100. AN ORDINANCE accepting the recommendation of the Planning Commis-
' sion and rezoning property at 3414 Tieton Drive in
the City of Yakima, Washington, from R-1, Single Family
• Zone, to Planned Development Zone.
WHEREAS, pursuant to due and legal notice, the City Council
of the City of Yakima held a hearing on the 13th day of November,
1979, upon the recommendation of the Planning Commission that
real property situate at 3414 Tieton Drive in the City of Yakima,
Washington, the legal description of which is set out hereinbelow,
be rezoned from R-1, Single Family Zone, to Planned Development
Zone, and
WHEREAS, •as a result of its hearing, the City Council hereby
makes its following findings and concliisions:
Il k FINDINGS:
• 1. The property proposed for rezone is situate between
South 34th and South 35th Avenues immediately south of Tieton
Drive, and is _currently zoned R-1, 1-Family Zone.
2. A church building exists on-the north half of the
property, and a parking lot is installed on the south half
of the property. The purpose for the rezone request is to
redevelop the existing church and half of its parking lot
into an 80-unit apartment complex for retired people.
3. Land use and zoning on adjacent property is as follows:

EAST R-I Single Family
WEST PD R-2 Commercial (north one-half)
Two Family (south one-half)
4. The General Plan indicates the property to be best
suited for low density (0-6 DU/NRA) development.
5. The parking requirements for an 80-unit apartment
complex is 120 spaces. Since the project is for elderly
and retired people, the applicant has provided 41 spaces
(32 for residents and 9 for visitors).
6. The Planning Commission recommends approval of the
Planned Development Zone according to the final plan and
program, subject to conditions set out hereinbelow.
CONCLUSIONS:
1. Although the proposal is not in direct conformance. 411
with the General Plan, because-of the nature of the project,
it is consistent with the intent of the General Plan.
The proposed use is an appropriate conversion of the exist-
. ing church building and parking lot.
2. Because of the nature of the project, its accessibility
to transit lines, and a limit on resident vehicles, a bus
turnout should be provided.
3. Because of the nature of the proposal, the City Coun-
cil finds the number of parking spaces proposed to be suf-

ficient.

4. , The recommendation of the Planning Commission to grant
the rezone subject to the conditions contained hereinbelow
should be affirmed and the rezone should be granted.
Now, therefore,
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. The recommendation of the Planning Commission
of the City of Yakima that the following described real property
situate at 3414 Tieton Drive in the City of Yakima, Washington,
and more particularly described as follows, to wit:
Lots 1, 2, 14 and 15 of the Liebert Addition as recorded
in Volume "Q" of Plats, page 39, records of Yakima County,
Washington, together with the south 140 feet of the north 411
170 feet of the east half of the west half of the northeast
quarter of the northeast quarter of Section 27, Township
13 North, Range 18, E.W.M.,
EXCEPT the east 118 feet and the west 25 feet,
be rezoned from R-1, Single Family Zone, to Planned Development
Zone be, and the same is hereby, approved and said real property
is hereby rezoned to a Planned Development Zone, all in accordance
with, and to conform to, the final development plan and program
therefor approved by the Yakima Planning Commission, a copy of
which is attached hereto and by reference made a part hereof;
provided, this rezone is granted with the following conditions:
1. That the property owner dedicate an additional 5

feet of right-of-way on Tieton Drive, with the conveyance
to the City to be made within thirty days of the enactment
of this ordinance. •

410 2. That existing sewer and storm sewer easements be
vacated and relocated, subject to approval by the City,
with deeds vacating those easements to be delivered to
)110 the City within thirty days of the enactment of this
ordinance.
3. .A bus turnout be provided on the northwest corner
of the property.
4. A fire hydrant be installed 80 feet south of the
subject property, with one-half the fire hydrant and
installation cost to be paid by the developer.
Section 2. The above change in zoning shall be included and
410' depicted on the next regularly amended Use District Map prepared
by and for the City.
Section 3. The City Clerk is hereby authorized and directed
to file with the Yakima County Auditor a certified copy of this
ordinance.
Section 4. This ordinance shall be in full force and effect
thirty days after its passage, approval and publication as pro-
vided by law and by the City Charter.
