AN ORDINANCE accepting the recoliauendation of the Planning Commis-
sion and rezoning property at 1406 Summitview Avenue
in the City of Yakima, Washington, from R-3, Multiple-
Family Zone, to Planned Development Zone, and declar-
ing an emergency.
WHEREAS, pursuant to due and legal notice, the City Council
of the City of Yakima held a hearing on the 25th day of Septem-
ber, 1979, unon the recommendation of the Planning Commission
that real property situate at 1406 Summitview Aenue in the City
of Yakima, Washington, the legal description of which is set out
hereinbelow, be rezoned from R-3, Multiple-ramily Zone, to Planned
Development Zone, and
WHEREAS, as a result of its hearing, the City Council hereby
makes its following findings and conclusions:
FINDINGS:
1. The subject property is presently improved with green-
houses and a floral shop which have existed for many years
and which constitute nonconforming uses on the currently
zoned R-3, Multiple-Family Zone parcel. The development
plan for the property includes the removal of the existing
greenhouses and a portion of the existing floral shop to ac-
commodate construction of a new floral shop and greenhouses
on the site.
2. Land use and zoning on adjacent properties is as follows:

3. Summitview Avenue, which runs adjacent to the northerly
boundary of the subject parcel, is classified as a major
arterial street.
4. The General Plan for the City of Yakima indicates the site
as best suited for Low Medium Density Residential Use (6-12
DU/NRA).
5. The existing greenhouses on the property are in a
dilapidated condition, open to unauthorized entry and subject
to vandalism, resulting in broken glass strewn on the premises
and on adjacent public rights of way, all of which constitute
a potential or actual hazard to the occupants of the buildings
and to the public, and it is in the best interests of the
public to allow reconstruction of the premises to commence
as soon as possible.
CONCLUSIONS:
1. Although a business use of the site does not conform
to the General Plan, the proposed redevelopment of the exist-
ing business on the property in accordance with the development
program will be compatible with other land uses in the vicinity.
2. The redevelopment will result in the removal of unsightly
and unsafe structures and therefore have a positive visual
impact.
3. The recommendation of the Planning Commission to grant
the rezone subject to the conditions contained hereinbelow
should be affirmed and the rezone should be granted.
41/ 4. The existing condition of the property hereinabove found
to exist justifies the declaration of an emergency so as to
make this ordinance immediately effective on its publication,
as required by law and the Yakima City Charter.

BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. The recommendation of the Planning Commission of
the City of Yakima that the following described real property situate
at 1406 Summitview Avenue in the City of Yakima, Washington, and more
particularly described as follows, to wit:
That part of the northwest quarter of the southwest quarter
• of Section 24, Township 13 North, Range 18 East, W.M.
bounded as follows:
Commencing at the west quarter corner of said Section
24; thence south 0°15' east along the west line thereof
30.00 feet; thence east, parallel with the Monumented
centerline of Summitview Avenue , 829.18 feet to the point
of beginning; thence east 210.00 feet to the west line of
Hall Avenue as deeded to the City of Yakima; thence south
0 east along said west line of Hall Avenue 113.45
feet to the north line of West "A" Street; thence south
89°52' west along the north line of West "A" Street 210.00
feet; thence north 0°11'30" west 113.92 feet to the point
of beginning;
EXCEPT that part thereof deeded to the City of Yakima for
street and recorded under Auditor's File No. 2002823,
Records of Yakima County, Washington,
be rezoned from R-3, Multiple-Family Zone, to Planned Development
Zone be, and the same is hereby, approved and said real property is
hereby rezoned to a Planned Development Zone, all in accordance with,
and to conform to, the final development plan and program therefor
approved by the Yakima Planning Commission, a copy of which is attached
hereto and by reference made a part hereof; provided, this rezone is
granted with the following conditions:
1. The "A" Street sidewalk be extended to the west boundary
of the site.
2. The off-street parking area be drained by use of a dry
well with drain lines of sufficient capacity.
410 3. That all sidewalk, off-street parking, and landscaping
improvements be completed prior to the issuance of a Certi-
ficate of Occupancy by the City.
Section 2. The above change in zoning shall be included and
depicted on the next regularly amended Use District Map prepared by
and for the City.
Section 3. The City Clerk is hereby authorized and directed
to file with the Yakima County Auditor a certified copy of this

ordinance.
Section 4. This ordinance is one to provide for the immediate
preservation of the public-peace, property, health, safety and wel-
fare of the people of the City of Yakima and an emergency is hereby
declared to exist and this ordinance shall be in full force and
40 effect immediately upon its passage, approval and publication as
provided by law and by the City Charter.
