WHEREAS, the rate of accrual and extent of accumulated vacation time for the city management group was agreed to by • the City Council during its studies of the. 1980 proposed bud- get., to become applicable on January 1, 1980, coincidentally with the effective date of the 1980 budget, and WHEREAS, certain employees affected by the provisions of this ordinance will be penalized by the forfeiture of accumulated vacation time in the event this ordinance does not become effec- tive immediately, so that it will be applicable commencing January 1, 1980; and the City Council finds and declares that an,emergency therefore exists so .that this ordinance will become effective immediately, now, therefore, BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. Subsection 2.40.020 "A (2) of the City. of .Yakima Municipal Code is hereby amended to read as .follows: "2.40.020 Vacation leave. • A. Rate of Accrual of Vacation Leave. ® (2) Effective, January 1, 1980, all employees in . the exempt classification as specified by Section 2.20.100 of the City of Yakima Municipal Code, the chief of the fire department and the chief, captains and lieutenants of the police department shall be entitled to. vacation leave at the following rates: • • 1. Employees with less than two years of service shall earn eight hours per.full month of . - (12 days per year); • 2. Employees with two years or more but less than six years of service shall earn nine and one -third hours per full month of service (14 days per year); • 3. 'Employees with six years or more but less than ten years of service shall earn twelve hours per full ironth of service (18 days per year),; ® - 4. Employees with ten years or more but less • than fifteen years of service shall earn fourteen hours per full month of service (21 days per year); 5. Employees with fifteen or more years of service shall earn sixteen hours per full month of service (24 days per year)." Section 2. Subsection 2.40.020 B of the City of Yakima Municipal Code is hereby amended to read as follows: "2.40.020 Vacation leave. B. Accumulation of Vacation. (1) An employee within the bargaining unit of the American Federation of State, County and Municipal Employees may accumulate vacation leave time in an amount equal to the vacation time the employee earns during two years of service, according to the accrual rate specified in Subsection A (1) of this section. (2) An employee in the exempt classification as specified in Section 2.20.100 of the City of Yakima Municipal Code, the chief of the fire denartment and the chief, captains and lieutenants of the police department may accumulate vacation leave time in an amount equal to the vacation time the employee earns during two years of service, according to the accrual . rate specified in Subsection A (2) of this section. (3) All other employees covered by this chapter except those affecte* by Subsections B (1) and B (2) above may accumulate vacation leave time not to exceed, two hundred forty hours." Section 3. This ordinance is one to provide for the immediate, preservation of the public peace, property, health, safety and welfare of the People of the City of Yakima and an emergency is hereby declared to exist and this ordinance shall be in full force and effect immediately upon its passage, approval and publication as provided by law and by the City Charter.
