A RESOLUTION authorizing a contract with Selland Construction, Inc. for alley
reconstruction
WHEREAS, in 2019 the City of Yakima has committed public utility funds for upgrades to
their utilities under Stormwater Capital Fund 442 to be expended on improvements to
approximately 4,000 feet of alley comprising the nine alleys and associated alley approaches
within the area between Cherry and Garfield Avenues on the north and south, and between
Oregon and Lewis Avenues on the east and west; and
WHEREAS, HLA Consulting, Inc. has prepared the plans and contract documents for the
construction of the improvements, which include alleys and associated alley approaches and
other related amenities; and
WHEREAS, the City of Yakima used the procedure established by Washington State law
for the bidding and awarding of public capital improvement projects; and
WHEREAS, Selland Construction, Inc. submitted the low bid and has the ability to
correctly install the improvements at a cost of $398,650 and
WHEREAS, the City's Chief Engineer has recommended awarding the contract to Selland
Construction, Inc. for installing the improvements; and
WHEREAS, the City Council finds that it is in the best interests of the City of Yakima and
its residents to improve the nine alleys and associated alley approaches in the area between
Cherry and Garfield Avenues on the north and south, and between Oregon and Lewis Avenues
on the east and west and award the construction contract; now, therefore
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
The City Manager is hereby authorized to execute the attached contract with Selland
Construction, Inc. in the amount of $398,650 for City Project No. SW2491, which improves the
nine alleys and associated alley approaches in the area between Cherry and Garfield Avenues
on the north and south, and between Oregon and Lewis Avenues on the east and west.

CONTRACT
THIS AGREEMENT, made and entered intriplicate, this day of .20_19 .byand between
the City ofYakima, hereinafter called the Owner, and Selland Construction, Inc, a
Washington Corporation, hereinafter called the Contractor.
HV|TNESSETH:
That in consideration of the terms and conditions contained herein and attached and made a port of this
agreement, the parties hereto covenant and agree aefollows:
|. The Contractor shall do all work and furnish all tools, materials, labor and equipment for THE
BID AMOUNT OF: $ »na'»o«,»» . for Yakima Alley Improvements - Phase 1. City of YmWnna
Project No. 2491, all in accordance with, and osdescribed in the attached plans and specifications and
the 2018 Standard Specifications for Road, Bridge, and Municipal Construction which are by this reference
incorporated herein and made o port hereof, and shall perform any alterations in oradditions to the work
provided under this contract and every part thereof.
Work shall start within ten (10) days after the Notice to Proceed and shall be completed in Thirty (30)
working days. If work has not commenced within the ten (10) days after the notice to proceed, the first
chargeable working day shall be the eleventh (1 1th) working day after the date on which the City issues the
Notice to Proceed.
If said work is not completed within the time specified, the Contractor agrees to pay to the Owner the sum
specified in the Standard Specifications for each day said work remains uncompleted after expiration of the
specified time, asliquidated damages. .
The Contractors shall provide and bear the expense of all equipment; work and labor of any sort whatsoever
that may be required for the transfer of materials and for constructing and completing the work provided for
in this contract and every part thereof, except such as are mentioned in the specifications to be furnished
bythe City ofYakima Yakima.
||. The City of Yakima hereby promises and agrees with the Contractor to emp|oy, and does
employ the Contractor tuprovide the materials and todoand cause tobedone the above described work
and to complete and finish the same according to the attached plans and specifications and the terms and
conditions herein contained and hereby contracts to pay for the .same according to the attached
specifications and the schedule of unit or itemized prices hereto attached, at the time and in the manner
and upon the conditions provided for in this contract.
|||. INDEMNIFICATION. The Contractor shall defend, indemnifv, and hold harmless the City, its
offinene, elected offinia|s, employees and agents from and against all n|ainno, causes of action, damages,
|osseo, and expenses of any kind or nature xvhotsoovar, including but not limited to, atb>mey'$feoa and
court costs, arising out of, relating to, or resulting from The (Contractor's perfonnence or non-performance
of the services, duties and obligations required of it under this Agreement.

assigns, does hereby agree to the full performance of all the covenants herein contained upon the part of
the Contractor. '
V. It is further provided that no liability shall attach to the City of Yakima Yakima by reason of
entering into this contract, except oaexpressly provided herein.

SUMMARY EXPLANATION:
City Project No. SW2491 reconstructs 4,000 of the 15,000 linear feet of alley and alley
approaches identified in the North Alley Paving project, a project listed in the 2019-2024 Six -Year
TIP. In contrast to the North Alley Paving project, which was limited to dust abatement by the
application of a liquid dust control treatment to the existing gravel alleys, Project SW2491
includes base preparation, asphalt paving, and the addition of concrete alley approaches. The
nine alleys and associated approaches included in Project SW2491 are in the area bordered by
Cherry and Garfield Avenues on the north and south, and by Lewis and Oregon Avenues on the
west and east.
The City utilized the procedure established by the State of Washington for competitively bidding
projects. Four contractors submitted bids, with Selland Construction, Inc. submitting the lowest
bid of $398,650. See attached contract. The project is funded by Stormwater Capital Fund 442.
