ORDINANCE NO. 42;1424 AN ORDINANCE relating to public services and utilities; imposing a sewer service charge and fixing sewer service rates and charges; amending Sections 7.60.010, 7.60.020 and 7.60.030, and enacting new Section 7.60.031, all of the City of Yakima Municipal Code. BE IT ORDAINED BY THE CITY OF YAKIMA: • Section 1. Section 7.60.010 of the City of Yakima Municipal Code is hereby amended to read as follows: "7.60.010 City to fix and collect sewerage rates and charges. The public health, safety and welfare require that the City of Yakima fix and collect sewerage rates and charges upon, and measured by water served to, premises in the City of Yakima and areas outside the corporate limits of the City, for the carrying and discharge of all sewage and drainage into the muni- cipal sewer system of the City of Yakima as presently 410 maintained and operated, together with additions and betterments thereto and extensions thereof, which rates and charges are fixed by this chapter; provided, that the specifying of service rates and charges by this chapter shall not affect the financing of construction of sewers and trunk sewers pursuant to the local improve- ment district process, the imposition of a Sanitary Sewer Capital Cost Recovery Charge, or other alternate means of financing such construction; provided, further, the adoption of rates fdr service to property outside the corporate limits of the City does not constitute an undertaking by the City to serve any or all such property without compliance with other laws, regulations and policies of the City pertaining to the furnishing of city sewer service outside city corporate limits." Section 2. Section 7.60.020 of the City of Yakima Municipal Code is hereby amended to read as follows: "7.60.020 Sewer service charge. • A. Rates--Minimum charge. There shall be charged to and collected from all premises within the City served by the city sewer system a sewer service charge composed of a ready-to-serve charge and a volume charge based on domestic water consumption; provided, in no event shall the total sewer service charge be less than $2.00 per month for premises inside the city limit boundary nor less than $3.00 per month for premises outside the city limit boundary. The sewer service charge shall be calculated and charged according to the following schedules: 1. Volume charge: For all customers, the volume charge shall be 1 $0.41 per 100 cubic feet of water consumption. B. Rate to property outside City. For customers located outside the City, a 1.5 multiplier shall be applied to the billings calculated in accordance with the rates for inside-City customers, except that such 1.5 mul- tiplier shall not be applied to the strong-waste surcharge. C. Strong waste surcharge. For industrial customers discharging wastewater which contains more than 300 parts per million of Biochemical Oxygen Demand (BOD) or more than 300 parts per million of Suspended Solids (SS), there shall be a surcharge, in addition to the ready-to- serve charge and the volume charge, which shall be 41/ calculated as. follows: Monthly Surcharge = (Unit costs per pound of BOD or SS) times (Weight of one gallon of water) times (Customer's flow in million gallons per month) times (Customer's concentration of BOD or SS in parts per million minus 300) In the foregoing formula: Unit cost per pound for BOD = $0.0704 Unit costs per pound for SS = $0.0303 Weight of one gallon of water = 3.34 pounds' Section 3. Section 7.60.030 of the City of Yakima Municipal Code is hereby amended to read as follows: "7.60.030 Sewer charge added to and payable with water bill. The sewer service charge provided for in this chapter shall be payable at the office of the iqp Treasurer of the City of Yakima, and shall be billed for and payable at the same time as the water bill for the premises is payable; and payment for water service shall not be accepted unless payment of the sewer ser- vice charge is made at the same time. The same shall be payable bimonthly and shall be added to city water bills as a separate charge thereon." Section 4. Section 7.60.031 is hereby enacted as a new section of the City of Yakima Municipal Code to read as follows: "7.60.031 Rate for premises not connected to sewer. All property owners within the area served by the city sewer system shall connect their private sewers with the city system; provided, in the event any property within the area served by the city sewer system is not so connected to the system, a penalty is hereby imposed against the owner, occupant or other person responsible for that property in an amount equal to the minimum sewer service charge applicable to that property, as provided by Section 7.60.020 of this chapter." -2- 411 Section 5. This ordinance shall be in full force and effect thirty days after its passage, approval and publication as provided by law and by the City Charter. 411 PASSED BY THE CITY COUNCIL, signed and approved this day of Od , 1978.
