ORDINANCE NO. p2 39 AN ORDINANCE accepting the recommendation of the Planning Commis- sion and rezoning property at 902 South 36th Avenue in the City of Yakima, Washington, from R-1, One- 411 Family Zone, to Planned Development Zone. WHEREAS, pursuant to due and legal notice, the City Council of the City of Yakima held a hearing on the llth day of March, 1980, upon the recommendation of the Planning Commission that real property situate at 902 South 36th Avenue in the City of Yakima, Washington, the legal description of which is set out hereinbelow, be rezoned from R-1, One-Family Zone, to Planned Development Zone, and WHEREAS, as a result of its hearing the City Council hereby makes its following findings and conclusions: FINDINGS: 1. The subject property is currently zoned R-1, One-Family Zone, and has a church constructed on the property. The proposal is for the purpose of constructing a 25- unit condominium complex. 2. Surrounding land use and zoning are as follows: Zoning Land Use NORTH R-3 Single-Family Residential (Duplex) EAST R-1 Single-Family Residential SOUTH R-1 Single-Family Residential WEST R-1 Single-Family Residential 3. The City's General Plan designates the area best suited for low-density residential development (0-6 DU/NRA). 4. Because of the location of traffic destination points and the design of 36th Avenue, it is anticipated that the pri- mary flow of traffic will be north to Tieton Drive. Al- though traffic generated from this project will be greater Ilk than normally anticipated from a single-family develop- ment, the impact to the area north of the proposal will not be substantial because of the limited number of sin- 111 gle-family residential properties accessing directly to 36th Avenue. 5. The massive appearance of the structures has been reduced by breaking up, separating and rearranging the structures on the site. 6. Although the project density is greater than what the 41 , General Plan has designated for the area, the proposal has substantially mitigated any impact caused by the increased density. 7. The applicant has satisfactorily met all the conditions of the preliminary plan and program. 8. The Planning Commission, at its meeting of February 5, 1980, granted approval of the rezone subject to the conditions set out hereinbelow. CONCLUSIONS: 1. The recommendation of the Planning Commission to grant am , the rezone subject to the conditions contained herein- below 10, should be affimed and the rezone should be granted. Now, therefore, BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. The recommendation of the Planning Commission of the City of Yakima that the following described real property situate at 902 South 36th Avenue in the City of Yakima, Washington, and more particularly described as follows, to wit: Lot 2 of Fisher Parkview Addition as recorded in Volume U, Page 21, of Plats, records of Yakima County, Washington, be rezoned from R-1, One-Family Zone, to Planned Development Zone 411 be, and the same is hereby, approved and said real property is here- by rezoned to Planned Development Zone, all in accordance with, and to conform to, the final development plan and program therefor approved by the Yakima Planning Commission, a copy of which is attached hereto and by reference made a part hereof; provided, this rezone is granted with the following conditions: 1. The Sundance Willow be excluded from the landscaping plan and be replaced with vegetation of similar height jill and bulk. 2. The applicant purchase and have installed on the pole across from the project entrance a 150 watt, 16,000 lumen . high pressure sodium light after removal by PP&L of the mercury vapor light, to be owned and maintained by the City. -2- Section 2. The above change in zoning shall be included and depicted on the next regularly amended Use District Map pre- pared by and for the City. Section 3. The City Clerk is hereby authorized and directed to file with the Yakima County Auditor a certified copy of this ordinance. Section 4. This ordinance shall be in full force and effect thirty days after its passage, approval and publication as pro- vided by law and by the City Charter.
