ORDINANCE NO. c7
AN ORDINANCE of the City of Yakima, Washington,
adopting a plan for the acquisition, construc-
tion and installation of certain additions and
improvements to and extensions of the water
and sewerage system of the city; declaring the
estimated cost thereof, and providing for the
payment of such cost and declaring an emergency.
WHEREAS, this Council finds that the existing sanitary
sewerage system of the City of Yakima, Washington (hereinafter
called the "City"), should be improved by the acquisition,
construction and installation of the hereinafter provided for
additions and improvements to and extensions of such system
and by the maintenance of such system as improved; and
WHEREAS, in order to pay part of the cost of acquiring,
constructing and installing such additions and improvements to
and extension of such water system it is deemed necessary and
advisable that the City issue and sell its sewer revenue bonds
in the principal amount of not to exceed $2,425,733;
NOW, THEREFORE, BE IT ORDAINED by the Council of the City
of Yakima, Washington, as follows:
Section 1. The City shall construct and install improve-
ments to the wastewater treatment and disposal system of the
City. The City shall upgrade and expand the existing primary
treatment plant and add a new secondary treatment facility and
shall construct new interceptor sewers. Such project shall be
as more fully set forth in preliminary and final maps, plans,
and specifications therefor prepared by R. W. Beck and Associates
and now on file with the City.
The City shall acquire and install all equipment, lines,
pump stations, valves, fittings, and other appurtenances neces-
sary for the installation, use, and operation of the hereinbefore
411 authorized improvements; and shall acquire by purchase or con-
demnation, gift or grant, all property, both real and personal or

any interest therein, and all easements, rights-of-way and fran-
chises which may be found necessary to carry out the hereinbefore
authorized plans.
It is hereby provided that the above-described plan of
improvements shall be subject to such changes as to location and
as to size of pipe or in any other details of said plan not
affecting the service to be rendered thereby which shall be
authorized by the City Council either prior to or during the
actual course of construction and which shall be found necessary
and desirable, so long as the same do not affect or change the
main general features of said plans as above set forth.
Section 2. The estimated cost of acquiring, constructing
and installing the above-provided for plans of additions and
improvements to the existing system of the City if hereby declared
to be, as near as may be, the sum of $20,189,330, approximately
$17,763,597 of which will be provided from anticipated grants
from the United States and the State of Washington. The remaining
amount of such cost shall be provided from the proceeds of sale

of water and sewer revenue bonds of the City in the principal
amount of not to exceed $2,425,733, or so much thereof as is
determined to be necessary by the City Council.
As an integral part of the plan of acquiring, constructing,
and installing the above-provided for additions, improvements,
and extensions the City shall issue and sell such water and sewer
revenue bonds in such amount or amounts and at such time or times
as this Council may determine to be to the best interest of the
City and its inhabitants. The exact date or dates, form, terms,
maturities and covenants of such bonds shall be as hereafter
fixed by ordinance or ordinances of the City.
Section 3. All of such grants and all other monies avail-
able for payment of the cost of the above-described facilities

and the proceeds of the sale of such. bonds shall be paid into the
Yakima Wastewater Facilities Project Fund heretofore created by
Ordinance No. 2123 of the City Council, passed October 24, 1977.
All costs of such facilities shall be paid out of such fund.
01/ When there are insuffient monies on hand in said fund to pay
approved costs of such facilities, warrants in payment thereof
shall be drawn in such fund marked "not paid for want of funds"
. and registered by the City Treasurer. Said warrants shall bear
interest from date of registration at such rate as shall be
determined by the City Treasurer based upon negotiation of
competitive bid. Such warrants-shall be redeemed in order of
their number out of the first monies next on hand and available
in said fund.
Section 4. This ordinance is one to provide for the immediate
preservation of the public peace, property, health,, safety and
welfare of the people of the City of Yakima and an emergency is .
hereby declared to exist and this ordinance shall be in full
force and effect immediately upon its passage, approval and
publication as provided by law and by the City Charter.
PASSED by the Council of the City of Yakima, Washington, and
approved by its Mayor, at a siDecial meeting of said Council held
this day of Al 1977.
