, therefore, BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. The recommendation of the Planning Commission of 111 the City of Yakima that the following described real property situated at 1701, 1705 and 1707 South 24th Avenue in the City of Yakima, Washington, and more particularly described'as follows, to wit: The north 6 acres of the southwest quarter of the northeast quarter of Section 35, Township 13 North, Range 18, E.W.M., except roads, be rezoned from R-2, Two-Family Zone, to R-3, Multiple-Family Zone, 111 be, and the same is hereby, approved and said real property is hereby rezoned to Multiple-Family Zone. Section 2. The above change in zoning shall be included and depicted on the next regularly amended Use District Map prepared by and for the City. Section 3. The City Clerk is hereby authorized and directed 411 to file with the Yakima County Auditor a certified copy of this ordinance. Section 4. This ordinance shall be in full force and effect 411 thirty days after its passage, approval and publication as pro- vided by law and by the City Charter. Long and Danny L. McLaughlin. WHEREAS, a hearing was held before the City Planning Commis- 110 sion on January 2, 1979, on the application of William Jeffries, Roberta I. Long and Danny L. McLaughlin requesting the rezone of property situated at 1701, 1705 and 1707 South 24th Avenue in the City of Yakima, Washington, which property is more particularly described as follows: The north 6 acres of the southwest quarter of the north- east quarter of Section 35, Township 13 North, Range 18, E.W.M., except roads, from R-2, Two-Family Zone, to R-3, Multiple-Family Zone, and WHEREAS, as a result of said hearing, said petition was granted, and WHEREAS, a hearing was held by the City Council on said appli- cation on January 29, 1979, and the City Couricil finds as a result of said hearing that a rehearing on said application for rezone should be held by the Planning Commission to assure that due con- sideration is given to the General Plan of the City of Yakima, as well as to other factors surrounding the application, before a final decision is made by the City Council, now, therefore, THE CITY COUNCIL OF THE CITY OF YAKIMA DOES HEREBY MOVE: That the Planning Commission of the City of Yakima be requested to hold a further hearing on the aforesaid rezone application and to report to the City Council within forty calendar days of the receipt of this Motion by the Planning Commission with respect to such rezone application; and the Clerk of the Council be directed to deliver a copy of this Motion to the Planning Commission forthwith.
