AN ORDINANCE accepting the recommendation of the Planning Commis-
sion and rezoning property in the vicinity of North
10th Street and East Lincoln Avenue from R-3, Multiple
Family Zone, to M-2, Heavy Industrial Zone.
410 WHEREAS, pursuant to due and legal notice, the City Council
of the City of Yakima held a hearing on the 9th day of October,
1979, upon the recommendation of the Planning Commission that
real property situated in the vicinity of North 10th Street and
East Lincoln Avenue in the City of Yakima, Washington, the legal
description of which is set out hereinbelow, be rezoned from R-3,
Multiple Family Zone, to M-2, Heavy Industrial Zone, and
WHEREAS, as a result of its hearing, the City Council hereby
makes its following findings and conclusions:
FINDINGS:
1. The subject property is presently vacant, but is a
part of two parcels under single ownership, with the adjacent
property presently being zoned M-2, Heavy Industrial Zone,
and used for industrial purposes.
2. The area surrounding the subject property is predominantly
either currently zoned for industrial use or developed for
industrial use.
CONCLUSIONS:
411 1. The subject property is not susceptible to development
for residential use.
2. The recommendation of the Planning Commission to grant
the rezone should be affirmed and the rezone should be
granted.
Now, therefore,
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. The recommendation of the Planning Commission of
411 the City of Yakima that the following described real property in
the vicinity of North 10th Street and East Lincoln Avenue in the
City of Yakima, Washington, and more particularly described as
follows, to wit:
That portion of parcels B and C in the southeast quarter
of Section 18, Township 13 North, Range 19, E.W.M., accord-
ing to the survey recorded in Book 15, pages 43 and 44,
records of Yakima County, Washington, bounded and described
as follows:
Commencing at the southeast corner or farcei or said
survey; thence7toi 88°03'37" west along the south line
of Parcel "C" 354.21 feet to the point of beginning; thence Ali
north 0°47'14" east along the east boundary of the south- • 11 11 ,
west quarter of .the southeast quarter of said Section 18
277.82 feet to the .northeast corner of said southwest quar-
ter; thence north 87°55'19" west along the north boundary
of said southwest quarter 546.22 feet; thence south 1717'
east 203.1.3 feet; thence north 72°42'08" east 10 feet; thenclilk
north 17°17' west 27 feet; thence north 83°38'27" east 100.15
feet; thence south 88°42'52" east 346 feet; thence south
1°59'12" west 190 feet; to the southeast corner of that
tract of land conveyed to Pacific Power and Light Company
by instrument recorded under Auditor's File No. 2162017, •
• records of Yakima County, Washington; thence, north 88°43'52"
west along the south line of said tract 204.54 feet to the •
easterly line of North 10th Street; thence south 17
east along the easterly line of North 10th Street 251.65
feet; thence north 72°41' east 140.00 feet; thence south
17°19' east 200 feet; thence north 0°47'14" east 376.09
feet along the easterly boundary of the southwest quarter
of the southeast quarter of Section 18 to the point of
beginning,

be from R-3, Multiple Family Zone, to M-2, Heavy Industrial '
Zone, be, and the same is hereby, approved and said real property
is hereby zoned to M-2, Heavy Industrial Zone.
Section 2. The above change in zoning shall be included

and depicted on the next regularly amended Use District Map pre-
pared by and for the City.
Section 3. The City Clerk is hereby authorized and directed
to file with the Yakima County Auditor a certified copy of this
ordinance.
Section 4. This ordinance shall be in full, force and effect
thirty days after its passage, approval and publication as provided -'-'
by law and by the City Charter.
