AN ORDINANCE relating to public services and utilities;
regulating the use of public and private sewers
and drains and the discharge of water into pub-
lic sewers; amending Subsection 7.62.050 B of
the City of Yakima Municipal Code; and declar-
ing an emergency.
4 110 WHEREAS, the City of Yakima is presently involved in
• litigation over the disposal of drainage waters and
WHEREAS, the current method of disposal of said drainage
waters has resulted in serious flooding, and
WHEREAS, the only possible method of disposal of said
drainage waters is into an existing city sanitary sewer, now,
therefore, the City Council finds and declares an emergency
to exist.
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. Subsection 7.62.050 B of the City of Yakima
Municipal Code is hereby amended to read as follows:
"7.62.050 Use of public sewers.
B. Stormwater and all other unpolluted drainage
shall be discharged to such sewers as are specifically
designated as storm sewers or to a natural outlet approved
by the Director of Public Works and other regulatory
agencies. Unpolluted industrial cooling water or process
waters may be discharged, on approval of the superinten-
dent, to a storm sewer or natural outlet; provided,
however, that the City Council by resolution may authorize
the discharge of storm and other unpolluted drainage
into a sanitary sewer upon a finding by the Council,
recited in the resolution, that the authorized discharge
will not overtax the current capacity of the sanitary
sewer system; that an emergency exists with respect to
disposal of storm waters and unpolluted waters in the
area of the proposed connection, and that the person,
firm or corporation making the request, other than the
City of Yakima, shall pay current rates for discharge
of waters into the sanitary sewer and bear the cost
of any metering device for determining such costs."
Section 2. This ordinance is one to provide for the immediate
preservation of the public peace, property, health, safety and
welfare of the people of the City of Yakima and an emergency is
hereby declared to exist and this ordinance shall be in full force
and effect immediately upon its passage, approval and publication
as provided by law and by the City Charter.
