AN ORDINANCE relating to fire codes; adopting by reference the
Uniform Fire Code, 1976 Edition, copyright 1976 by
the International Conference of Building Officials
II/ and the Western Fire Chiefs Association, and making
deletions therefrom and amendments thereto; and amend-
ing Sections 10.05.010, 10.05.020, 10.05.025, and
repealing Section 10.05.065, all of the City of Yakima
Municipal Code.
WHEREAS, R.C.W. 35.21.180 authorizes cities and towns within
the State of Washington to enact ordinances which adopt by reference
compilations and codes, including fire codes, and
WHEREAS, R.C.W. 19.27.030 mandates that on and after January 1,
1975, there shall be in effect in all cities of the state a state
building code which shall include the Uniform Fire Code with appen-
dices thereto, 1973 Edition, and
WHEREAS, R.C.W. 19.27.040 authorizes cities within the state
to amend the state building code and to adopt subsequent revisions
thereof, and
WHEREAS, the City Council of the City of Yakima has heretofore
examined and understands the scope and purpose of the regulations
of the Uniform Fire Code, and appendices thereto, 1976 Edition,
copyright 1976 by the Western Fire Chiefs Association and the Inter-
national Conference of Building Officials and deems it in the best
interests of the City of Yakima that such code, as amended by this
ordinance, be adopted as the fire code of the City of Yakima, and
WHEREAS, three copies of such Uniform Fire Code have heretofore
been filed and are now on file in the office of the City Clerk of
the City of Yakima for use and examination by the public, as required

by law, now, therefore,
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. Section 10.05.010 of the City of Yakima Municipal
Code is hereby amended to read as follows:
"10.05.010 Adoption of codes. The Uniform Fire Code
with appendices thereto, 1976 Edition, published by the
International Conference of Building Officials and the
Western Fire Chiefs Association, of which not less than
three copies are filed in the office of the City Clerk
of the City of Yakima, and are hereby adopted and incor-
porated as fully as if set out in full herein, as the
fire prevention code of the City, except as hereinafter
amended, and the provisions and regulations thereof are
hereby adopted as the provisions and regulations of the
City, and the several sections or numbers therein shall
constitute, and may be referred to as, the numbers
of this Chapter."
Section 2. Section 10.05.020 of the City of Yakima Municipal
Code is hereby amended to read as follows:
"10.05.020 Deletion from the Uniform Fire Code.
Article 12, 'Fireworks', is hereby deleted in its entirety
from the Uniform Fire Code."
Section 3. Section 10.05.025 of the City of Yakima Municipal III
Code is hereby amended to read as follows:
"10.05.025 Amendments to the Uniform Fire Code.
Section 1.216 'Compliance With Recognized Standards',
of the Uniform Fire Code, 1976 Edition, is hereby amended
to read as follows:
'Section 1.216. Whenever the Uniform Fire Code,
1976 Edition, is inapplicable for any reason to any
situation involving the protection of persons and proper-
ty from the hazards of fire and explosions, the materials,
methods of . construction, installation, practices, or
operations necessary to provide such protections shall,
to a reasonable degree, be in accordance with nationally
recognized and accepted standards, principles and tests
and generally recognized and well established methods of
fire prevention and control as set forth in the following
publications by recognized national authorities and techni-
cal or scientific organizations, which are adopted by
reference as part of this code as though set forth herein
in full:

Section 4. Section 10.05.065 of the City of Yakima Municipal
Code is hereby repealed.
Section 5. This ordinance shall be in full force and effect
thirty days after its passage, approval and publication as provided
by law and by the City Charter,
