AN ORDINANCE granting major modifications to a Planned Development
Zone for certain property situated at 1015 South 40th
Avenue within the City of Yakima, Washington.
410 WHEREAS, by City of Yakima Ordinance No. 1331, enacted August
23, 1973, real property described below was zoned Planned Develop-
ment Zone, and modifications to the development of that property
were authorized by City of Yakima Ordinance No. 1590, enacted
December 3, 1973, Ordinance No. 1662, enacted May 13, 1974, and
Ordinance No. 1965, enacted June 21, 1976, and
WHEREAS, an application has been filed requesting further
modifications to the plan and program for the development of such
property; and the Planning Commission recommended granting such
modifications pursuant to its hearing conducted on October 2, 1979,
• and
WHEREAS, the Yakima City Council held its hearing on Octo-
ber 23, 1979, on the request for such modifications, as a result
of which hearing the City Council hereby makes its following find-
ings and conclusions:
FINDINGS:
1. • The applicant has submitted an application for a
modification of a previously approved Planned Development
located at 1015 South 40th Avenue. The request involves two
S medical office buildings proposed to be constructed on the
easterly portion of the site. The request asks for an
approximately 2000 square foot reduction in the size of the
building proposed to be located in the northeast corner of
the site and a relocation of the other proposed building
to a location adjacent to South 38th Avenue.
2. The proposed modifications will not alter the use
or architectural design of the buildings and will reduce
the number of off-street parking spaces from 151 to 143.
The proposed relocation of the one building would, however,
affect the view from residences on the east side of South 38th
Avenue.
3. The Yakima City Planning Commission, in public hearing
on October 2, 1979, recommended approval of the modification
request subject to certain conditions which are contained
hereinbelow as conditions to the grant of this modification
request.

1. The problem of view obstruction of neighboring resi-
dences can be overcome by lowering the construction grade
of both buildings approximately two (2) feet below the eleva-
tion of the 38th Avenue curb. The natural slope of the site
should facilitate the grade change.
2. The recommendation of the Planning Commission to
grant the major modifications subject to the conditions con-
tained hereinbelow should be affirmed and the request for
major modifications should be granted.
Now, therefore,
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. The recommendation of the Planning Commission
to grant major modifications to the Planned Development Zone for
certain property situated at 1015 South 40th Avenue in the City
of Yakima, Washington, and more particularly described as follows,
to wit:
The northeast quarter of the southwest quarter of the south-
west quarter of the northeast quarter of Section 27, Township
13 North, Range 18, E.W.M.,
EXCEPT the east 25 feet conveyed to Yakima County for road; and
EXCEPT the east 134 feet of the south 110 feet of said sub-
division; and
EXCEPT the south 6 feet of said subdivision,
Ehould be approved so that the development of said property shall
conform to the final development plan and program, as modified,
ached hereto and by reference made a part hereof; provided, this
major modification is granted with the following conditions:
1. Lowering the construction grade of the buildings
approximately two (2) feet below the elevation of the South 41/
38th Avenue curb.
2. Submittal of surface water drainage plans to be approved
by the City Office of Engineering.
3. Location and number of fire hydrants and fire flow
as required by the City Fire Marshall.
Section 2. The above change in zoning shall be included and

411 depicted on the next regularly amended Use District Map prepared
by and for the City.
Section 3. The City Clerk is hereby authorized and directed
to file with the Yakima County Auditor a certified copy of this
ordinance.
Section 4. This ordinance shall be in full force and effect
thirty days after its passage, approval and publication as pro-
vided by law and by the City Charter.
