HomeMy WebLinkAbout1979-2299 TAXICAB STAND PERMITS; IMPOUNDMENT OF VEHICLES PARKED IN VIOLATION; UNLAWFUL TO PARK IN VIOLATION OF PERMIT SY ORDINANCE NO p.277 AN ORDINANCE relating to licenses and business regulations; providing ,ihte for the issuance of exclusive taxicab stand permits; providing for •the impoundment of vehicles parked in violation of such permit system; declaring it to be unlawful to park a vehicle in violation of such permit system; prohibiting certain other practices by the owner or operator of for-hire vehicles, and amending Sections 5.78.120 and 5.78.160 of the City of Yakima Municipal Code. BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. Section 5.78.120 of the City of Yakima Municipal Code is hereby amended to read as follows: "5.78.120 Taxicab stands. A. The traffic engineer of the City of Yakima may desig- nate and set aside spaces on the public streets where for- hire vehicles may stand while awaiting employment. The City Clerk may, upon application therefor, issue a permit to the owner of a for-hire vehicle granting him the exclusive use of any such space not previously designated for such use by another person. No permit shall be issued unless the appli- cant shall furnish proof of compliance with all laws of the state of Washington and ordinances of the City of Yakima re- lating to and governing the operation of for-hire vehicles and has attached to his application the written consent of the owner or lessee of the property abutting such space to the use of such space for taxicab stand. It is unlawful for any per- son to solicit, offer, give or receive, either directly or indirectly, anything of value as consideration for such written consent. The applicant for a permit contemplated by this sec- tion shall pay to the City the amount of eighty-two dollars and fifty cents each year for each space assigned to his exclusive use. The holder of a permit for exclusive use of any such space may obtain a transfer of his permit to another space, approved by the traffic engineer, on complying with the provisions of tl}is section and by the payment of a trans- fer fee in the amount of forty-four dollars to the City Clerk. B. It is unlawful for any person to knowingly stop, stand or park any vehicle within any such space previously designated for the use of a for-hire vehicle of another. C. Any law enforcement officer may impound or cause to be impounded any vehicle parked within any such space pre- viously designated for the use of a for-hire vehicle of another. Such impoundments shall be the same as an impoundment pursuant to Section 6.84.030 of the City of Yakima Municipal Code." Section 2. Section 5.78.160 of the City of Yakima Municipal Code is hereby amended by adding Subsection (i) to read as follows: "5.78.160 Prohibited practices. It is unlawful for the owner or operator of any for-hire vehicle to: (i) KnOwingly stop, stand or park within the space 41/ designated forthe use ofa for vehicle of another." Section 3. This ordinance shall be in full force and effect thirty days after its passage, approval and publication as provided by law and by the City Charter.
