ORDINANCE NO. 2 - AN ORDINANCE accepting the recommendation of the Planning Com- mission and rezoning certain property along North Front Street in the City of Yakima, Washington, 410 from R-3, Multiple-Family Zone, to M-1, Light Industrial Zone. WHEREAS, pursuant to due and legal notice, the City Coun- cil of the City of Yakima held a hearing on the 22nd day of April, 1980, upon the recommendation of the Planning Commission that certain real property on North Front Street in the City of Yakima, Washington, the legal description of which is set, out hereinbelow, be rezoned from R-3, Multiple-Family Zone, to M-1, Light Industrial Zone, and WHEREAS, as a result of its hearing, the City Council hereby makes its following findings and conclusions: FINDINGS: 1. This rezone was initiated by the Planning Commission for the purpose of removing an R-3 "island" in a predominately industrial and commercial area and making the area consistently zoned. 2. The subject property is currently zoned R-3 and is pre- _ dominantly single-family residential. The surrounding . • properties' land use and zoning are as follows: Zoning Land Use NORTH M-1 Industrial EAST B-2 Mixed Commercial and some residential SOUTH M-1 Commercial WEST M-1 Railroad (Industrial) 3. The General Plan indicates the area to be best suited for industrial development. 4. On April 1, 1980, the Planning Commission recommended approval of the rezone. 4 10 CONCLUSIONS: 1. The proposed rezone would dissolve an R-3 "island" which is surrounded by higher intensive-industrial and commercial uses. It is expected that this area will eventually be developed as industrial or commercial uses. 2. The proposal is consistent with the General Plan and is appropriate at that location. • 3. The recommendation of the Planning Commission to 111 rezone the subject property should be affirmed and the property should be rezoned accordingly. Now, therefore, 110 BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. The recommendation of the Planning Commission of the City of Yakima that the following described real property situate on North Front Street in the City of Yakima, Washington, and more particularly described as follows, to wit: Lots 9, 13, 14, 15 and 16 of Block 2 of "The Town of North Yakima", now Yakima, Washington, as recorded in Volume "A" of Plats, page 10, records of Yakima Co.nty, 110 Washington, ALSO Lots 9 through 14 of Block 3 of said Plat, be rezoned from R-3, Multiple Family Zone, to M-1, Light Industrial Zone, be, and the same is hereby, approved and saidreal property is hereby rezoned to Light Industrial Zone. • Section 2. The above change in zoning shall be included and depicted on the nest regularly amended Use District Map pre- pared by and for the City. Section 3. The City Clerk is hereby authorized and directed to file with the Yakima County Auditor a certified copy of this ordinance. 111 Section 4. This ordinance shall be in full force and effect thirty days after its passage, approval and publication as pro- vided by law and by the City Charter.
