ORDINANCE NO. ai 6 AN ORDINANCE of the City of Yakima, Washington approving and confirming the assessments and assessment roll of Local Improvement District No. 1001, levying assessments against the several lots, tracts and parcels of land as • shown on the assessment roll, fixing interest and penalties, and providing for the payment of such assess- merits, interest and penalties into the Local Improvement District No. 1001 Fund of the City. WHEREAS, the City Council of the City of Yakima, Washington, (the "City") has provided that a hearing on the assessment roll in Local Improvement District No. 1001 should be held at 3:00 p.m. on February 27, 1978, at the City Hall in Yakima, Washington; and- WHEREAS, notice of such hearing was published at the times and in the manner required by law; and_ WHEREAS, notice of such hearing was also mailed to the owners and reputed owners of the land in Local Improvement District No. 1001 at the addresses shown on the tax...rolls of the Treasurer of II! Yakima County, Washington, more than 15 days prior to the date fixed for the hearing; and WHEREAS, at said hearing the City Council considered all objections to the assessment roll and determined that said objections were without merit and should be overruled except as hereinafter provided; NOW, THEREFORE, BE IT ORDAINED by the Council of the City of • Yakima, Washington, as follows: Section 1. Except as provided, herein all protests against the assessment roll in Local Improvement District No. 1001 of the City are overruled and disallowed and the assessment roll as prepared and on file with the City Clerk shall be and the same is • hereby approved and confirmed. The amount of the assessment roll as now confirmed is $ 1,836,794 . • • Section 2. Said assessment roll shall be modified and certain assessments thereon changed as set forth in Exhibit A attached hereto and incorporated by reference herein. • Section 3. Each of the lots, tracts and parcels of land appearing on the assessment roll is hereby declared to be speci- ally benefited by the improvements constructed in Local Improve- ment District No. 1001 in at least the amount charged against such property, and the assessments appearing against each are in proportion to the total assessments appearing upon the assessment roll. There is hereby levied and assessed against each such lot, tract and parcel of land the amount appearing on the assessment roll as modified by Section 2 hereof. Section 4. Each assessment or any portion thereof may be paid at any time within 30 days from the date of the first publi- cation of the notice of collection of assessments in Local Im- provement District No. 1001 without penalty, interest or costs, and thereafter the sum remaining unpaid, if any, may be paid in 20 equal annual installments, with interest on the whole unpaid sum at the rate of 8% per annum or such lesser rate as may here- after be fixed by ordinance. One year from the expiration of such 30 -day period and each year thereafter, one of the insta- llments shall become due and shall be collected as provided by law. Annual installments may be prepaid in the manner provided by law. Section 5. The assessment roll shall be filed with the City Treasurer for. collection. The Treasureer shall publish notice as required by law that the assessment roll is in his hands for collection and that any assessments or portion thereof may be paid at any time within 30 days from the date of the first publication -2- of said notice without penalty, interest or costs. The notice of assessment shall be in substantially the following form: NOTICE OF ASSESSMENT LOCAL IMPROVEMENT DISTRICT NO. 1001 YAKIMA, WASHINGTON Notice is hereby given that the assessment roll for the improvement of property located within Local Improvement District No. 1001, Yakima, Washington, for the construction and installa- tion of street improvements of the City is in my hands for collec- tion. All or any portion of any assessment may be paid within 30 days from (the date of the first publication of this notice) without penalty, interest or costs and the unpaid balance, if any, may be paid in equal annual installments with interest thereon at the rate of percent ( %) per annum, or the lien of any such assessment may be discharged at any time after the first 30 days following the date of the first publication of this notice by paying the entire amount of the assessment remaining unpaid with interest thereon to the due date of the installment next falling due. Treasurer, Yakima, Washington Section 6. Within 15 days of the first newspaper publication as provided in the foregoing section, the City Treasurer shall notify each owner or reputed owner whose name appears on the assessment roll, at the address shown on the tax rolls of the County Treasurer, for each item of property described on the list, of the nature of the assessment, of the amount of his real prop- 111 erty subject to such assessment, of the total amount of assessment -3- due, and of the time during which such assessment may be paid without penalty, interest or costs. Section 7. All assessments, including interest and penalties thereon, levied as authorized herein shall be paid into the Local Improvement District No. 1001 Fund. Section 8. This ordinance shall become effective upon its passage and publication.
