AN ORDINANCE providing for the vacation of a public alley in the City of Yakima, Washington. — WHEREAS, a petition signed by Yakima School District No. 7 and a private party has been filed with the City Council of the City of Yakima requesting the vacation of the hereinafter described public alley, with the school district having requested the vaca- tion without the payment of monetary compensation by the school district to the City, and WHEREAS, a hearing by the City Council was duly held on said petition, and as a result of such hearing the City Council finds it to be in the best interests of the City of Yakima that said peti- tion be granted and that said alley be vacated; and further that no compensation will be required to be paid to the City by Yakima School District No. 7 in accordance with City of Yakima Resolution No. D- , adopted June 24, 1980, now, therefore, BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. The following public alley in the City of Yakima, Washington, to wit: The alley in Block 269 of Ker's 2nd Addition to the Town of North Yakima, now Yakima, Washington, as recorded in Volume "A" of Plats, page 32, records of Yakima, Wash- ington, be, and the same is hereby vacated. Section 2. The City of Yakima hereby reserves all necessary easements, and the right to exercise and grant easements, over, along, and across, and above and below the surface, for the instal- lation, construction, repair and maintenance of city and other pub- lic utilities which may now exist in said alley or which may here- after be installed or constructed therein, as well as easements for furnishing other public services as may hereafter be deemed necessary or desirable by the City; and no building or other struc- ture shall be constructed on any portion of the vacated alley without the prior approval of the City. Section 3. The reservation of easements by Section 2 of this ordinance precludes the erection by abutting property owners of gates or other barriers so as to prevent access into the vacated alley by city and other public utility personnel and equipment for installation, construction, maintenance and repair purposes or by 11, personnel and equipment to furnish other public services, without prior arrangements with the City to provide such access. Section 4. This ordinance shall be in full force and effect 401, thirty days after its passage, approval and publication as provided by law and by the City Charter; provided, this ordinance shall not become effective until compensation in the amount of $860 has been paid to the City, representing one-half the appraised value of the vacated alley area abutting property other than that owned by Yakima School District No. 7. 7t PASSED BY THE CITY COUNCIL, signed and approved this 2Cd of , 1980.
