Q.//e 1111 AN ORDINANCE providing for the improvement of cnn f y by constructing water mains, fire and other appurtenances therefor for the purpose of supplying water for domestic use, fire mt a n ish- tion and other purposes to said property; ing a Local Improvement District, providing for the method of payment thereof, and creating a special fund. BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. The following described property situate in Yakima County, Washington, shall be improved by constructing,water mains, fire hydrants, valves and other appurtenances therefor for the purpose of supplying water for domestic use, fire protection and other purposes to said property: The South 200 feet of the East 654 feet of the following described tract: That portion of the Northeast 1/4 of the Northwest 1/4 of Section • 35, Township 13 North, Range 18, E.W.M., described as follows: Beginning at the Northeast corner of said subdivision; thence South along the East line of said subdivision 600 feet to the North right of way line of a lateral from the Natchez and Cowichye Ditch (as said lateral was located and existed on November 25, 1905) and the True Point of Beginning of the herein described tract; thence South along the East line of said subdivision 710 feet, more or less to the Southeast corner of said subdivision; thence West along the South line of said subdivision to the Southeast corner of the West half of the West half of the North- east 1/4 of the Northwest 1/4 of said Section 35; thence North along the East line of said West half of the West half of the Northeast 1/4 of the Northwest 1/4 of said Section 35 to a point 573.5 feet South of the North line of said subdivision; thence East 389.5 feet, more or less, to the Easterly or Northerly 410 right of way line of a lateral from the Natchez and Cowichye; thence Southeasterly along the Northerly right of way line of said lateral 612.5 feet, more or less, to the true point of beginning. EXCEPT that portion thereof described as follows: Beginning at the Northeast corner of said subdivision; thence South along the East line of said subdivision 600 feet to the North right of way line of a lateral from the Natchez and Cowichye Ditch (as said lateral was located and existed on November 25, 1905) and the True Point of Beginning of the herein described tract; thence South along the East line of said subdivision 398.45 feet to a point situate 998.45 feet South from the Northeast corner of said subdivision; thence South 88° 07' West 593.58 feet; thence North 0 00' West 220.30 feet; thence North 17 19' West 244.3 feet; thence South 89 51' 48" East 52.5 feet, more or less, to the Easterly or Northerly right of way line of a lateral from the Natchez and Cowichye Ditch; thence Southeasterly along the Northerly right of way line of said lateral 612.5 feet, more or less, to the True Point of Beginning. • - , AND EXCEPT that portion thereof lying within the right of way of South 24th Avenue. and ID The North 200 feet of the East 654 feet of the following described Tract: Parcel A: That portion of the Northeast quarter of the Southeast quarter of the Northwest quarter of Section 35, Township 13 North, Range 18, E.W.M., lying North of the center line of Wide Hollow Creek, EXCEPT the East 20 feet for County Road and EXCEPT beginning at a point 924.1 feet North of the Southeast corner of the Northwest quarter of said Section; thence West 167 feet; thence South 214 feet, more or less, to the center line of Wide Hollow Creek; thence Northeasterly along said center line to the East line of said Northwest quarter; thence North 100 feet, more or less, along said East line to the point of beginning. Parcel B: That portion of the West half of the Southeast quarter of the Northwest quarter of Section 35, Township 13 North, Range 18, E.W.M., lying North of a line beginning at a point on the East line of said West half 894 feet North of the Southeast corner of said West half; thence Northwesterly in a straight line to a point in the West line of said West half which said'point is situate 978 feet North of the Southwest corner of said West half:" _ - Section 2. There js hereby created a Local Improvement Dis- trict, to be called "Local Improvement District No. 1021," which said district shall include all of the above described property. Section 3. The assessments shall be made according to special benefits derived from the improvements without regard to the zone and termini method. Section 4. All costs and expenses in connection with the construction of said improvements, including the cost and expenseill, of engineering, inspection, advertising, publication of notices, and all other expenses incident thereto, shall be levied and assessed upon all of the property embraced within said Local Improvement District, in the manner and as provided by the laws of the State of Washington and the ordinances of the City of Yakima, and said City shall not be liable in any manner for any portion of said costs and expenses of said improvement. Section 5. All of the aforesaid construction work shall be in accordance with the plans and specifications, profiles, maps and detailed drawings which have been prepared by the City Engineer filed with the City Clerk, and which are hereby approved and adopted. -2- Section 6. All of the work necessary to be done in connec- tion with the making of said improvement shall be done and made by contract upon competitive bids, and the City shall have the power to reject any and all bids. 110 Section 7. There is hereby created a special fund, to be called "Local Improvement Fund, District No. 1021", into which shall be placed all sums paid on account of the aforesaid special assessments all interest and penalties thereon, and in the event of the sale of local improvement bonds by the City, all premium and interest on said bonds issued for said improvement. Section 8. Bonds bearing interest at a rate not to exceed 8% per annum, payable on or before 12 years from the date of issuance, shall be issued in payment of the costs and expense of said improvement, which bonds shall be redeemed by the collec- tion of special assessments to be levied and assessed upon the property within said district, payable in ten equal annual installments with interest at a rate not to exceed 8 1/2% per annum, interest payable annually under the mode of payment "payment by bonds", as defined by the statutes of the State of Washington and ordi- nances of the City of Yakima, provided that, this improvement may be financed by the issuance of promissory notEs, under the authority of R.C.W. 35.45.150 and Section 8.12.100 of the City of Yakima Municipal Code. Section 9. This ordinance is one relating to local improve- ments or assessments therefor, and shall become effective immediately upon its passage, approval and publication as provided by law and by the City Charter.
