AN ORDINANCE relating to fire protection; authorizing and regulat-
ing private fire alarm systems and alarm receiving
systems connected to or installed within facilities
owned or operated by the City; and enacting Chapter
10.03, "Private Fire Alarm System Connection and
411 Monitoring", and Sections 10.03.010, 10.03.020,
10.03.030, 10.03.040, 10.03.050, 10.03.060,
10.03.070, 10.03.080, 10.03.090, 10.03.100,
10.03.110 and 10.03.120 as a new chapter and new
sections of the City of Yakima Municipal Code.
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. Chapter 10.03, "Private Fire Alarm System Con-
nection and Monitoring", and Sections 10.03.010, 10.03.020,
10.03.030, 10.03.040, 10.03.050, 10.03.060, 10.03.070, 10.03.080,
10.03.090, 10.03.100, 10.03.110 and 10.03.120 thereof are hereby
enacted as a new chapter and new sections of the City of Yakima
Municipal Code to read as follows:
"Chapter 10.03
PRIVATE FIRE ALARM SYSTEM CONNECTION AND MONITORING
10.03.010 Purpose and scope of chapter. The pur-
pose of this chapter is to authorize and regulate private
fire alarm systems and alarm receiving systems con-
nected to or installed within facilities owned by the
City; to adopt standards for private fire alarm instal-
lation and maintenance; to adopt procedures for authoriz-
ing the installation and connection of such systems to
City facilities; to require fees for services provided
by the City; and to assure a reasonable degree of
reliability against equipment failure and false alarms.
• 10.03.020 Applicability to existing private fire
alarm systems and alarm receiving s stems. This chapter
shall apply to all existing private fire alarm systems
and alarm receiving systems which continue to be connected
to or installed within facilities owned or operated by
the City after the effective date of this chapter; and
this chapter shall also apply to any future such systems
and installations.
10.03.030 Definitions. As used in this chapter,
unless a different meaning clearly appears from the
context, the following words and phrases shall have
the following meanings ascribed to them:
1. 'City Fire Alarm Center' shall mean the muni-
cipal fire communications and dispatch control
point owned and operated by the City of Yakima.
2. 'Private fire alarm system' shall mean a system
installed within a building used for the pur-
pose of detecting and/or suppressing a fire
410 condition.
3. 'Alarm receiving system' shall mean a system,
either privately owned or municipally owned,
used to receive and record electrical signals
from a remote location and connected to a pro-
tective fire detection and/or fire suppres-
sion system used for the purpose of summoning
assistance.
10.03.040 Installation authorized. Installation

of private fire alarm systems connected to or to be con-
nected to alarm receiving systems installed in the City
Fire Alarm Center shall be permitted as authorized by
a permit for such installation, which permit shall be
applied for and obtained in accordance with provisions
of this chapter.
10.03.050 Application for permit--Fee. Applications
for permits for the connection of private fire alarm systems
or installation of alarm receiving systems in the City
Fire Alarm Center shall be made to the Office of Code
Administration at 129 North 2nd Street, Yakima, Washing-
ton. A permit fee of $50 shall be paid to the Yakima
City Treasurer for each private fire alarm system con-
nection to the municipally owned fire alarm circuit,
which fee shall be paid prior to the connection to the
municipally owned fire alart circuit.
10.03.060 System plan to be filed. Prior to the
installation or modification of a private fire alarm
system connected to an alarm receiving system installed
in the City Fire Alarm Center, or an alarm receiving
system installed in the City Fire Alarm Center, two
copies of the system plan, consisting of specifications
and wiring diagrams, and two copies of the floor plan
of the building or premises to be protected by the private
fire alarm system, shall be filed in the City of Yakima
Office of Code Administration, and shall be subject to
approval as provided by Section 10.03.070 of this chapter
, before a permit shall issue.
10.03.070 Alarm system standards. All private fire
alarm systems connected to City of Yakima owned facili-
ties and all alarm receiving systems installed in the
City Fire Alarm Center shall comply with Standards No.
72B, 72C, or 72D, 1975 Edition, and with Standard No. 110
72E including Appendices A and B, 1974 Edition, of the
National Fire Protection Association.
10.03.080 Installation costs. The owner shall
pay all costs and bear any other expense incidental to
the installation of alarm receiving equipment in the
City Fire Alarm Center, which shall be accomplished at
no expense to the City.
10.03.090 Ownership--Maintenance.
A. Owner's responsibility. Private fire alarm systems,
including alarm receiving equipment installed in the City
Fire Alarm Center, shall remain the property of the pri-
vate system owner who shall make, or cause to be made,

all repairs to and otherwise perform service on such
equipment within twenty-four hours after notification
by the Yakima Fire Department of the necessity for any
such repair or service.
B. Maintenance agreement required. The owner or operator III
of each private fire alarm system connected to alarm receiv-
ing equipment installed in the City Fire Alarm Center shall

execute a written inspection and maintenance agreement
with a person, firm or corporation engaged in the busi-
ness of alarm system maintenance, a copy of which agree-
ment shall be submitted to the Office of Code Adminis-
tration and shall be maintained on file at the Yakima
Fire Department.
C. Exception to maintenance agreement requirement.
II/ The requirement of Subsection B of this section shall
not apply to any private fire alarm system which is
inspected and maintained by the owner or operator of the
system or the occupant of the protected premises in
accordance with a program approved by the Yakima Fire
Chief or his designate.
10.03.100 Transmitter equipment--Fee. A fee of
$3.00 per month for each signal code transmitter device
shall be paid to the City of Yakima by the owner or
operator of each private fire alarm system connected to
alarm receiving equipment in the City FireAlarm Center,
which fee shall be paid at such times and in such accumula-
tive amounts as may be billed from time to time by the
City.
10.03.110 Waiver of liability. The owner of
premises protected by a private fire alarm system with
alarm receiving equipment in the City Fire Alarm Center,
and the occupant of those premises if occupied by some-
one other than the owner, and the owner and operator
of such private system, shall file with the City Office
of. Code Administration a waiver of liability releasing
the City of Yakima, its agents, officers and employees
from any increased duty or increased standard of care
in detecting or suppressing any fire, or in responding
to any alarm, where such increased duty or increased
standard of care may otherwise result from the instal-
lation of a system pursuant to this chapter, which waiver
of liability shall further absolve the City of Yakima,
its agents, officers and employees from liability for
all damages and liability of any nature based or result-
ing from the installation of the private fire alarm
system and alarm receiving equipment, which waiver shall
include a provision absolving the City of Yakima, its
agents, officers and employees from liability for all
damages and liability arising from any malfunction or
failure of the fire alarm circuit or appurtenant equip-
ment or devices. The waiver shall be executed on
forms provided by the City and shall be submitted to
the City Office of Code Administration and maintained
on file in the administrative offices of the Yakima Fire
Department prior to the installation of the private fire
alarm system.
10.03.120 Disconnection of equipment. The Fire Chief
or his designate may disconnect or remove any fire alarm
receiving equipment from the City Fire Alarm Center or
discontinue service to any private fire alarm system
in the event the owner or occupant of the premises pro-
tected by the system or the owner or operator of the
alarm receiving system fails to comply with the require-
ments of this chapter."
Section 2. This ordinance shall be in full force and effect
thirty days after its passage, approval and publication as provided
by law and by the City Charter.
