AW AN ORDINANCE relating to city government personnel; providing for overtime pay for certain employees; amending Subsec- tion 2.40.100 A. 3. of the City of Yakima Municipsl Code; and declaring an emergency. WHEREAS, because of the eruption of the Mount St. Helens 411 volcano and resulting ash fallout, and the emergency thereby created which requires extraordinary time and effort by certain city employees in performing cleanup operations and other emergency work attributable to the volcanic eruption, and WHEREAS, under existing provisions of the City of Yakima Muni- cipal Code, no provision is made for overtime pay for city depart- ment heads, and the City Council deems it to be in the best interests of the City that overtime payment be provided for depart- ment heads when the overtime work is attributable to such an emergency, with this ordinance to be effective so as to be applic- able for the overtime work performed by department heads during the current emergency period which commenced on May 18, 1980; and the City Council finds an emergency to exist of the type contem- plated by Article VI, Section 2, of the Yakima City Charter so that this ordinance shall become immediately effective as provided by Section 2 hereof, now, therefore, BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. Subsection 2.40.100 A. 3. of the City of Yakima Muni- cipal Code is hereby amended to read as follows: 2.40.100 Overtime pay. A. 3. Department directors, when required to work overtime in a nonsupervisory capacity because of an emer- gency determined by the City Manager, may be paid overtime at a straight time rate; provided, commencing May 18, 1980, department directors, when required to work in excess of 40 hours during any work week in a supervisory capacity because of an emergency or unusual circumstance approved by the City Manager, shall be paid at the rate of time and one-half for such overtime work." Section 2. This ordinance is one to provide for the immediate preservation of the public peace, property, health, safety and wel- fare of the people of the City of Yakima and an emergency is hereby declared to exist and this ordinance shall be in full force and effect immediately upon its passage, approval and publication as provided by law and by the City Charter.
