from B-1, Modified Business Zone, to Planned Develop-
ment Zone.
WHEREAS , ot Council
of the City of Yakima held a hearing on the 25th day of Septem-
ber, 1979, upon the recommendation of the Planning Commission that
real property situate in the vicinity of 205 North 40th Avenue
in the City of Yakima, Washington, the legal description of which
is set out hereinbelow, be rezoned from B-1, Modified Business
Zone, to Planned Development Zone, and
WHEREAS, as a result of its hearing the City Council hereby
makes its following findings and conclusions:
FINDINGS:
1. The property is currently zoned B-1, Modified Business
Zone, and contains an abandoned service station, Crescent
Medical Center, and parking facilities.
2. The surrounding properties are as follows:
Zoning Land Use
NORTH R-3 Single Family Res idential
SOUTH B-1 Service Station - Church
EAST B-1 Professional Offices
WEST B-2 Westpark Shopping Center
3. The General Plan for the City of Yakima indicates the
property best suited for low-medium density residential
development 6-12 DU/NRA.
' 4. Summitview and North 40th Avenues are shown as Major
Arterials on the Arterial Street Plan.
CONCLUSIONS:
1. The plan calls for the removal of the existing aban-
doned service station building; and the establishment
410 of a banking facility with associated off-street parking
on the site, which is compatible with uses in the area.
2. The recommendation of the Planning Commission to grant
the rezone subject to the conditions contained hereinbelow
should be affirmed and the rezone should be granted.
Now, therefore,
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. The recommendation of the Planning Commission
of the City of Yakima that the following described real property
situate in the vicinity of 205 North 40th Avenue in the City of
Yakima, Washington, and more particularly described as follows,
to wit:
Lots 1, 2 and 4 of Ott's Addition, as recorded in Volume
"G" of Plats, page 35, records of Yakima County, Washing-
ton,
AND
Lots 11 and 12 of Crescent Hill Homes as recorded in
Volume "J" of Plats, page 29, records of Yakima County,
Washington,
be rezoned from B=1, Modified Business Zone, to Planned Development
Zone be, and the same is hereby, approved and said real property
is hereby rezoned to a Planned Development Zone, all in accordance
with, and to conform to, the final development plan and program
therefor approved by the Yakima Planning Commission, a copy of
which is attached hereto and by reference made a part hereof;
provided, this rezone is granted with the following condition:
That the applicant dedicate twenty (20) feet of right-
of-way along North 40th Avenue and twelve (12) feet of
right-of-way along Summitview Avenue.
Section 2. The above change in zoning shall be included
and depicted on the next regularly amended Use District Map
prepared by and for the City,.
Section 3. The City Clerk is hereby authorized and directed
to file with the Yakima County Auditor a certified copy of this
ordinance.
Section 4. This ordinance shall be in full force and effect
thirty days after its passage, approval and publication as provided
by law and by the City Charter.
