HomeMy WebLinkAbout1980-2423 CONSTRUCTING A PIPE SEWER WITH WYE BRANCHES & MANHOLES; SUPPLYING WATER FOR DOMESTIC USE & FIRE PROTECTION. .,, III ORDINANCE NO. ;2 AN ORDINANCE providing for the improvement of certain property by constructing a pipe sewer with the necessary wye branches and manholes, by constructing the necessary mains, fire hydrants, valves and other 411 appurtenances for the purpose of supplying water for domestic use and fire protection; establish- ing a Local Improvement District, providing for the method of payment thereof, and creating a special fund. BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. The following described property situate in Yakima County, Washington, shall be improved by constructing a pipe sewer with the necessary wye branches and manholes: 111 Lots 6 through 32 of the proposed plat of Criterion Park to be located in the following described area: Lot 23 of the Plat of Section 36, Township 13 North, Range 18, E.W.M., recorded in Volume "E" of Plats, page 36, records of Yakima County, Washington, Except for the north 337 feet of the east 283.5 feet of said Lot 23; The west 134.5 feet of Lot 3 of Huxtable Model Orchards recorded in Volume "E" of Plats, page 41, records of Yakima County, Washington; Lots 14, 15, 16 and 18 of the Plat of Ahtanum Meadows recorded in Volume "Q" of Plats, page 47, records of Yakima County, Washington. Section 2. The following described property situate in Yakima County, Washington, shall be improved by constructing the necessary mains, fire hydrants, valves and other appurtenances 410 for the purpose of supplying water for domestic use and fire pro- tection: Lots 6 through 32 of the proposed plat of Criterion Park to be located in the following described area: Lot 23 of the Plat of Section 36, Township 13 North, Range 18,,E.W.M., recorded in Volume "E" of Plats, page 36, records of Yakima County, Washington, Except for the north 337 feet of the east 283.5 feet of said Lot 23. Section 3. There is hereby created a Local Improvement Dis- 0 trict, to be called "Local Improvement District No. 1030," which said district shall include all of the above described property. Section 4. The assessments shall be made according to special , benefits derived from the improvements without regard to the 111 zone and termini method. Section 5. All costs and expenses in connection with the con- struction of said improvements, including the engineering, inspec- tion, advertising, publication of notices, and all other expenses incident thereto, shall be levied and assessed against all of 111 the property legally and properly assessable therefor as provided by law and as above described. Section 6. All of the aforesaid construction work shall be 0 in accordance with the plans and specifications, profiles, maps and detailed drawings which have been prepared by the City Engineer, filed with the City Clerk, and which are hereby approved and adopted. Section 7. The work necessary to be done in connection with the making of said improvements shall be done by contract upon competitive bids according to specifications and plans as prepared by the Engineering Division of the Department of Community Develop- ment, and the City shall have the power to reject any and all bids. Section 8. There is hereby created a special fund, to be known as "Local Improvement Fund, District No. 1030", into which shall be placed all sums paid on account of the aforesaid special assessments, including all interest and penalties thereon, and in the event of the sale of local improvement bonds by the City, all premium and interest on said bonds issued for said improve- ment. Section 9. Bonds shall be issued in payment of the costs, and expense of said imprcwements, which bonds shall be redeemed by the collection of special assessments to be levied and assessed ID upon the property within said district, which assessments, with interest, shall be payable annually under the mode of payment "pay- ment by bonds" as defined by the statutes of the State of Washing- ton and the ordinances of the City of Yakima; provided, this improve- ment may be financed by the issuance of promissory notes, under the authority of R.C.W. 35.45.150 and Section 8.12.100 of the City of Yakima Municipal Code. The term and interest rate of bonds and 1". special assessments contemplated by this section shall conform to provisions, terms and conditions to be specified by a subsequent ordinance of the City of Yakima. Section 10.
