AN ORDINANCE relating to city government administration, and
relating to the Human Relations Commission and
Affirmative Action Specialist position; amending
Section 1.18.010 of the City of Yakima Municipal
410 Code, designating the powers and duties of the
City Manager, by deleting a provision for the
appointment of a Community Relations Officer by
the Yakima City Council; amending Subsection
1.30.010 A of the City of Yakima Municipal Code
to, rename the Community Relations Officer position
to that of Affirmative Action Specialist; and
amending Section 1.30.050 of the City of Yakima
Municipal Code to describe the duties and functions
of the Affirmative Action Specialist.
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. Section 1.18.010 of the City of Yakima Municipal
Code is hereby amended to read as follows:
"1.18.010 City Manager--Powers and duties. The
City Manager shall be the chief executive officer and
the head of the administrative branch of the city govern-
ment. He shall be responsible to the Council for the
proper administration of all administrative affairs
of the City and to that end he shall have power and
shall be required to:
(1) Plan, direct and coordinate' the administra-
tive functions of the City and administer and execute
the laws and ordinances of the City;
(2) Appoint and, when necessary for the good
of the service, remove all administrative officers
and employees of the City, all in compliance with
civil service rules, regulations and laws; he may
authorize the head of the department or office to
appoint and remove subordinates in such department or
office;
(3) Prepare the budget annually and submit it
to the Council and be responsible for its administra-
tion after adoption;
(.4) Prepare and submit to the Council as of
the end of the fiscal year a complete report of the
finances and administrative activities of the City
for the preceding year;
(5) Keep the Council advised of the financial
condition and future needs of the City and make such
recommendations as may seem to him desirable;
(6) Administer all finance and fiscal matters
of the City and countersign all warrants and approve
all claim vouchers and authorize all travel for ad-
ministrative personnel;
(7) Perform such other duties as may be pres-
411 cribed by this chapter or required of him by the
.Council, not inconsistent with the Charter;
(8) Prepare and submit to the Council such
reports as may be required by that body or he may
deem it advisable to submit; the manager may have
•one confidential secretary, and if the volume of
business justifies it he may have an administrative
assistant;
(9) Transfer between items within any class
in the budget, and, notwithstanding the provisions

of any statute to the contrary, the budgetary trans-
fers herein authorized may be made as between any
offices, departments, divisions, services, institu-
tions, etc., or any combination thereof within the
City's organizational structure, which operate from
the appropriations of the same fund; provided, however,
that no salary shall be increased above the amount
provided therefor in the budget."
Section 2. Subsection 1.30.010 A of the City of Yakima Muni-
cipal Code is hereby amended to read as follows:
"1.30.010 Created -- Members.
A. Effective June 1, 1979, there is hereby created
a Human Relations Commission of the City of Yakima to
consist of seven members of various racial, religious
and ethnic backgrounds, who shall be representative
of the citizens of Yakima as to age, sex and economic
status, and who shall serve without compensation.
The Affirmative Action Specialist of the City of Yakima
shall be an ex- officio member and administrative assis-
tant to the commission, but shall not be entitled
to vote on any matter voted on by the commission."
Section 3. Section 1.30.050 of the City of Yakima Municipal
Code is hereby amended to read as follows:
"1.30.050 Affirmative Action Specialist. Under
the supervision of the Personnel Officer, the Affirma-
tive Action Specialist shall perform duties and functions
generally described as follows:
1. Serve as administrative staff to the Human
Relations Commission, attends Commission
meetings and serves as ex- officio member
of the Commission. Prepares minutes and
periodic reports on Commission activities.
On behalf of the Human Relations Commission
receives and investigates complaints by •
citizens with respect to charges of discrimina-
tion against City employees pursuant to rules
and regulations adopted by the Commission
and the City Council for investigating com-
plaints.
2. • Administers the City's Affirmative Action
Program, reviews and audits the Affirmative
Action Plan and develops recruitment programs
to address employment goals, timetables, and
other needs as identified. Makes recommenda-
tions for Affirmative Action Plan revisions.
Meets with citizen and community groups to
promote affirmative action outreach efforts.
Conducts in -house educational programs per-
taining to equal employment opportunity and
methods of attaining affirmative action
goals and timetables.
3. Prepares federal EEOC reports and submits
recommendations for city management for changes
in administrative and civil service procedures
with respect to affirmative action, as appro-
priate. Performs related duties as required.
4. Reviews city public improvement contracts for
compliance with federal, state and local affir-
mative action and equal employment opportunity
laws by both on -site review and written report,

makes recommendation for corrective action as
41 necessary. Provides assistance to depart-
ments and contractors in meeting legal require-
ments."
Section 4. This ordinance shall be in full force and effect
thirty days after its passage, approval and publication as provided
Ill by law and by the City Charter.
