AN ORDINANCE providing for the vacation or a portion of public street
in the City of Yakima, Washington.
WHEREAS, a petition has been filed with the City Council of the
0 City of Yakima requesting the vacation of the hereinafter described
portion of public street, and
WHEREAS, a hearing by the City Council was duly held on said
petition, and as a result of such hearing the City Council finds it
to be in the best interests of the City of Yakima that said petition
be granted and that said portion of street be vacated, now, therefore,
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. The following described portion of street in the
City of Yakima, Washington, to wit;
Beginning at the northwest corner of Lot 15 of Philips. Subur-
ban Tracts, recorded in Volume "I" of Plats, page 12, records
of Yakima County, Washington; thence southerly along the west
line of said lot 64.5 feet to the southwest corner of said lot,
the real point of beginning; thence westerly along the south
line extended of said lot 50 feet to the east line of Lot 14
of said plat; thence south along the east line of said Lot 14
to a point 25 feet north of the southeast corner of said Lot 14;
thence east to the west line of Lot 17 of said plat; thence
north along the west line of Lots 17 and 16 of said plat 70.5
feet to the real point of beginning,
be, and the same is hereby, vacated.
Section 2. The City of Yakima hereby reserves all necessary
easements and rights of way for the installation and maintenance of
any and all water mains, sewers or utilities of any and all kinds which
may now exist in said street or which it may hereafter desire to con-
struct therein, and no building or other structure shall be constructed
on any portion of said vacated street without the prior approval of
the City.
Section 3. This ordinance shall be in full force and effect
thirty days after its passage, approval and publication as provided
• by law and by the City Charter; provided, this ordinance shall not
become effective until the owners of property abutting upon that por-
tion of the vacated street above described shall compensate the City
in the amount of $1,269, that amount being one-half the appraised
value of the area vacated by this ordinance.
