AN ORDINANCE accepting the recommendation of the. Planning Commis-
sion and rezoning property in the vicinity of South
18th Avenue and Greenway in the City of Yakima, Wash-
ington, from R-2, Two-Family Zone, to Planned Develop-
ment Zone.
WHEREAS, pursuant to due and legal notice, the City Council
of the City of Yakima held a hearing on the llth day of March, 1980,
upon the reconmiendation of the Planning Commission that real proper-
ty situate in the vicinity of South 18th Avenue and Greenway in
the City of Yakima, Washington, the legal description of which is
set out hereinbelow, be rezoned from R-2, Two-Family Zone, to Planned
Development Zone, and
WHEREAS, as the result of its hearing, the City Council hereby
makes its following findings and conclusions:
FINDINGS:
1. The subject property is presently zoned R-2, Two-Family
Zone, and occupied by a small single family residence and
a small apple orchard. The request is for the construction
of two single story duplexes on the site and the reten-
tion of the existing small single family residence
located on the site, to result in a proposed density of
approximately 6.25 DU/NRA. All other properties in the
110 neighborhood are zoned R-2 and the existing land use is
a mixture of medium density multi-family residential and
single-family residential on relatively large lots. The
present density in the neighborhood is approximately 6-8
DU/NRA.
2. Land use and zoning on adjacent properties is as follows:

3. The General Plan for the City of Yakima indicates that
the property is best suited for medium density residen-
tial use with a density range of 12-24 DU/NRA.
4. Greenway, which provides access to the site, is design-
nated as a local access street. Access to the two
duplexes is to be provided via an existing and recorded
20 foot access easement running from Greenway to the
northeastern corner of the site. The access is of suf-
ficient width for emergency vehicles. The access to
the single family dwelling is via another easement,
18 feet in width, which runs from Greenway to the
northwestern corner of the site. The access to the
duplexes is proposed to be paved, whereas, the access
to the single-family residence is proposed to remain
as a gravel surface.
5. The residents of the neighborhood have submitted a
petition in support of the project provided the follow-
ing
conditions are imposed:
(a). Installation of 6 foot solid cedar wood fence
along the north and south boundaries of the site.
(b). Removal of all existing fruit trees on the site.
(c). Surfacing of both drives with pavement.
6. On February 5, 1980, the Yakima City Planning Commis-
sion recommended approval of the Planned Development
Zone subject to certain conditions set out below and
incorporated as conditions No. 1 and 2 to the grant of
this rezone request.
CONCLUSIONS:
1. The proposal conforms to the General Plan.
2. The proposed density of approximately 6.25 DU/NRA is
equivalent to the existing density in the neighborhood.
3. The recommendation of the Planning Commission to grant
the rezone request subject to the conditions specified
by the Planning Commission, and subject to the additional
conditions specified hereinbelow, should be affirmed and
the rezone should be granted.
Now, therefore,
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. The recommendation of the Planning Commission of 410
the City of Yakima that the following described real property situate
in the vicinity of South 18th Avenue and Greenway in the City of
Yakima, Washington, and more particularly described as follows, to
wit:
Lot 28 of Suburban Acre Homes, except the north 100 feet
thereof, together with an easement and right-of-way over the
west 18 feet of the north 100 feet of Lot 28, as recorded
September 22, 1964, Yakima County Auditor's File No. 2011434
and except an easement for ingress and egress over the east
10 feet of the north 100 feet of Lot 28, and the west 10 fee*
of Lot 27, as disclosed by instrument recorded November 13, 1OF
1967, Yakima County Auditor's File No. 2148587,
be rezoned from R-2, Two-Family Zone, to Planned Development Zone
be, and the same is hereby, approved and said real property is 010
hereby rezoned to a Planned Development Zone, all in accordance
with, and to conform to, the final development plan and program
therefor approved by the Yakima Planning Commission, a copy of

which is attached hereto and by reference made a part hereof;
provided, this rezone is granted with the following conditions:
1. The drainage plan for the duplexes driveway and
parking area, and the engineering design therefor,
to be approved by the City Engineer.
2. The landscaping and irrigation plan to be approved
by the Office of Environmental Planning. The plan
shall specify the removal of all existing fruit trees
from the site.
3. Existing wire fences on the south and east, and the
existing wood fence on the west of the rezoned area,
411 shall be retained; and a site screen fence, to be sub-
ject to approval by the Office of Environmental Planning,
shall be installed along the northerly boundary of the
property (without destruction of existing trees along that
northerly boundary) except for the easterly 10 feet and
the westerly 18 feet of that northerly property line.
Section 2. The above change in zoning shall be included and
depicted on the next regularly amended Use District Map prepared
by and for the City.
Section 3. The City Clerk is hereby authorized and directed
• to file with the Yakima County Auditor a certified copy of this
ordinance.
Section 4. This ordinance shall be in full force and effect
thirty days after its passage, approval and publication as provided
by law and by the City Charter.
