HomeMy WebLinkAbout1980-2371 REZONE PROPERTY ON 24TH AVENUE, ADJACENT TO WIDE HOLLOW CREEK. 411 ORDINANCE NO. ;Z3 AN ORDINANCE accepting the recommendation of the Planning Com- mission and rezoning property on 24th Avenue, adjacent to Wide Hollow Creek, from R-3, Multiple- Family Zone, to M-4, Planned Industrial Zone. WHEREAS, pursuant to due and legal notice, the City Council of the City of Yakima held a hearing on the 22nd day of January, 1980, upon the recommendation of the Planning Commission that real property situate on 24th Avenue, adjacent to Wide Hollow Creek, in the City of Yakima, Washington, the legal description of which is set out hereinbelow, be rezoned from R-3, Multiple- Family Zone, to M-4, Planned Industrial Zone, and WHEREAS, as a result of its hearing, the City Council here- by makes its following findings and conclusions: FINDINGS: 1. The subject property was rezoned from R-2, Two-Family Zone, to its existing R-3, Multiple-Family Zone, in early 1979 for the purpose of constructing a convalescent home, the plans for which have since been abandoned. 2. The property consists of 4.28 acres, and is presently improved with one single family dwelling only. 3. Land use and zoning on adjacent properties is as 111 follows: Zoning Land Use North R-2 Tahoma Cemetery South M-4 _Agriculture East R-2 Tahoma Cemetery West M-1 and R-3 Light Industrial and Single Family Residential 4. The General Plan for the City of Yakima indicates that the area is best suited for cemetery expansion. South 24th Avenue is indicated as a Secondary Arterial 411 Street. 5. Adequate sewer and water service is available in the vicinity of the site, however, some difficulty may be 411 experienced due to the topography of the site and its loca- tion adjacent to Wide Hollow Creek. 6. On January 2, 1980, the Yakima City Planning Commis- sion recommended approval of the request. CONCLUSIONS: 1. Even though the General Plan indicates this area to be best suited for cemetery expansion, the potential use of the site for cemetery expansion is unlikely because 0 the topography of the site would require a substantial fill. 2. The proposed use of the site and other uses permissible in the M-4 zone are compatible with the cemetery and the other industrial uses and zoning which are predominant in the vicinity of the airport; the only inconsistency in the general compatibility of uses and zoning in the area affecting this request being the remaining R-3 property lying between the rezone site and South 24th Avenue. However, the R-3 property is not presently developed to an R-3 use and is itself the cause of any potential incompatibility rather than the requested rezone. 3. The recommendation of the Planning Commission to grant the rezone should be affirmed. Now, therefore, BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. The recommendation of the Planning Commission of the City of Yakima that the following described real property 41 situate on South 24th Avenue, adjacent to Wide Hollow Creek, in the City of Yakima, Washington, and more particularly des- cribed as follows, to wit: The east two-thirdsof the north 6 acres of the west 16 acres of the southwest quarter of the northeast quarter of Section 35, Township 13 North, Range 18, E.W.M., and the north 81 feet of the west one-third of the north 6 acres of the west 16 acres of the southwest quarter of the northeast quarter EXCEPT 20 feet of right-of-way for road on the west, be rezoned from R-3, Multiple-Family Zone, to M-4, Planned Industrial Zone, be, and the same is hereby, approved and said real property is hereby zoned to M-4, Planned Industrial Zone. 411 Section 2. The above change in zoning shall be included and depicted on the next regularly amended use district map prepared by and for the City. -2- • Section 3. The City Clerk is hereby authorized and directed to file with the Yakima County Auditor a certified copy of this ordinance. Section 4. This ordinance shall be in full force and effect thirty . days after its passage, approval and publication as provided by law and by the City Charter.
