AN ORDINANCE accepting the recommendation of the Planning Commis-
sion and rezoning property in the vicinity of 416
South 46th Avenue, in the City of Yakima, Washing-
ton, from R-1, One-Family Zone, to Planned Develop-
ment Zone.
410 WHEREAS, pursuant to due and legal notice the City Council
of the City of Yakima held a hearing on the 22nd day of April,
1980, upon the recommendation of the Planning Commission that real
property situate in the vicinity of 416 South 46th Avenue in the
City of Yakima, Washington, the legal description of which is set
out hereinbelow, be rezoned from R-1, One-Family Zone, to Planned
Development Zone, and
WHEREAS, as a result of its hearing, the City Council hereby
makes its following findings and conclusions:
FINDINGS:
1. The subject property, consisting of two lots, is •
presently zoned R-1, One-Family Zone. One of the lots,
on the northwest corner of South 46th Avenue and Tieton,
is improved with a single family dwelling, and the other
lot, immediately north of an existing medical office,
• is improved with a single family dwelling and by a park-
ing lot for the existing medical office.
2. Petitioner's planned development and use of the
property would consist of removing the two existing
dwellings and the subsequent reconstruction of a family
medical care office approximately 8,000 square feet in
size. The medical office building is proposed to be
completed in two phases.
3. Specific land use and zoning on adjacent properties
is as follows:

Single Family Residential
4. The General Plan for the City of Yakima designates
• the site as Low Density Residential (0-6 D.U./N.R.A.). Tieton
Drive is classed as a Major Arterial Street and South 46th
410 and 47th Avenues are Local Access Streets.
5. The traffic flow on Tieton Drive will not be
affected since all traffic entering the site will be from side
streets.
411 6. The right-of-way for Tieton Drive does not meet present
standards; 10 feet of right-of-way must be dedicated by the
owner to the City as right-of-way for Tieton Drive.
7. On April 1, 1980, the Planning Commission considered
the request and recommended approval' subject to the con- 411
ditions set out hereinbelow.
CONCLUSIONS:
1. Although the proposed use of the site does not con-

form to the General Plan, the proposed family medical IIP
care office will be directly associated with an adjacent
and similar medical office and will provide additional
needed parking and improved traffic flow; and such use
will be compatible with other land uses in the vicinity.
2. The recommendation of the Planning Commission to grant
the rezone subject to the conditions contained hereinbelow
should be affirmed and the rezone should be granted.
Now, therefore,
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. The recommendation of the Planning Commission of
the City of Yakima that the following described real property
situate in the vicinity of 416 South 46th Avenue in the City of
Yakima, Washington, and more particularly described as follows,
to wit:
Lot 10, Block 1, of Highland Hills Addition according to
the official plat thereof recorded in plats, Volume Q,
page 19, records of Yakima County, Washington, and
Lot 3, Block 1, of Highland Hills Addition as recorded
in Volume Q of Plats, page 19, records of Yakima County,
Washington,
be rezoned from R-1, One-Family Zone, to Planned Development Zone
be, and the same is hereby, approved and said real property is
hereby rezoned to Planned Development Zone, all in accordance.
with, and to conform to, the final development plan and program
therefor approved by the Yakima Planning Commission, a copy of
which is attached hereto and by reference made a part hereof;
provided, this rezone is granted with the following conditions:
1. Landscaping, irrigation and fencing plans must be sub-
mitted to, and are subject to approval by, the Office of Environ-
mental Planning prior to issuance of a building permit.
2. Engineering plans for an on-site drainage disposal
must be submitted to, and are subject to approval by, the Office
of Engineering prior to installation of the off-street parking
area.
3. Prior to the issuance of a building permit, 10 feet
of right-of-way must be dedicated to the City as additional
right-of-way for Tieton Drive, as indicated on the plan consti-
tuting part of the final development plan and program for the
contemplated use of the subject property.
Section 2. The above change in zoning shall be included
and depicted on the next regularly amended use district map
prepared by and for the City.
Section 3. The City Clerk is hereby authorized and directed
to filed with the Yakima County Auditor a certified copy of this

ordinance.
Section 4. This ordinance shall be in full force and effect
thirty days after its passage, approval and publication as pro-
. vided by law and by the City Charter.
