AN ORDINANCE accepting the recommendation of the Planning Commis-
sion and authorizing a major modification to a
planned development zone applicable to property
• at the northwest corner of the intersection of
31st Avenue and Tieton Drive in the City of Yakima.
• WHEREAS, pursuant to due and legal notice, the City Council
of the City of Yakima held a hearing on the 8th day of January,
1980, upon the recommendation of the Planning Commission for a
major modification to a planned development zone applicable to
property at the northwest corner of the intersection of 31st Ave
nue and Tieton Drive, the legal description of which property is
Ill set out hereinbelow, and
• WHEREAS, as a result of its hearing, the City Council hereby
makes its following findings and conclusions:
FINDINGS:
1. The subject property is owned by the New Valley
Osteopathic Hospital situate at the northwest corner
of 31st Avenue and Tieton Drive, and is presently zoned
as a Planned Development, including provision for off-
street parking.
2. The property has not yet been developed in accordance
110 with the presently applicable Planned Development Zone.
3. Yakima Valley Memorial Hospital, situate easterly
immediately across 31st Avenue from the subject property,
is undergoing a construction program resulting in the loss
of offstreet parking available to serve that hospital;
and it is the purpose of th modification sought by this
proceeding to provide offst eet parking to accommodate
Yakima Valley Memorial Hosp'tal for a two year period
during that construction pr gram.
CONCLUSIONS:
1. Although the proposed improvements are less than
those required by the Plann d Development and the off-
street parking standards of the City's zoning ordinance,
temporary use of the site w th the improvements requested
will immediately relieve t e present onstreet parking

congestion in the neighborhood caused by the construction
program of Yakima Valley Memorial Hospital.
2. The approval of the request will alter the require-
ments of the Planned Development for only the specified
two year time period.
3. There has been no neighborhood opposition to the
request.
4. It is in the best interest of the neighborhood and
the public use and interest of the community to alleviate
the existing onstreet parking congestion in the vicinity
of Yakima Valley Memorial Hospital by granting the modifi-
cation to the existing Planned Development Zone.
5. The recommendation of the Planning Commission to grant
the major modification should be affirmed.
Now, therefore,
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. The recommendation of the Planning Commission
of the City of Yakima that a major modification be authorized
to the Planned Development Zone applicable to property situate
at the northwest corner of the intersection of 31st Avenue and
Tieton Drive, in the City of Yakima, Washington, more particularly
described as follows, to wit:
The north 250 feet of the south 280 feet of the west
half of the southwest quarter of the southwest quarter
of the southwest quarter of Section 23, Township 13
North, Range 18, E.W.M.
EXCEPT the west 186.44 feet and
EXCEPT the east 25 feet thereof,
be, and is hereby, approved; and the Planned Development Zone
applicable to the above described property is hereby modified in
accordance with, and to conform to, the final development plan and
program for the development of that property, a copy of which,
entitled "Narrative Description of Project", is attached hereto
and by reference made a part hereof. Provided, this modified
development and use of the above described property shall terminatElp
no later than November 1, 1981, and, upon such termination, the
Planned Development Zone applicable to the above described property
as approved by City of Yakima Ordinance No. 1892, enacted January

12, 1976, shall be reinstated and applicable to that property.
411 Section 2. The above change in zoning shall be included and
depicted on the next regularly a ended use district map prepared
40 by and for the City.
Section 3. The City Clerk is hereby authorized and directed
to file with the Yakima County A ditor a certified copy of this
ordinance.
Section 4. This ordinance shall be in full force and effect
thirty days after its passage, approval and publication as provided
by law and by the City Charter.
