AN ORDINANCE accepting the recommendation of the Planning Commis-
sion and rezoning property at 111 North Naches Ave-
nue in the City of Yakima, Washington, from R-3,
Multiple Family Zone, and Planned Development Zone
to Planned Development Zone.
WHEREAS, pursuant to due and legal notice, the City Council
of the City of Yakima held a hearing on the 23rd day of October,
1979, upon the recommendation of the Planning Commission that real
property situate at 111 North Naches Avenue in the City of Yakima,
Washington, the legal description of which is set out hereinbelow,
be rezoned from R-3, Multiple Family Zone, and Planned Development
Zone to Planned Development Zone, and
WHEREAS, as a result of its hearing the City Council hereby
makes its following findings and conclusions:
FINDINGS:
1. The subject property consists of four lots. The nor-
therly two lots are zoned Planned Development and are occupied
by a vacant house. The southerly two lots are zoned R-3
with the southernmost occupied by a multi-family dwelling.
2. Land use and zoning of other property in the vicinity
of the subject property are as follows:

3. The City of Yakima General Plan, as amended by the Cen-
tral Business District Plan, indicates the area as best suited
for social and fraternal organizations. The CBD plan also
states that "although there is a general intent in the Land
Use Plan to encourage development of the indicated uses within
411 the separate areas, this is not to say that this precludes
the location of other compatible uses within such areas; . . ."
4. The existing house located at 111 North Naches Avenue,
which was recently zoned Planned Development for use as a
professional office, would be removed to accommodate the
condominium structure. Although the structure has some
architectural and historical significance, it has been so
severely damaged and vandalized that the cost of restora-
tion far exceeds the value of the site for other uses.
5. The Yakima City Planning Commission, on October 2,
1979, recommended approval of the request subject to cer
tain conditions, which are contained hereinbelow as condi-
tions to the grant of this rezone request.
CONCLUSIONS:
1. The proposed multi-family residential use is not of
a social or fraternal nature; however, it is similar to,
and compatible with, other land uses in the vicinity and
therefore conforms to the CBD Plan.
2. Use of the alley as the primary vehicular access to
the site will require improvement of the alley to handle
the increased traffic load. Improvement should consist of
paving the entire alley between "A" and "B" Streets.
3. The proposed fourteen (14) foot front yard setback is
equivalent to the setbacks of other buildings on the same
block and will therefore maintain the character of Naches
Avenue.
4. The recommendation of the Planning Commission to grant
the rezone subject to the conditions contained hereinbelow
should be affirmed and the rezone should be granted.
Now, therefore, 411
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. The recommendation of the Planning Commission
of the City of Yakima that the following described real property
situate at 111 North Naches Avenue in the City of Yakima, Washing-
)n, and more particularly described as follows, to wit:
Lots 11, 12 and 13 of Block 109 of the Town of North
Yakima, as recorded in Volume "A" of Plats, page 10, records
of Yakima County, Washington,

he rezoned from R-3, Multiple-Family Zone, and Planned Development
Zone to Planned Development Zone be, and the same is hereby,
approved and said real property is hereby rezoned to a Planned
Development Zone, all in accordance with, and to conform to,
the final development plan and program therefor approved by the
Yakima Planning Commission, a copy of which is attached hereto

411 and by reference made a part hereof; provided, this rezone is
granted with the following conditions:

1. Modification of parking area entrancesto provide ade-
quate site distance for traffic.
2. Provisions for disposal of surface dr4nage on the site.
Plans to be approved by the City Engineer. ,
3. Paving of the entire alley between "A" and "B" Streets.
Plans to be approved by the City Engineer.
4. Replacement of the existing sidewalk on Naches Avenue
adjacent to the site.
• 5. Removal and replanting of trees adjacent to the site
on Naches Avenue, subject to approval by the Office of
Environmental Planning.
Section 2. The above change in zoning shall be included
and depicted on the next regularly amended Use District Map pre-
pared by and for the City.
Section 3. The City Clerk is hereby authorized and directed
to file with the Yakima County Auditor a certified copy of this
ordinance.
Section 4. This ordinance shall be in full force and effect
thirty days after its passage, approval and publication as pro-

vided by law and by the City Charter.
