AN ORDINANCE accepting the recommendation of the Planning Commission
and rezoning property located on South Naches Avenue
north of Arlington Street from R-3, Multiple Family
• Zone, to M-1, Light Industrial Zone.
WHEREAS, pursuant to due and legal notice, the City Council of
the City of Yakima held a hearing on the 7th day of November, 1977,
upon the recommendation of the Planning Commission that real property
situated on South Naches Avenue north of Arlington Street in the City
of Yakima, Washington, the legal description of which is set out
hereinbelow, be rezoned from R-3, Multiple Family Zone, to M-1, Light
Industrial Zone, and
WHEREAS, the City Council finds that such recommendation of
the Planning Commission for such rezoning should be approved for the
reasons that such rezoning is in accord with good planning and with
the General Plan of the City of Yakima; that the majority of property
owners in the vicinity do not oppose the change in classification;
that the needs of the City and community do require such change and
that the highest and best use of said property is for Light Industrial
Zone, now, therefore,
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. The recommendation of the Planning Commission that
the following described real property situated on South Naches Avenue
north of Arlington Street in the City of Yakima, Washington, and
more particularly described as follows, to wit:
Lots 3 through 8, Block J, South Park Addition, as recorded
in Volume "B" of Plats, page 2, records of Yakima County,
Washington,
be rezoned from R-3, Multiple Family Zone, to M-1, Light Industrial
Zone, be, and the same is hereby, approved and said real property
is hereby rezoned to Light Industrial Zone, provided, this rezone
is granted subject to the following conditions, and the rezone shall
not be effective until Noel Canning Company complies with those
conditions, as follows:
1. The existing parking strip (planting strip) along the
full distance of the east boundary of the rezoned area, adjacent
to Naches Avenue, shall be planted with street trees on 40 foot
centers, and of a variety recommended by the City street tree
committee.
2. A cyclone type fence, six feet in height and with
red/brown aluminum strips for sight screening, shall be installed
three feet behind the sidewalk along the full distance of the
east boundary of the rezoned property, adjacent to Naches Avenue,
and along the full distance of the south boundary of the rezoned
property, adjacent to Arlington Street; and that arborvitea shall
be planted on 3 foot centers along the entire length of the fence
as described herein.
3. An automatic irrigation system shall be installed along
the full distance of the east and south boundaries of the rezoned
property, adequate to properly irrigate the landscaping improve-
ments required by conditions imposed by the foregoing paragraphs
1 and 2 hereof.
4. Noel Canning Corporation shall file with the City a letter
of agreement authorizing the City to hire maintenance work to be
performed at the expense of Noel Canning Corporation to maintain
the landscaping improvements required hereinabove in the event the
Director of Community Development, in his sole discretion, deems
it necessary to do so because of the failure of Noel Canning 111
Corporation to properly maintain those improvements.
Section 2. The above change in zoning shall be included
depicted on the next regularly amended Use District Map prepared
by and for the City.
Section 3. The City Clerk is hereby authorized and directed
to file with the Yakima County Auditor a certified copy of this

Section 4. This ordinance shall be in full force and effect
thirty days after its passage, approval and publication as pro-
vided by law and by the City Charter.
PASSED BY THE CITY COUNCIL, signed and approved this
